Supreme Court Deals Major Blow To Texas, Louisiana In Deportation Lawsuit

The U.S. Supreme Court dealt a major blow to Texas and Louisiana Friday in a lawsuit over a Biden administration policy that’s helped effectively end most deportations of foreign nationals in the U.S. illegally.

Rather than rule on the merits of the case, in United States v. Texas, the court ruled 8-1 that the states didn’t have standing, or a legal right, to challenge the policy.

Justice Samuel Alito wrote the sole dissent, arguing the justices ignored “a major precedent.”

He wrote:

“The Court holds Texas lacks standing to challenge a federal policy that inflicts substantial harm on the State and its residents by releasing illegal aliens with criminal convictions for serious crimes.

In order to reach this conclusion, the Court brushes aside a major precedent that directly controls the standing question, refuses to apply our established test for standing, disregards factual findings made by the District Court after a trial, and holds that the only limit on the power of a President to disobey a law like the important provision at issue is Congress’s power to employ the weapons of inter-branch warfare – withholding funds, impeachment and removal, etc. I would not blaze this unfortunate trail. I would simply apply settled law, which leads ineluctably to the conclusion that Texas has standing.”

Last June, a federal judge in Texas, U.S. District Judge Drew Tipton, ruled in favor of Texas and Louisiana, arguing they would incur costs due to the federal government’s failure to comply with federal immigration law and deportation policies. The judge ruled the states had standing to sue because of these costs. He also vacated the deportation policy, arguing it was unlawful.

The Biden administration appealed to the Fifth Circuit, which again handed a victory to the states by declining to stay the lower court’s ruling. The Biden administration appealed to the Supreme Court, which granted cert. Last fall, the court heard oral arguments and on Friday ruled the states lacked Article III standing.

Justice Brett Kavanaugh wrote for the majority and was joined by Chief Justice John Roberts and Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson. Justice Neil Gorsuch wrote a different opinion saying the states didn’t have standing for a different reason than the one Kavanaugh gave. He was joined by Justices Clarence Thomas and Amy Coney Barrett. Barrett also wrote her own concurring opinion and was joined by Gorsuch.

At issue is a final memorandum, “Guidelines for the Enforcement of Civil Immigration Law,” issued by Department of Homeland Security Alejandro Mayorkas, drastically altering deportation policies, including limiting issuing detainer requests for dangerous criminal aliens.

In Mayorkas’ final September 2021 memorandum, he also challenged federal law established by Congress that illegal entry is a crime in itself and a deportable offense. The policy states: “The fact an individual is a removable noncitizen therefore should not alone be the basis of an enforcement action against them. We will use our discretion and focus our enforcement resources in a more targeted way. Justice and our country’s well-being require it.”

Many news organizations reported the Supreme Court ruling would allow the administration to prioritize deporting violent criminals. But under the current administration, deportations immediately dropped by two-thirds in the first fiscal year of the administration, according to CBP data. In fiscal 2021, deportations also dropped to the lowest level since fiscal 1996 despite record-high illegal entries.

Mayorkas’ policy also followed President Joe Biden’s directive, who after taking office ordered a “pause” on deportations.

Last July, 19 attorneys general filed an amicus brief expressing support for Texas’ and Louisiana’s lawsuit, arguing Mayorkas violated federal law and DHS’s actions negatively impacted their states and jeopardized the safety and welfare of Americans.

The AGs argued, and still maintain, “The Amici States and their citizens continue to suffer significant costs from illegal immigration – including billions of dollars in new expenses relating to law enforcement, education, and healthcare programs – as a direct result of Defendants’ failures to enforce immigration law. Those harms are exacerbated by DHS’ increasingly brazen disrespect for the requirements of our nation’s immigration laws and the Administrative Procedure Act.

“The border is in crisis,” they argued. “This DHS Administration is lawless. And the States continue to suffer escalating irreparable harm as the border crisis continually intensifies to successive, ever-more unprecedented levels of illegal crossings.”

Feds Catch More Than 460 Known, Suspected Terrorists In Nine Months, Most At Northern Border

There have been hundreds of known or suspected terrorists apprehended at the northern and southern borders in the current fiscal year, according to U.S. Customs and Border Protection data.

As foreign nationals illegally enter the U.S. and are apprehended, U.S. Customs and Border Protection Office of Field Operations agents screen them against a federal Terrorist Screening Dataset, which includes sensitive information about terrorist identities. It originated as a consolidated terrorist watch list “to house information on known or suspected terrorists, or KSTs, but has evolved over the last decade to include additional individuals who represent a potential threat to the United States, including known affiliates of watch-listed individuals,” CBP states.

As of June 15, OFO agents apprehended 53 KSTs at southwest border ports of entry and 284 at northern border ports of entry, totaling 337. CBP’s fiscal year begins on Oct. 1.

They also apprehended 125 KSTs between ports of entry at the southern border and two between ports of entry at the northern border, totaling 127 KSTs fiscal year to date. 

Combined, they’ve apprehended 464 known or suspected terrorists.

That’s nearly a 30% increase in one month after previous increases were roughly 87%.

Roughly one month ago, The Center Square reported OFO agents apprehended 332 KSTs at both borders. They apprehended 125 at the southern border (45 KSTs at ports of entry and 80 between ports of entry) and 207 at the northern border (205 at ports of entry and two between ports of entry).

