Three key Trump figures intersect two Justice Department probes 

Three key figures connected to former President Trump are at the intersection of two accelerating Justice Department probes seen as the most viable pathways for a prosecution of the former president.    

Special counsel Jack Smith is overseeing what began as two entirely separate cases: the mishandling of classified records at Mar-a-Lago and the effort to influence the 2020 election that culminated in the Jan. 6, 2021, attack on the Capitol.      

Several Trump World figures straddle both events, providing prosecutors with what experts say is a potent opportunity to advance both investigations.      

Alex Cannon, Christina Bobb and Kash Patel played different roles in the two sagas, but each has been sought by the Justice Department in the documents dispute and has also been called in by the special House committee, now disbanded, that investigated the Jan. 6 riot.    

Cannon, a longtime Trump Organization employee, was pulled into campaign efforts to assess allegations of voter fraud and then served as a liaison for Trump with the National Archives as officials there pushed for the recovery of presidential records.  

Bobb, a lawyer for Trump’s 2024 campaign, aided in the Trump 2020 campaign’s post-election lawsuits. She later shifted to doing legal work for Trump that culminated in her signing a statement asserting classified records stored at Mar-a-Lago had been returned.   

Patel was chief of staff to the secretary of Defense as the Pentagon was grappling with Jan. 6. Trump also named Patel as one of his representatives to the National Archives upon leaving office, and he was later one of Trump’s chief surrogates in pushing claims that the former president declassified the records discovered in his Florida home.  

It’s unclear whether any of the trio faces significant legal exposure, but their unique positions could be valuable for Smith, who is racing forward with both cases. In recent weeks, Smith has subpoenaed former Vice President Mike Pence and former White House chief of staff Mark Meadows, while securing another batch of materials from Mar-a-Lago.  

“Typically, you don't have two separate investigations and two separate sets of possible crimes to work with as you're negotiating. Smith does have that here,” said Norm Eisen, a counsel for Democrats during Trump’s first impeachment who has penned analyses of both cases.     

“For him, it's like a two-for-one sale. If he cuts a cooperation deal with some of these individuals, he can advance multiple cases at the same time,” Eisen added.     

Patel was granted immunity by a judge and compelled to answer questions in the Mar-a-Lago case after being previously subpoenaed to appear before a grand jury and repeatedly pleading the Fifth. Bobb has also spoken with prosecutors in relation to the case and testified before a grand jury. And the Justice Department is seeking to speak to Cannon about his dealings with the National Archives, The New York Times reported

“I think that is a potential fruitful avenue for the Justice Department in these cases,” said Barbara McQuade, a former U.S. attorney under President Obama. “Their overlap in the two cases is very interesting, because you could use criminal exposure in one case to flip them in the other case.” 

Attorneys for Cannon and Bobb did not respond to multiple requests for comment for this story, while a spokesperson for Patel declined to comment. The Trump campaign also did not respond to request for comment.  

To be clear, other figures also may have insight into the two probes, including Meadows and former deputy White House counsel Patrick Philbin. Former White House attorney Eric Herschmann is also reported to have warned Trump about holding records at Mar-a-Lago.     

Still, the trove of transcripts released by the House Jan. 6 committee offers a window into three figures who, despite diverging paths, became central in the Mar-a-Lago probe. 

Bobb and Patel, who now serves on the board of Trump’s social media enterprise, remain deeply enmeshed with the former president.      

Cannon was most recently employed by Michael Best, a law firm that in December severed its ties with several Trump-connected attorneys, including Stefan Passantino, who represented former aides before the Jan. 6 panel. The firm also allowed contracts with Cannon and former Trump deputy campaign manager Justin Clark to lapse, Bloomberg News reported

The firm did not respond to a request for comment.   

Cannon, who was initially hired to work on contracts for the Trump Organization, expressed hesitation during interviews with the Jan. 6 panel about being pulled into working on fraud issues for the campaign as the pandemic brought hotel operations to a trickle.    

“I believe that the only reason I was asked to do this is because others didn't want to. I have no particular experience with election law or anything. I do vendor contracts,” he told the committee.     

When asked if he found that work undesirable, he responded, “I'm sitting here right now. Yes, it's undesirable.”      

The conversations show Cannon was tasked with evaluating a number of claims from “crazy people,” as he once described it, as well as other claims that dead people may have voted — something he was unable to verify given limitations in voter databases.  