These numbers were up from 284 KSTs apprehended by March, which was significantly up from 38 apprehended by January, an 87% increase in just two months.

By comparison, in fiscal 2022, 478 KSTs were apprehended in fiscal 2022. Agents apprehended 165 at the southern border (67 at ports of entry and 98 between ports of entry) and 313 at northern border ports of entry. 

Department of Homeland Security Secretary Alejandro Mayorkas maintains that the border is closed and secure. He’s refused to resign despite growing calls for him to do so. Multiple attorneys general and members of Congress have called for his impeachment.

While border security experts acknowledge the commendable work of OFO agents in apprehending known or suspected terrorists, they also express concern about how many have illegally entered the U.S. unabated.

Last month, former acting director of Immigration and Customs Enforcement under the Trump administration Tom Homan warned, “What’s happening is the greatest national security threat since 9/11. Border Patrol has arrested people from 171 countries. Many of these countries are sponsors of terrorism.”

He also pointed to the record number of gotaways, those who’ve illegally entered the U.S. and evaded capture by law enforcement, totaling over 1.7 million reported by Border Patrol agents since the president’s been in office – that number’s since gone up.

“If you don’t think a single one of the 1.7 million is coming from a country that sponsors terrorism, then you’re ignoring the data,” Homan said. “That’s what makes this a huge national security issue.”

While many have focused on the southern border, a congressional Northern Border Security Caucus was formed in March to call for additional security along there. It’s mainly left unmanned when comparing the amount of personnel to square mileage.

The U.S. northern border is the longest international border in the world, spanning 5,525 miles. Fourteen states share the U.S.-Canada border; 13 to Canada’s south and Alaska to its west.

By comparison, four states share 1,954 miles of the U.S.-Mexico border, with Texas sharing the most of 1,254 miles.

House GOP inches closer to Mayorkas impeachment amid discord in conference

House Republicans inched closer this week toward impeaching Homeland Security Secretary Alejandro Mayorkas, officially launching an investigation that would serve as the basis for any inquiry.

But conservative supporters of the effort still face enormous hurdles, including a reluctance of leadership to take such a drastic step and the continued opposition from more moderate lawmakers in the GOP conference — barriers that even the loudest Mayorkas critics have been forced to acknowledge. 

On Wednesday, Republicans on the House Homeland Security Committee said they would review Mayorkas’s performance through a five-phase plan, which Chairman Mark Green (R-Tenn.) said could be completed in a matter of 11 or 12 weeks.

“His policies have resulted in a humanitarian crisis this country has never seen,” Green said at a press conference.  

“Today's hearing will begin the process of digging into all of the details. The cause and effect of Alejandro Mayorkas’s dereliction of duty. I hope the American people will listen intently. I hope the press will report this, honestly. I hope the president of the United States, the commander in chief charged with the security and protection of this country, will listen. He can't possibly know of all of these failures of Mayorkas and have not fired him already.”

It’s a process that faces a complex path in the House — and one that’s already highlighted several layers of division within the GOP conference. Not only is there discord between impeachment supporters and opponents, but there’s also growing tension among Mayorkas’s most vocal critics, all of whom seem to want to play a prominent role in the effort to oust him. 

“We don't have the votes,” Rep. Matt Gaetz (R-Fla.) said Tuesday. Asked what would change the minds of the Republican opponents, he offered a biting criticism of his centrist colleagues.  

“An embrace of logic and reason,” he said.  

Green’s presser was followed by a hearing titled “Open Borders, Closed Case: Secretary Mayorkas’ Dereliction of Duty on the Border Crisis.”

Democrats argued the hearing’s name alone shows Republicans have already reached a conclusion on whether to take the dramatic step of impeaching a cabinet secretary — an action not seen since the 1870s.

“You may have a difference of opinion as to how the United States should process our asylum applicants. But the notion that that difference of a policy opinion would be the basis for a quote unquote, ‘case closed’ that Secretary Mayorkas is violating his duty, is preposterous and it is not any basis for impeachment,” said Rep. Dan Goldman (D-N.Y.), who before entering Congress worked as lead counsel for the first impeachment inquiry against former President Trump.

The move, six months into GOP leadership of the House, follows wrangling within the conference over how speedily to pursue the topic.

While a slew of lawmakers introduced impeachment resolutions days after the contentious vote to give the gavel to House Speaker Kevin McCarthy (R-Calif.), the most recent effort was offered by Rep. Marjorie Taylor Greene (R-Ga.), a sign of discontent among those eager to speed ahead.

It also comes as border numbers have dropped in the weeks following the May lifting of a policy that allowed the U.S. to quickly deny entry to would-be asylum seekers, bucking widespread predictions of a surge of migrants. The repeal of that policy, however, was paired with the reintroduction of consequences for those caught wrongly crossing the border.

“The number of Border Patrol encounters have plummeted by 70 percent since the Biden administration ended Title 42 last month. The number of overall border encounters have dropped by 50 percent in that time, due in large part to [Homeland Security's] hard work under Secretary Mayorkas’s leadership,” ranking member Bennie Thompson (D-Miss.) said during the hearing.

“Calling a hearing and saying ‘case closed’ before you’ve heard any testimony is not legitimate oversight. ... It’s about House Republican leadership catering to its most extreme MAGA members, who want to impeach someone — anyone at all. It’s about trying to make good on GOP backroom deals to elect a Speaker, raise the debt ceiling and stave off a mutiny in the Republican ranks.”