He ultimately relayed those concerns to Pence, recounting to the committee in what would become a brief appearance in a hearing that “I was not personally finding anything sufficient to alter the results of the election.”      

It was a stance that caught the eye of former Trump adviser Peter Navarro.  

“Mr. Navarro accused me of being an agent of the deep state working … against the president. And I never took another phone call from Mr. Navarro,” Cannon said.     

Bobb, in contrast, made clear in her interview that she believed there was suspicious activity on Election Day that merited review.     

Once a reporter for the far-right One America News, Bobb had come to the network after working as an attorney, including during stints with the Marine Corps. She would later get a master of laws degree from Georgetown University, joining the Trump administration at the Department of Homeland Security after graduation.      

While working as a One America News employee, she volunteered her time to the Trump campaign immediately after the election. The arrangement was approved by the network, though the campaign required her to sign a nondisclosure agreement.     

“There was plenty of evidence to be concerned about fraud,” she said, even if the legal team wasn’t prepared to launch a case on the first day following the election. 

“I volunteered and I wanted to look into it because I was concerned about the integrity of my vote, of the country. I think that's why we all got involved. So I don't want you to take my statement and say, Christina Bobb said that in the beginning the legal team knew there was no fraud. That's not what I'm saying. I'm saying there was plenty of reason to believe there could be fraud.”

Bobb was present in the “war room” at the Willard Hotel on Jan. 6 and was listening in to Trump’s call with Georgia Secretary of State Brad Raffensperger — a discussion she told the panel was “unremarkable.”    

The Jan. 6 committee transcripts indicate Cannon and Bobb had no interaction throughout the litigation process, with Bobb saying they did not connect until after President Biden was sworn in. Bobb told investigators she didn’t speak with Cannon until later, adding nothing more when investigators asked if it was on an unrelated matter.     

Bobb’s role with Trump on the Mar-a-Lago documents picked up where Cannon left off.     

In February 2022, Cannon declined Trump’s request to sign a statement indicating all classified material at Mar-a-Lago had been returned because he wasn’t sure the statement was true, according to reporting from The Washington Post.      

Bobb would join the team later, agreeing to sign a declaration given to the Justice Department in June attesting that all sensitive government documents had been returned — with the stipulation that her attestation was “based upon the information that has been provided to me.”     

“The contrast between the two as lawyers speaks volumes,” said Josh Stanton, an attorney with Perry Guha who contributed to a model prosecution memo for the Mar-a-Lago case.  

“Alex Cannon refus[es] to sign a certification that everything had been turned over where he wasn't able to do himself the diligent work to actually independently verify that, whereas Christina Bobb is in a position where she's told to sign the certification, and is told that that's correct, then just goes ahead and signs it anyway,” he said.  

“Whether or not you could actually make out, say, criminal charges against Christina Bobb for signing that certification … it certainly puts her ethically, as a lawyer, in really hot water,” he added.     

Patel, who spoke to the Jan. 6 committee after being subpoenaed, began his deposition with an opening statement expressing frustration that the panel did not think he would be cooperative with its investigation.     

Patel later answered questions during a lengthy interview after noting privilege concerns, but investigators at times seemed baffled by details the former high-ranking Defense Department official could not remember. Patel struggled to recall specifics about some conversations with Trump and demurred when asked about reported plans near the end of the Trump presidency to install him as head of the CIA.    

“I know you guys try to think this is improbable, but I was in one of those positions for a two-year period of time, approximately, where I had many conversations with the president impacting things that I would only read about or watch in movies,” he said.      

“So, after a certain period of time, they tend to stack up and you just do the mission,” Patel added.     

Patel largely sidestepped questions on whether Trump should have done more to stop the chaos on Jan. 6, but spoke at length about the process for securing assistance from the National Guard and Trump’s approval for the use of as many as 20,000 troops that day.     

The committee panned Trump’s inaction as dereliction of duty, and Stanton said Patel’s comments could forecast a response should Trump or others face culpability for Jan. 6.  

“Some of the most powerful testimony in the hearings themselves was the sort of hours Trump seemed not to act. And so I think he's previewing what they're going to say, which is, ‘Oh, no, I actually did authorize 10,000 or 20,000 National Guard members to be able to respond,’” he said.

In the Mar-a-Lago probe, Patel repeatedly asserted his Fifth Amendment rights during his first appearance before a grand jury.     

“Trump declassified whole sets of materials in anticipation of leaving government that he thought the American public should have the right to read themselves,” Patel told Breitbart News in May.     

“The White House counsel failed to generate the paperwork to change the classification markings, but that doesn’t mean the information wasn’t declassified,” Patel said. “I was there with President Trump when he said ‘We are declassifying this information.'”     

Trump’s attorneys have not directly backed that claim, though it would not be a bulletproof defense should he face Espionage Act charges, as the law deals with those who mishandle “national defense information.”

The special counsel appears to be ratcheting up the probes in recent weeks, even seeking to pierce the attorney-client privilege of Evan Corcoran, one of Trump’s attorneys in the document dispute, arguing his legal advice may have been given in furtherance of a crime.

It’s a move observers say should give warning to other attorneys involved in the probe.     

“Any lawyer associated with Donald Trump is at great risk,” Eisen said. “I mean, he's like a neutron bomb for the legal profession.”  

Pence special counsel ‘more likely than not,’ says former WH ethics lawyer

Norm Eisen, a former Obama White House ethics lawyer, said Wednesday it's “more likely than not” a special counsel will be assigned to investigate classified documents found at former Vice President Mike Pence’s residence.

During an appearance on “CNN Newsroom,” host Abby Phillip asked Eisen, a legal analyst for the network, if the Justice Department would deploy a special counsel in Pence's case, as it has for former President Trump and President Biden.

“Abby, there’s no question the pressure is on Attorney General Merrick Garland to treat the Pence case as he treated the Biden and the Trump cases," Eisen told Phillip.

“But it's not assured that we're going to have a special counsel because, as the attorney general said yesterday, what DOJ does is try to look at every case on the facts and on the law,” Eisen added. “We need to know more details about Pence. It's more likely than not that we are going to get a third special counsel to look at the Pence situation.” 

Eisen was also a co-counsel for the House Judiciary Committee during then-President Trump’s first impeachment trial.

His remarks come a day after officials confirmed that classified documents were found at Pence’s Indiana residence, with his attorney, Greg Jacob, writing in a letter that Pence’s team notified the National Archives the week prior about the discovery of a small number of documents at the former vice president's residence. 

Pence’s attorney added in his letter to the Archives that his client was “unaware of the existence of sensitive or classified documents at his personal residence.”

In a Truth Social post, Trump said that his former vice president is “an innocent man. He never did anything knowingly dishonest in his life. Leave him alone!!!”

The discovery has complicated GOP attacks against Biden's handling of classified material.

“Politically, this makes it difficult if not impossible for the GOP to criticize Biden, w/out damaging Pence; the situations look very similar,” tweeted Joyce White Vance, a law professor and legal analyst on MSNBC.

Nikki Haley Turns On Trump – ‘We Need To Acknowledge He Let Us Down’

In an interview on Fridayformer U.N. Ambassador Nikki Haley came out of the box criticizing former President Donald Trump.

Her forceful comments, come in the wake of the Jan. 6 Capitol Hill riot, and also as Trump’s defense attorneys prepare to present their case in Trump’s second impeachment trial.

“We need to acknowledge he let us down,” she told Politico. “He went down a path he shouldn’t have, and we shouldn’t have followed him, and we shouldn’t have listened to him. And we can’t ever let that happen again.”

Haley, who is also the former governor of South Carolina, expressed anger over the harsh treatment she felt that former Vice President Mike Pence received at the hands of Trump.

“When I tell you I’m angry about it that’s an understatement,” she said. “I’m so disappointed in the fact that [despite] the loyalty and friendship he had with Mike Pence, that he would do that to him. Like, I’m disgusted by it.”

There are many who speculate that Nikki Haley is a strong contender for the GOP presidential nomination in 2024. However, she is also one of many so-called “establishment” Republicans who once backed Donald Trump, but are now are turning against him.

There have been many other high-profile Republicans who have come out and harshly criticized Trump for Capitol riot and have gone on to distance themselves from him.

But in doing that, are they distancing themselves from 75 million people who cast their vote for Trump just a few short months ago by essentially telling those people they were wrong to support him?