The House Homeland Security Committee doesn’t have the power to ignite an impeachment inquiry. That task falls to the House Judiciary Committee.

Green has cast the investigation as an effort that will be handed off to the other panel and ultimately brought to fruition by Judiciary Chairman Jim Jordan (R-Ohio). 

The firebrand Georgia congresswoman, however, offered her impeachment resolution with a tweet that included an emoji of a slice of cake, a reference to earlier comments that the debt ceiling package would be more appealing if it included “dessert” like an impeachment of Mayorkas or FBI Director Christopher Wray. 

The move was a reflection of impatience from some in the GOP, even as McCarthy has largely stuck to comments he made while visiting the border late last year stressing the need to investigate. 

“I know people are very frustrated with [Mayorkas],” McCarthy told CNN last month, but added that any impeachment process shouldn’t be pursued “for political reasons.”

Rep. Andy Biggs (R-Ariz.), former head of the far-right Freedom Caucus, suggested the Speaker is moving closer toward backing the impeachment effort. 

"McCarthy has loosened up on that. Whereas quite some time ago he was a no, now he’s kinda saying — kinda saying — yes,” Biggs said. Other reluctant Republicans are also shifting, he said. 

“There are people who were an absolute ‘no’ on it even a few weeks ago, and now told me that they're moveable,” he said. “There's probably two or three people that I'm trying to work on, see if I can move them my way. And if those two or three come along, I think then we're ready to go.”

Green sidestepped questions over whether the caucus would be able to secure the votes to impeach Mayorkas. 

“I would say it’s intuitively obvious to the casual observer, that Republicans are individualists and we think independently, we’re not robots being told by a Speaker how to vote,” he said in a nod to the standstill on the House floor led by a group of far-right members who stalled a vote on a GOP bill on gas stoves as a way to voice frustration with McCarthy's handling of the debt ceiling. 

“And so, there are many people with differences of opinions about this. And, you know, I'm in a leadership position, and from my leadership position, the direction of our committee is to get to the facts.”

The Department of Homeland Security has pushed back on GOP arguments and has largely blamed Congress for issues at the border.

“The immigration system has been terribly broken and outdated for decades. That is something about which everyone agrees, and it is my hope that they take that problem, and they fix it once and for all. In the meantime, within a broken system, we are doing everything that we can to increase its efficiency, to provide humanitarian relief when the law permits and to also deliver an enforcement consequence when the law dictates,” Mayorkas said earlier this year during an appearance on MSNBC.

“That is exactly what we are doing, and as far as I am concerned, I will continue to do that with tremendous pride with the people with whom I work."  

Green said his five-point plan includes investigations into cartels as well as the financial cost associated with migration.

“The guy has got to go,” Green said.

“We're going to hold him accountable. And if the president picks another guy that does this kind of stuff, we'll do what we have to do there too.”

Mayorkas on GOP impeachment efforts: ‘I am focused on the work in front of us’ 

Secretary of Homeland Security Alejandro Mayorkas during an interview on Sunday waved off concerns about a potential impeachment, emphasizing that he is "focused on the work in front of us."

"I am focused on the work in front of us meeting the challenge, not only with respect to the southern border, but meeting the challenge of ... the cyber threat from cyber criminals and adverse foreign nations states," Mayorkas told CNN's Dana Bash on "State of the Union."

"I am focused on the increasing severity and frequency of extreme weather events," he added. "I am focused on the adverse actions of the People's Republic of China, North Korea, Iran, Russia. I am focused on the work of the Department of Homeland Security. I will continue to focus on that work throughout my tenure."

Mayorkas is facing numerous calls for his impeachment by House Republicans over his handling of the U.S. border. The House Homeland Security Committee grilled Mayorkas last month, focusing on a 2006 law that requires a standard of perfection at the border.

Title 42 - a pandemic era policy that allowed for the rapid expulsion of asylum-seekers - expired last week, prompting concerns that a surge of migrants would result at the border. Instead, Mayorkas said on Sunday that authorities seen a 50 percent drop in encounters at the border in the days since the rule expired.

Mayorkas says administration to announce plans to address expected border surge

Homeland Security Secretary Alejandro Mayorkas says the Biden administration is getting ready to announce a new border security plan to handle an expected surge of migrants when pandemic-era immigration restrictions lift May 11.

“I think next week we’ll have more to say about our preparation and some of the things we are going to be doing,” Mayorkas told reporters at the Department of Homeland Security headquarters on Thursday.

President Biden has come under steady fire from Republican lawmakers over his administration’s handling of the border. This week, Sen. Roger Marshall (R-Kan.) filed a vote of no confidence resolution against Mayorkas, saying his handling of the border is negligent.

“I stand at the ready to receive articles of impeachment from the House and conduct an impeachment trial in this body,” Marshall said at a Judiciary Committee hearing Tuesday. “But in the meantime, I think the Senate must show our colleagues in the House that we’ve had enough of the failures from the Department of Homeland Security and believe that the secretary is not fit to faithfully carry out the duties of his office.”

Illegal border crossings are expected to increase significantly starting in May once pandemic-era rules on immigration expire, most notably Title 42, which allows the U.S. to quickly turn away undocumented migrants without allowing them to seek asylum in the interest of public health.