Sen. Mitt Romney (R-UT) cozied up to Trump when he was talked about as a possible Secretary of State. Then Trump chose someone else, and Romney has criticized him at every turn since. 

Rep. Liz Cheney (R-WY), on a recent appearance on Fox News Sunday, when speaking of Trump stated that, “that is a person who does not have a role as the leader of our party going forward.”

Will There Be A “New” Republican Party In 2024?

Nikki Haley may have presidential aspirations, but will the GOP be a different party in four years?

In her Politico interview,  she said, “I know how much people love Donald Trump. I know. I feel it. Whether it’s an RNC room, or social media or talking to donors, I can tell you that the love they have for him is still very strong. That’s not just going to fall by the wayside.”

However, she also said, “Nor do I think the Republican Party is going to go back to the way it was before Donald Trump. I don’t think it should.” 

But does she really think that? Does the establishment think they can override the will of 75 million Trump supporters and take the party back to the way it was pre-Trump? Many would argue that those 75 million people really want to do is purge the Republican party of squishy RINO’s and swamp creatures. 

Haley states that, “what we need to do is take the good that he built, leave the bad that he did, and get back to a place where we can be a good, valuable, effective party. But at the same time, it’s bigger than the party.”

Nikki Haley Before The Riot And Nikki Haley After The Riot

Nikki Haley’s establishment status as a squishy Republican who sides one way then another is not something she will be able to hide from American voters. In a report from Axios, prior to January 6, Haley stated that she genuinely believed that Trump believed he was wronged. 

She defended his refusal not to concede to Joe Biden, but said that she felt that his lawyers did him a “disservice by not telling him the truth of his loss.”

She equated Trump’s feeling of false election claims to being colorblind.

“That would be like you saying that the grass is blue and you genuinely believing it,” she explained. “Is it irresponsible that you’re colorblind and you truly believe that?”

Haley added that there was nothing anyone could do to make Trump believe that he legitimately lost the election.

After January 6, her positions seem to have changed. She says that we should have not followed him down the path we did, and she spoke of Trump’s treatment of Mike Pence, saying that the former president has lost “any political viability he was going to have.”

Haley also said she did not think Trump will run again. “I don’t think he can. He’s fallen so far.” This might be news to Haley and other RINO’s, but that is not certain.  

Politico reporter Tim Alberta stated, “I’ve also spoken with nearly 70 people who know her: friends, associates, donors, staffers, former colleagues. From those conversations, two things are clear. First, Nikki Haley is going to run for president in 2024. Second, she doesn’t know which Nikki Haley will be on the ballot.”

If Nikki Haley doesn’t know who is on the ballot, then voters don’t know who is on the ballot.

 

 

In the end, it’s clear that Haley is just the latest in a line of RINOS that think they have a chance of running for anything if they now distance themselves from Trump. She may soon find out how wrong she is about this.

Joy Behar Accuses Trump Of ‘Negligent Homicide’ For Capitol Riot

As the Senate impeachment trial against Donald Trump continues, “The View” cohost Joy Behar is accusing him of “negligent homicide” over last month’s riots at the Capitol.

During Thursday’s episode of “The View,” the hosts discussed the new footage that has come out showing the Capitol riots. Unsurprisingly, Behar took the opportunity to blame everything on Trump, just as she did for the entirety of his presidency.

“One of the arguments they’re giving on the Trump side of it is that he can’t be held responsible just for the basis of inflammatory speech,” Behar said. “The original permit of the event on the ellipse was not to authorize a march on the Capitol. It was not authorized.”

“According to what we heard yesterday, it wasn’t until Trump and his team directly involved in the event’s planning that the march came into the picture,” she added.

“They signed the permit to allow the mob to go on the Capitol, okay? That is not a free speech issue. That is action. That is actionable. He signed the permit that said ‘go ahead,'” she said.

Behar Accuses Trump Of ‘Negligent Homicide’

After accusing Trump of giving his supporters a “signal to go after Pence,” she concluded her rant by saying that Trump didn’t share his video address to the mob until hours after the riot took place.

“Now, to me, that is negligent homicide,” she said outrageously. “A cop was killed. Many were injured. Between the Pence act and the mob of the period of time between the assault on the Capitol and when Trump decides to talk and tell them calm down, that is negligent homicide.”