“We’re certainly going to see numbers higher than we’re seeing today,” Border Patrol Commissioner Troy Miller said in a hearing Wednesday.

Miller cited U.N. statistics that an estimated 660,000 migrants are traveling through Mexico right now. He said the number of border crossings could nearly double to about 10,000 per day.

Mayorkas did not disclose what the new plan would be, but he said the department would prepare with additional bed space in migrant facilities.

Nearly 2 million migrants have been turned back from the border using Title 42. The Biden administration has come under fire from Democrats and activists who have said the measure does not provide border crossers with their right to seek asylum in the U.S.

The administration has attempted to overturn Title 42 in the past but ran into roadblocks in federal court and opposition from Republican lawmakers in border states. With the coronavirus pandemic officially over, the administration no longer expects any legal challenges.

Mayorkas said the department is considering a new rule to more easily deny asylum claims. Migrants who have not applied for asylum in other countries on their way to the U.S. or have crossed the border illegally would not be eligible for asylum. 

The rule is in the public comment period, and Mayorkas said Tuesday that there is not a specific date for implementation as of now.

Mayorkas was questioned by House and Senate lawmakers this week in hearings that saw him receive harsh criticism and some personal attacks.

Much of the criticism was focused on reports that a significant number of child migrants were placed with sponsors who forced them to work, sometimes through the night, at dangerous factories.

Immigration is expected to be a major issue in the 2024 election; Biden is expected to announce his reelection campaign in the coming days.

Heated GOP grilling of Mayorkas leads to pledge to ‘dial the rhetoric down’

Republicans gave a preview Wednesday of a still materializing impeachment case against Homeland Security Secretary Alejandro Mayorkas, zeroing in on a 2006 law that requires a standard of perfection at the border.

But what started as a fiery hearing filled with attacks on Mayorkas ended with promises to tone down the rhetoric and move towards civility in the House Homeland Security Committee — a panel with numerous members who have pledged to remove the secretary from office.

The GOP on Wednesday repeatedly referenced the Secure Fence Act of 2006, a law that defines operational control as achieved when there is not a single unlawful entry of either migrants or drugs at the border. 

Chair Mark Green (R-Tenn.) and other Republicans played numerous clips of Mayorkas previously answering questions about whether he has maintained operational control of the border — a tactic that comes after Green reportedly told donors at a fundraiser to “get the popcorn” ready ahead of the hearing.

Green rattled off a series of policies rolled out under the Biden administration, including the rescission of some Trump-era policies, though the current administration has alienated immigration advocates by retaining others. 

“You have not secured our borders, Mr. Secretary, and I believe you've done so intentionally. There is no other explanation for the systematic dismantling and transformation of our border,” he said. 

Several Republicans on the committee, including Green, leveled a series of accusations against Mayorkas, using their full five minutes for speeches, without asking questions of Mayorkas or allowing him to respond.

“I have no interest in asking the secretary any questions because he obfuscates and lies,” said  Rep. Clay Higgins (R-La.) after arguing Mayorkas had “failed your country.”

Rep. Bennie Thompson (D-Miss.), the top Democrat on the committee, defended Mayorkas, pointing to reporting from The New York Times about Green’s comments to donors.

“I was dismayed to see that speaking to a group of campaign contributors last week about today's hearing the Chairman said, and I quote, ‘Get the popcorn. It's going to be fun.’ I think that tells Americans all they need to know about the Republican agenda here,” Thompson said.

“They don't want solutions to homeland security challenges. They want to make a headline or photo opp. They want a political wedge issue and something to talk to their deep-pocketed donors about more than they want to work together to get things done.”

Green later said the article misquoted him. He did not specify how but detailed he has no power to impeach Mayorkas, noting such a move would fall to the House Judiciary Committee and that his role is limited to oversight.

Republicans used much of the hearing to dissect Mayorkas’s previous statements on operational control of the border.

Mayorkas has repeatedly maintained he has control of the border, but the GOP has seized on prior comments from Border Patrol Chief Raúl Ortiz who answered “no” when asked if the department was meeting the high standard set under the Secure Fence Act.

It was a line Green said “told the truth” about the situation at the border.

Mayorkas on Wednesday said he was previously cut off by lawmakers from giving nuance to earlier answers, arguing the law leaves much discretion to the secretary in determining how to manage the border while the standard itself has never been met.

“The Secure Fence Act provides that operational control means that not a single individual crosses the border illegally. And it's for that reason that prior secretaries and myself have said that under that definition, no administration has had operational control,” Mayorkas said.

“As I have testified under oath multiple times, we use a lens of reasonableness in defining operational control. Are we maximizing the resources that we have to deliver the most effective results? And under that definition, we are doing so very much to gain operational control.”

Democrats took turns defending Mayorkas.

Rep. Donald Payne (D-N.J.) accused Republicans of having “such short memories … with respect to the situation at the Southern border.” Rep. Sheila Jackson Lee (D-Texas) rattled off a list of Trump-era policies, including family separation, prompting Mayorkas to say they not only failed to achieve operational control but “disobeyed our values as a country.”

Thompson turned to the archives, citing comments from GOP lawmakers from when the Secure Fence Act was first passed, citing concerns over the standard it set, including Rep. Michael McCaul (R-Texas), a member of the committee who worked on the legislation.

“When you put this number as a metric in the definition of operational control, you make it impossible to achieve operational control. Perfection shouldn't be the enemy of the good,” McCaul said at the time, according to a portion of the transcript read aloud by Thompson.

Republicans, however, took issue with Mayorakas’s explanation, arguing the secretary has no right to interpret the laws passed by Congress.

“Congress set an objective in law. You haven't pursued it,” said Rep. Dan Bishop (R-N.C.).  “Who are you to displace the legal definition of operational control by this Congress in favor of pursuing one of your own invention?”

Rep. Daniel Goldman (D-N.Y.), who played a central role in the impeachment of then-President Trump, later pounced on Bishop’s phrasing.

“I have a little experience with impeachment and I can tell you, as well as everybody else, that there is no grounds for impeachment based on a policy dispute. And there is absolutely nothing that I've seen here today that amounts to a false statement under oath,” he said.

“In fact, Mr. Bishop, my colleague, in referencing operational control and that standard, stated himself that it is an objective. It is the objective of the Department of Homeland Security to have operational control and, as you pointed out, that is to allow no unlawful entry into this country. That, of course, is an impossible standard.”

Other Republicans sought to hold Mayorkas accountable with other methods.

One lawmaker brought a series of charts with multiple questions. Two others brought guests to the hearing, including parents of children that had died of a fentanyl overdose and the family of victims who died after a man carrying migrants crashed into their car while seeking to evade police in a high-speed chase. 

The committee’s proceedings came to an almost 20-minute standstill following comments from Rep. Marjorie Taylor Greene (R-Ga.) accusing Mayorkas of lying.

Green agreed to a motion from Democrats to take down her words, ultimately resulting in the loss of her speaking privileges during the hearing.

It was a complex turn of events given that many Republicans at prior points in the hearing accused Mayorkas of being dishonest before Congress, though none, as Greene did, labeled him a liar.

Still, the hearing ended on a tone much different from how it started, with Thompson and Green both speaking to the need to maintain decorum during proceedings.

Thompson said the two men had "sidebarred" about the language used, noting other nations keep tabs on Congressional proceedings — “our adversaries look at us,” he warned.

“You and I pledge that going forward, we'll make every effort to get back to the civility that this committee has been known for,” Thompson said.

Green echoed that in his own closing remarks.

“I agree with the former chairman, now ranking member, that we disagree on a lot of policies. We really do. And we don't have to despise someone because they disagree with us. We don't have to disparage someone because they disagree with us,” Green said. 

“And we do need to dial the rhetoric down in the country and apparently in the committee.”

GOP senator floats no confidence vote as Mayorkas defends border response

Homeland Security Secretary Alejandro Mayorkas and other officials were on the defensive Tuesday as Senate Republicans became more vocal about their efforts to back impeachment for the secretary.

Mayorkas’s appearance before the Senate Homeland Security Committee sparked the usual heated exchanges and personal attacks now common in such forums, but the GOP posture escalated as Sen. Roger Marshall (R-Kan.) pledged to soon introduce a vote of no confidence resolution for the secretary.

House efforts to launch an impeachment of Mayorkas have been simmering for some time, with GOP lawmakers arguing he has failed to successfully manage the border amid an uptick in migration. But an official inquiry has yet to be launched, and those efforts have recently taken a back seat to debt ceiling talks.

But Marshall on Tuesday suggested a need to buoy that process in the Senate, where it is expected to make little progress given the Democratic majority.

“I stand at the ready to receive articles of impeachment from the House and conduct an impeachment trial in this body,” Marshall said. “But in the meantime, I think the Senate must show our colleagues in the House that we've had enough of the failures from the Department of Homeland Security and believe that the Secretary is not fit to faithfully carry out the duties of his office.”

Mayorkas at one point attempted to respond, asking to take a point of personal privilege, but Marshall objected, saying, “I want you to answer my questions, not give me lectures.”

Mayorkas, given an opportunity by the next speaker, Sen. Tom Carper (D-Del.), declined to respond. 

“I just want to take a moment to ask my colleagues here today to treat the secretary with the respect he deserves,” Carper said, noting Mayorkas’s integrity, work ethic and dedication to a complex job.

“I was raised — my guess is most of the folks in this committee were raised — to treat other people the way we want to be treated. I wouldn't treat anybody the way that I've seen you treated before in other committees and again here by at least one of our colleagues today.”

At other turns during the hearing, GOP lawmakers sought to hold Mayorkas personally responsible for various issues at the border.

"Do you not care? Do you not just have an ounce of human compassion for what your open border policy, the kind of human deprivation it is causing?” Sen. Ron Johnson (R-Wis.) said.

Mayorkas would later defend the Department of Homeland Security's (DHS) efforts to stem migratory flows, pointing to a program that largely blocks nationals from Haiti, Nicaragua, Venezuela and Cuba from seeking asylum but allows those with U.S. sponsors to apply to enter the U.S.

Various GOP lawmakers zeroed in on a recent New York Times article delving into the extent Biden administration officials were aware unaccompanied children were being trafficked into child labor.

The care of children who arrive at the border without their parents spans multiple agencies, with the Department of Health and Human Services (HHS) responsible for vetting the sponsors who ultimately care for them.

At one point, Sen. Josh Hawley (R-Mo.), who has also called for Mayorkas’s resignation, accused Mayorkas of “pressuring officials and agencies to skip the vetting process and get these kids out as soon as possible to sponsors who weren't vetted.”