Behar then shared a quote from the George Orwell book “1984,” which goes, “The party told you to reject the evidence of your eyes and ears it was their final most essential command.”

These kinds of extreme attacks on Trump are nothing new for Behar. Last month, she bizarrely claimed that Trump “made it his business for four years to rape this country.”

Cory Booker Claims No More Evidence Is Needed To Conclude ‘Trump Violated His Oath Of Office’

Sen. Cory Booker (D-NJ) went on CNN on Thursday morning to claim that “we do not need more evidence to come to the conclusion that Trump violated his oath of office.”

In making this claim, Booker cited Trump’s “prolific tweeting,” and his silence as his followers tried to find then-Vice President Mike Pence and Speaker of the House Nancy Pelosi during the Capitol riots last month.

“They literally were saying they were taking direction from him. They were reading his tweet publicly out to other rioters as they chanted, ‘Hang Mike Pence,” Booker said. 

“I do not understand how you cannot look [at] this prolific tweeting that went on and then the silence afterward. This is a president that knows how to tell people to stop,” he added.

Booker Doubles Down

“I don’t know how you can’t look at the fact that it was well known that the riotous, murderous mob was in the Capitol for an hour plus, and then the two things you hear from the president is one, him replaying his own speech on Twitter and then telling the mob that Mike Pence had failed them,” Booker continued. 

“It is hard to even venture to say that the commander-in-chief who swore an oath to protect this sacred space did not fail in his duty, did not betray that oath,” Booker concluded. “We do not need more evidence, in my opinion, to come to the conclusion that … Donald Trump violated his oath of office.”

Trump Impeachment

This comes as Trump’s impeachment trial is ongoing in the Senate, with the former president being accused of inciting the Capitol riots last month.

He was already impeached by the House over this for a second time last month, but it remains to be seen whether Democrats will be successful in impeaching him in the Senate.

Earlier this month, Booker released a statement calling for the Senate to impeach Trump, saying that “it brings me no satisfaction to come to this conclusion. And yet we all swore an oath to  ‘support and defend the Constitution of the United States.’”

Meghan McCain Attacks Nikki Haley For Asking For Trump To Be Given A Break – ‘Most Disgusting Language I’ve Ever Heard’

On Wednesday’s episode of “The View,” host Meghan McCain spoke out to slam former United Nations Ambassador Nikki Haley, saying that it was “disgusting” for her to call for Trump to be given a “break” when it comes to the Capitol riots last month.

Haley’s Initial Comment

“They beat him up before he got into office and they’re beating him up after he leaves office,” Haley said at the end of January, according to Newsweek.

“I mean at some point, give the man a break. I mean, move on if you truly are about moving on,” she added.

McCain brought this up today while discussing the current impeachment effort.

McCain Lashes Out

“One thing that struck me was seeing President Trump talk about Mike Pence at his rally, and cutting to the footage of the people storming the Capitol and the vice president having to be rushed out immediately,” she said.

“Words have ramification. The rhetoric we put out have ramifications,” McCain added. “You can see in realtime what happens when you call Vice President Mike Pence a traitor, and then people are storming the Capitol screaming ‘Traitor Pence.’

“It’s something out of a dystopian science fiction movie,” she said.

McCain Lashes Out At Haley

“I don’t understand how anyone could vote against impeachment, but I do logically when it comes to the politics— the ethics I don’t understand — but the politics of this is Republicans want to move on,” McCain added. ”

“They want to walk the fine line of still being attached to Trump and not being attached to Trump. Nikki Haley said maybe in the most disgusting language I’ve ever heard, ‘Give the guy a break,” McCain said. “Well, it’s hard for me to give President Trump a break when our vice president could have been killed because of the things he was saying.”

“I think that I would love to see more Republicans come out and do the right thing ethically, but politics is going to come in the middle of this,” she concluded.

Liz Cheney Says ‘Massive Criminal Investigation’ Underway Into Whether Trump Incited ‘Premeditated Violence’ At The Capitol

Representative Liz Cheney (R-WY) claims there is a “massive criminal investigation underway” to determine if former President Trump is guilty of inciting “premeditated” violence on the Capitol.

Cheney made the startling assertion during an interview on “Fox News Sunday” with Chris Wallace.

The Republican lawmaker urged her colleagues in the Senate to consider the evidence that would be put forth during the upcoming impeachment trial.