The Times story does not reference Mayorkas and primarily focuses on the roles of HHS and high-ranking White House officials in the matter.

“Senator, I look forward to discussing this issue further because you are misstating the facts so terribly,” Mayorkas responded.

Mayorkas also shot back when Hawley accused him of letting thousands of children into the country to be exploited, pointing to a Trump-era policy of separating parents from their children.

“It is stunning to me, stunning, to hear you say that the prior administration reunited children with their parents,” Mayorkas said.

Mayorkas at another point said lawmakers, including Johnson, were “disparagingly mischaracterizes our commitment to address trafficking and the exploitation of vulnerable individuals, including children."

Sen. Alex Padilla (D-Calif.) offered a defense of Mayorkas and DHS, saying that senators must not forget the role of corporations hiring the migrant child labor outlined in the Times investigation.

"It is the employers breaking child labor laws,” Padilla said. “We should not misplace the blame here."

Mayorkas was one of several officials called before Congress on Tuesday to discuss immigration-related matters. 

HHS officials appeared before both the House’s Energy and Commerce and Oversight committees, while Immigration and Customs Enforcement Director Tae Johnson appeared before House appropriators.

Much of the discussion with Johnson surrounded the number of detention beds funded through the ICE budget, a figure that determines the extent the agency is able to house people in detention centers versus other means of supervision. President Biden’s budget cut detention capacity by about a quarter.

At various points during the hearing, Johnson said he would like to see funding for a greater number of beds than covered in the budget but acknowledged that the agency simply would not be able to detain all those who may be slated for deportation.

Rep. Michael Guest (R-Miss.) said that would undercut the administration’s ability to remove people from the country as their immigration cases work their way through the court system.

“If it's easier to remove people once they're in detention, and you've agreed with that, and I agree with that, but yet we have a budget which is actually shrinking detention beds. I find that counterproductive,” Guest said.

“As these additional cases work their way through the system, we're going to see those numbers grow exponentially. And it just doesn't seem to me that we either don't have the resources or we don't have the policies in place to enforce the law.”

Johnson said even when the agency has rapidly expanded the number of beds in the past “we filled those beds up in no time.”

“So I personally don't think there's a number of beds that you can actually buy that's going to solve this problem that we're seeing,” he said.

At another point, Johnson was asked about the agency’s Homeland Security Investigations (HSI) unit, which works to combat cartels and other transnational crime.

Rep. Lauren Underwood (D-Ill.) pointed to reporting that HSI staff at one point proposed separating from ICE, arguing the agency’s reputation made it difficult to carry out their work.

Johnson said he opposes siphoning off the unit, but backs giving them “flexibility” to minimize their affiliation with ICE, saying efforts like removing the “ICE” part of their email address has proven helpful.

“One of the things we did this year was to give HSI the flexibility to use whatever branding they felt was necessary to increase cooperation in the communities. So in other words, if removing the ICE moniker completely and just using the HSI brand was going to result in greater cooperation, they had the flexibility to do so,” he said.

But Underwood said those moves failed to address the underlying problem.

“ICE has the responsibility to proactively and intentionally build trust in the communities that you serve,” she said.

“And so I think that this is an area where the agency definitely needs to do more.”

Mayorkas: ‘The number of people that are arriving at our border is at an extraordinary height’

Homeland Security Secretary Alejandro Mayorkas said in a new interview that the number of people arriving at the U.S.-Mexico border has reached an “extraordinary height.”

“The number of people that are arriving at our border is at an extraordinary height. There is no question about that,” Mayorkas told Sharyn Alfonsi in a forthcoming episode of “60 Minutes."

“But that is not unique to the southern border of the United States,” he continued. “There is tremendous amount of movement throughout the hemisphere, and in fact throughout the world.”

Mayorkas has faced intense criticism from Republican lawmakers over his handling of the southern border, with some calling for his impeachment.

“I think that we face a very serious challenge in certain parts of the border,” the Homeland Security secretary acknowledged in the "60 Minutes" interview.

However, he declined to call the situation a crisis, as many GOP lawmakers have described it.

“I have tremendous faith in the people of the Department of Homeland Security, and a crisis speaks to me of a withdrawal from our mission,” Mayorkas said. “And we are only putting more force and more energy into it.”

Encounters at the U.S.-Mexico border increased substantially under President Biden, with Customs and Border Patrol reporting nearly 2.4 million encounters from October 2021 through September 2022.

However, the Biden administration's new asylum policies aimed at discouraging Cuban, Haitian, Nicaraguan and Venezuelan migrants from traveling through Mexico seem to have eased the influx slightly. Between December and January, encounters at the U.S.-Mexico border dropped by nearly 100,000.

Why Hasn’t the GOP Yet Walked the Walk on Its Mayorkas Impeachment Talk?

It’s almost an understatement to say that Republican candidates campaigned hawkishly on border control in the runup to the 2022 midterms: As they decried the flow of illegal immigrants and drugs from Mexico, many vowed to impeach the man they largely blamed for the mess, Homeland Security Secretary Alejandro Mayorkas. 

Republicans have continued hammering Mayorkas since taking control of the House. Judiciary Committee Chairman Jim Jordan, who called the flooding of more than 5 million illegal immigrants across the southern border since President Biden took office an “intentional” policy, has made several visits to the U.S.-Mexico border with other Republicans, and the House has held multiple hearings on immigration.

But as winter has turned to spring, the GOP has taken little action to remove Mayorkas. Republicans Andy Biggs of Arizona and Pat Fallon of Texas  have each filed bills, but the House Judiciary Committee, from which any impeachment move must come, has not taken up either resolution. 

Conservative groups focused on the southern border told RealClearInvestigations that impeachment did not come up during recent meetings in Washington. 

“I just came from the Hill and a bunch of meetings with staffers and they’re reporting the same thing; one said the conference is split, with a lot of GOP ‘George W. Bush types’ who love the cheap labor for American industry and agriculture,” said Todd Bensman of the conservative Center for Immigration Studies and author of “Overrun: How Joe Biden Unleashed the Greatest Border Crisis in U.S. History.”  

Bensman calls it an “old story,” but cheap labor is only part of it. Republicans aren’t united on this issue because some fear that following through on impeachment talk will alienate the moderate swing voters that the GOP needs to remain in control of the House.

Even Republicans who have publicly attacked Mayorkas are now reticent about discussing impeachment. RCI reached out to 16 GOP House members for comment. Neither Biggs nor Fallon responded. Virginia Rep. Bob Good, a member of the Freedom Caucus who is co-sponsor of both resolutions, declined to comment on the record. Other outspoken administration critics such as Dan Crenshaw of Texas, Tom McClintock of California, and Matt Gaetz of Florida did not respond. 

Only two of the 16 Republican House members agreed to speak on the record.

“I have repeatedly called for his impeachment and am confident that Chairman Jordan will hold true to his word of impeaching Mayorkas for overseeing an unprecedented surge of illegal activity at our southern border,” Rep. Paul Gosar of Arizona said.

Rep. Scott Perry of Pennsylvania said Biden administration officials have lied about what they have done at the border but was more circumspect on impeachment, suggesting a wait-and-see attitude may be behind the aggressive rhetoric. 

“I’m not on the Judiciary Committee and it would have to come from there,” he said. “My hope is that at least some information will come from hearings because some members legitimately have some questions.” 

Perry and others said they would like to see the Judiciary Committee make the case for impeachment, a process Jordan appears to be favoring. For the moment, however, the only concrete step Republicans have taken is a symbolic gesture by Rep. Chip Roy of Texas to try to cut Mayorkas’ salary from the DHS budget. 

The bills filed by Reps. Biggs and Fallon contend that Mayorkas’s conduct meets the constitutional threshold for impeachment, “high crimes and misdemeanors.” Fallon’s bill, H. Res. 8, alleges that the secretary has violated the oath all cabinet members take to “faithfully uphold” the laws of the United States by failing to enforce: 

  • The Secure the Fence Act of 2006 that requires the DHS secretary to “maintain operational control over the entire international land and maritime borders of the United States.”
  • The Immigration and Nationality Act that requires the DHS secretary to “detain inadmissible aliens arriving in the United States or aliens who are present in the United States without inspection until processed.” Instead, it claims, Mayorkas’ “catch and release” approach has allowed more than “1,000,000 illegal aliens” into the country. 

While referencing those two laws, the Biggs resolution, H. Res. 582, also accuses Mayorkas of violating the Public Health Services Act by failing to protect U.S. citizens from “risk and exposure to and contracting Covid-19 by refusing to take necessary steps to prevent contagious illegal aliens from entering the United States.”  

In sum, the Biggs resolution concludes Mayorkas should be impeached because “his actions have subverted the will of Congress and the core tenets of the Constitution.” 
RCI reached out repeatedly to a dozen Democratic members of the House Judiciary Committee seeking comment on a possible impeachment of Mayorkas and their reaction. None of them responded.

Mayorkas has stated repeatedly he has no intention of resigning, a suggestion Republican Sen. Ted Cruz of Texas made again Tuesday when Mayorkas appeared at a Senate committee hearing. “If you had any integrity you would resign,” Cruz said.

The volley came after the two got into a verbal spat over how truthful the administration has been about the border. Cruz cited comments by White House Press Secretary Karine Jean-Pierre that people are “not walking across the border” along with photographs of people doing just that. “You claim you care, Mr. Secretary –– that is a lie,” Cruz said. 

Cruz again accused Mayorkas of dissembling after the DHS chief would not answer a question about whether Jean-Pierre lied. Mayorkas called Cruz’s accusation “revolting.”

Nevertheless, the department is bracing for a possible impeachment and taking steps for Mayorkas’ defense. A government contract was signed with the law firm Debevoise & Plimpton to provide legal assistance to the secretary; that contract would kick in only if the Judiciary Committee moved an impeachment motion to the House floor.

Debevoise & Plimpton did not respond to a request for comment about the arrangement. Biden administration officials familiar with it said it was necessary because the impeachment of a cabinet secretary is so rare none of its legal staff has any relevant experience. 

The terms of the contract were not disclosed, although officials pointed to examples in the past where House Republicans hired outside legal counsel to assist it on legislation that proved legally fraught.

A DHS spokesperson said the contract was necessary to “ensure the Department’s vital mission is not interrupted by the unprecedented, unjustified and partisan impeachment efforts of some members of Congress, who have already taken steps to initiate proceedings.”

History shows the House can move swiftly on impeachment if members choose to. The Democratic majority, along with a handful of Republicans, voted to impeach departing President Trump just one week after the post-election riot at the Capitol on Jan. 6, 2021.