“If I was in the Senate, I would listen to the evidence,” she said. “I think that is the role the Senate has as jurors.”

“I would also point out that the Senate trial is a snapshot. There’s a massive criminal investigation underway,” continued Cheney. “There will be a massive criminal investigation of everything that happened on Jan. 6 and in the days before.”

Liz Cheney – Trump the Subject of a Massive Criminal Investigation

Rep. Liz Cheney went on to suggest that the criminal investigation into Trump’s alleged role in the Capitol riots was to determine whether or not his actions were “premeditated.”

“People will want to know exactly what the president was doing,” Cheney said referencing a tweet in which the former President criticized vice president Mike Pence for not being courageous in combating the election results.

People “will want to know … whether that tweet, for example, was a premeditated effort to provoke violence,” she claimed.

Cheney’s rantings are nearly indiscernible from those of her colleague Rep. Maxine Waters (D-CA) who claims Trump should face premeditated murder charges for his alleged role in the riots.

“There’s information that some of the planning came out of individuals working in his campaign,” Waters said.

“As a matter of fact, he absolutely should be charged with premeditated murder because of the lives that were lost with this invasion, with this insurrection.”

Not an ounce of difference between what Waters has said and what Liz Cheney is trying to say with her criminal investigation comments about Trump.

Claims No Future For Trump in the Republican Party

Liz Cheney, during her interview with Wallace, went on to claim that Donald Trump has no future in the Republican party.

“Somebody who has provoked an attack on the United States Capitol to prevent the counting of electoral votes, which resulted in five people dying, who refused to stand up immediately when he was asked to stop the violence, that is a person who does not have a role as the leader of our party going forward,” she said.

“We should not be embracing the former president.”

The reality, however, suggests it is Cheney and the anti-Trump Republicans who are not being embraced by Republican voters.

One poll, released last month, shows a vast majority of Republicans do not hold Trump responsible for the Capitol riots, and a staggering 92 percent still see him as their preferred nominee in 2024.

Another poll shows an overwhelming percentage of Republican voters would follow him to a new political party if need be.

Cheney, one of the few Republicans to join the Democrats in their impeachment charade, was censured by the Wyoming Republican Party for her actions.

Former Clinton campaign adviser Dick Morris recently told Newsmax that she “has a snowball’s chance in hell of getting reelected.”

Whoopi Goldberg Goes Off On Republicans Who Voted Against Impeachment – ‘You’re Scared’

On Wednesday’s episode of the ABC talk show “The View,” cohost Whoopi Goldberg went off on the 45 Republican senators who dared to vote that a Senate impeachment trial against former President Donald Trump would be unconstitutional.

Impeachment Of Trump In The Senate Looks Unlikely

She went so far as to accuse the Republicans of being “scared” to convict him because “then their feet are going to be in the fire as well.”

Only five Republicans joined Democrats in voting against a motion put forth by Senator Rand Paul (R-KY) stating that having an impeachment trial for a president who has already left office is unconstitutional.

This means that it is extremely unlikely that Democrats will get the votes they need to actually impeach Trump in the Senate, as doing so would require far more than five Republicans to join them.

Goldberg Goes Off

This did not sit well with Goldberg, who proceeded to throw a temper tantrum on her show.

“A lot of the people that are saying, ‘No, we’re not going to vote for this,’ they’re protecting themselves because they know if he is convicted they are next,” Goldberg whined. “Because with all of those senators and congresspeople, all the people that are still saying, ‘No, he was cheated,’ then their feet are going to be in the fire as well.”

“See, with one lie, you can take them all down or raise them all up,” she added.

Goldberg went on to say, “If somebody would just say, ‘You know, I know that was his voice talking to the man in Georgia, I know that was his voice saying to people, yeah, you can peacefully go, but you know, this is not going to happen easily, you’re going to have to take what you want and Mike Pence is going to have to step up’ — You read the signs. I read the signs. You know what he said, and you know what you allowed to happen. You allowed it to happen.”

“All of you who are saying that this was a steal, the woman that was wearing the mask, you know what this was and you watched it happen and you let it happen,” Goldberg concluded. “Now you’re scared that if there is a vote that says, yeah, we’re going to impeach him, you all are on the line as well.”

Democrats are more desperate than ever to impeach Trump because doing so would prevent him from running for president again in 2024.