Defenders of the government’s current border policies say that the conservatives’ argument is flawed. The Biden administration’s approach is basically a relaxation of the Trump administration’s more stringent strategy. As such, they amount to policy differences between the two major political parties and fall far short of any “crimes and misdemeanors” that would justify impeachment.  

But, as RCI has previously reported, President Biden’s policies have marked a sharp break from his predecessor’s, since Biden’s first day in office, when he signed seven executive orders on immigration that, among other things, suspended deportations. 

Hans von Spakovsky, a senior fellow at the conservative Heritage Foundation who co-authored the February report, “The Case for Impeachment of Alejandro Nicholas Mayorkas Secretary of Homeland Security,” defended the impeachment argument from liberals who deride it as purely political. 

“It inaccurately and incorrectly asserts that we are confusing the requirements of the Immigration and Naturalization Act with the Trump administration policies,” he said. “Our analysis is based not on disagreeing with the policies implemented by Mayorkas, but with his violation of federal immigration law.” 

“I think we have laid out in our paper what we think the basis is for impeachment,” von Spakovsky told RCI. They include the claims that Mayorkas:  

  • “deliberately defied and contravened the laws he is charged with faithfully executing.” 
  • “repeatedly abused the authority of his office, including by, among other conduct, enticing a flood of aliens to cross the U.S. southern border with his policies and Statements.” 
  • “betrayed the trust of the people by lying to Congress and withholding information and misleading the public in an effort to hide and suppress the nature and consequence of his abominable policies.” 

Von Spakovsky added that “the misguided priorities of Mayorkas have resulted in a huge backlog in the adjudication system that unfairly hurts the many thousands of U.S. citizens and lawful applicants whose immigration matters are delayed many months.”

Although von Spakovsky and others argue impeachment is warranted “consistent with U.S. history and constitutional traditions,” it would also be a highly unusual move. Only one cabinet member has ever been impeached, President Ulysses S. Grant’s War Secretary William Belknap in 1876, but he resigned the same day the House voted unanimously against him.  

Attorney General Harry Daugherty in 1922 and Treasury Secretary Andrew Mellon in 1932 also faced possible impeachment proceedings by the House, but the former resigned in 1924 and the latter left the cabinet and became U.S. ambassador to England. 

Impeachment supporters also point to the dangers the Biden administration’s porous border have created. In addition to the humanitarian issues of hundreds of thousands of people migrating through Mexico to the U.S., and the money they have paid to Mexican cartels to facilitate their passage, the southern border has become the main conduit for deadly illicit fentanyl.

Scott Perry said his constituents would like to see the Republicans do more than simply talk about the border crisis, though he noted that Mayorkas is the agent who carries out policies set by President Biden. 

“It’s chaos down there with the fentanyl and the cartels making millions of dollars,” he said. 

“Most of our constituents are distraught about that and want it fixed, and many would like accountability for how it occurred. Ultimately, the president is responsible so why not impeach him?” 

But as to what might actually happen with Mayorkas, Perry acknowledged he wasn’t sure. 

“My sense is that with the Judicial Committee holding hearings we are working toward those kind of things,” he said. “That will go to the fact-finding we need to have to convince some of our skeptical members.”

Democratic rep says he might vote in favor of impeaching Mayorkas over border wall construction

A House Democrat said he might vote in favor of impeaching Secretary of Homeland Security Alejandro Mayorkas over the construction of two 30-foot walls at the border with Mexico. 

Rep. Juan Vargas (D-Calif.) said at a press conference on Friday that he might vote for an impeachment resolution if Republicans bring one up against Mayorkas, though for different reasoning than his GOP colleagues. 

While Republicans have slammed Mayorkas and the Biden administration for high numbers of undocumented immigrants coming into the country, Vargas said he might vote to impeach Mayorkas over the issue of the border walls being built at Friendship Park in San Diego. 

The park is located on a cliff over the Pacific Ocean between San Diego and Tijuana, Mexico, according to Border Report, an outlet owned by Nexstar Media Group that focuses on coverage of the U.S.-Mexico border. 

The Hill is also owned by Nexstar. 

Vargas said he wants Mayorkas and President Biden to halt the construction of the walls at Friendship Park, which Border Report reported has served as a meeting place for families to gather with a wall between them. 

“He told us that he would help us, and he hasn’t done it,” Vargas said, referring to Mayorkas. “He betrayed us.” 

The outlet reported that U.S. Border Patrol officials have said the existing barriers are decaying and have become a danger to the public, migrants and agents in the area. They have said the barriers need to be replaced with the new walls. 

But Vargas, who represents the area in the House, and other local leaders have expressed concerns that the walls will end public access to the area. Vargas said Mayorkas promised him that the construction would be stopped. 

The construction started a few weeks ago and is expected to be completed in six months, the outlet reported. 

The Department of Homeland Security hired an outside law firm last month to help Mayorkas respond to a potential Republican-led impeachment inquiry. Mayorkas has vowed that he would not be pushed out of his position by his opponents. 

Republicans in the House have been somewhat divided about the path forward on Mayorkas, however, as some wanted to impeach Mayorkas immediately upon the GOP taking control of the House, while others wanted to take time to build a case against him. 

Two articles of impeachment have been introduced in the House against Mayorkas. 

Vargas is the first Democrat to publicly say they are open to considering an impeachment vote against Mayorkas.
