Democrat Adam Schiff wins Dianne Feinstein’s former Senate seat

Rep. Adam Schiff has won the late Dianne Feinstein's U.S. Senate seat, beating out GOP challenger and former MLB star Steve Garvey, The Associated Press projected Tuesday night.

Garvey, who refused to ask for an endorsement from former President Trump and embraced being a "conservative moderate," congratulated Schiff during an election night appearance with his supporters.

"I want you to know that, despite the outcome, that when the counting is over, we will have gotten the fourth most number of votes in the country," Garvey said. "This means that everyone in California does have a voice, and it will only grow louder and louder.

"I want to sincerely thank you for your support and vote. It was an honor to be your nominee and represent you around this great state of ours, to discuss the issues and ideas that we care about most — the cost of living, fixing our homeless crisis, making our communities safe, improving our public schools and securing our border," Garvey said.

The Los Angeles-area congressman, who rose to national prominence as the lead prosecutor in President Trump’s first impeachment trial, defeated a Republican former baseball star who had tried to parlay his sports celebrity into a political career.

Schiff, who was favored to win in deeply blue California, did not immediately release a statement.

Garvey, a former MLB first baseman, spent a week in Israel as part of his campaign efforts earlier this year to stand in solidarity with the Jewish community in California and set himself apart from his Democratic opponent during the college campus riots. 

Schiff shaped his campaign around national issues, including abortion rights, while continuing to play a foil to Trump, calling the former president a threat to democracy. He also contrasted his years of experience in Congress — Schiff was first elected to the House in 2000 — against Garvey, a first-time candidate who positioned himself as an outsider with a fresh perspective to deal with California’s long-running homeless crisis, inflation and housing costs.

Feinstein, a Democrat elected to the Senate in 1992, died at 90 in September 2023. Laphonza Butler, a Democratic insider and former labor leader, was appointed to the seat after Feinstein’s death and decided not to seek a full term this year.

Republicans in California have struggled in recent years to gain momentum in their campaigns, often overshadowed by a Democratic trifecta.

Trump urges California GOP US Senate candidate Garvey to reach out for endorsement: ‘No chance’ without MAGA

Former President Trump told reporters on Friday that California Republican U.S. Senate candidate Steve Garvey "hasn’t reached out to MAGA" after the presidential nominee was asked why he hadn’t endorsed Democratic Congressman Adam Schiff’s opponent. 

"I don’t know much about Steve Garvey. I think he’s made a big mistake because he hasn’t reached out to MAGA," Trump said outside his Trump National Golf Club in Rancho Palos Verdes following a press conference where he spoke out against "Comrade Kamala Harris and the communist left."  

He said if the former Major League Baseball star Garvey "doesn’t have MAGA, he has no chance." 

Trump was fundraising in California Thursday and Friday.

"Well, I haven’t spoken to him," Trump added of Garvey. "I’m hearing he wants the MAGA endorsement, but he’s got to call me. If he had the MAGA endorsement, he could win. If you had an honest election he’d win, but you don’t have an honest election." 

Garvey previously told FOX 11 he voted for Trump in 2016 and 2020. 

He told Fox News Digital in a statement, "Since day one, I've ran a different type of campaign, I have not taken or asked for a single political endorsement. The only endorsements I want are from the law enforcement community and first responders. This week, we launched a historic campaign dedicating all of our resources to talk with California's Latino community from now until the election.

"My focus is, and always has been, on the issues that truly matter to Californians — affordability, public safety, securing the border, fixing the homelessness crisis and restoring California's leadership. I'm running a ‘Steve Garvey’ campaign for all the people of California, not for partisan or special interests. I'm committed to tackling the challenges that families and communities face every day and making sure that California has the voice it deserves in Washington." 

Trump also disparaged Schiff as "one of the sleaziest politicians in history, Crooked Adam Schiff. He’s one of the most disgusting human beings and to think he’s going to be a senator. That’s why you need me as president, because this guy is a sleazebag." 

He called it "impossible to believe" Schiff could represent the area.

The former president has long disliked the Los Angeles-area congressman, who served as the lead impeachment manager in Trump's first Senate trial and was a vocal critic throughout his presidency. 

Schiff responded to Trump's comments about him on X, writing, "I don’t think he likes me."

"Steve Garvey’s a nice guy. I don’t know him at all," Trump told reporters. "But if he doesn’t reach out to MAGA, he has absolutely no chance." 

Schiff is heavily favored to win in the deep blue state that hasn’t had a Republican senator since John Seymor lost his election in 1992.

The most recent Real Clear Politics polling average has Schiff leading Garvey 57.3% to 33%.

Vince Fong advances in special election runoff to replace ousted House Speaker Kevin McCarthy

Californians voted to advance Republican State Assemblyman Vince Fong during Tuesday's special election to replace former House Speaker Kevin McCarthy, who was ousted last year.

Fong, a former McCarthy aide endorsed by both McCarthy and former President Trump, faced off with Republican Tulare County Sheriff Mike Boudreaux at the polls on Tuesday. 

Because both candidates are Republicans, the GOP will hold 218 seats, compared to the Democrats' 213, factoring in four vacancies. In California's jungle primary system, the top two vote-getters advance to the general election.

Fong, who also earned the most votes in March's primary election, will serve out the rest of McCarthy's term until he battles against Boudreaux again in November in the general election.

Fong and Boudreaux advanced to Tuesday's runoff following a March special election where they emerged as the top two candidates, with neither getting more than 50% of the vote to trigger a victor. By November, voters in the district will have voted for either candidate a total of three times.

McCarthy resigned from the House in December, three months after he was voted out of the speakership. 

The district, which cuts through the Central Valley farm belt, including parts of Bakersfield and Fresno, is the most strongly Republican House seat in heavily Democratic California. Trump largely carried CA-20 in 2020 and McCarthy represented the district from 2007 until his resignation in late 2023. In February, Trump called Fong "a true Republican."

Among Boudreaux's supporters are Ric Grenell, former acting director of national intelligence under Trump, and Republican state Sen. Shannon Grove, from Fong's hometown of Bakersfield.

Trump's involvement in the race casts it as a litmus test for the former president's political relevance as he presumably gears up for a potential rematch against President Biden in November.

Pete McCloskey, GOP congressman who once challenged Nixon, dies at 96

Pete McCloskey — a pro-environment, anti-war California Republican who co-wrote the Endangered Species Act and co-founded Earth Day — has died. He was 96.

A fourth-generation Republican "in the mold of Teddy Roosevelt," he often said, McCloskey represented the 12th Congressional District for 15 years, running for president against the incumbent Richard Nixon in 1972. He battled party leaders while serving seven terms in Congress and went on to publicly disavow the GOP in his later years.

He died at home Wednesday, according to Lee Houskeeper, a family friend.

Years after leaving Washington, McCloskey made one last bid for elective office in 2006 when he challenged Richard Pombo of Northern California’s 11th District in a primary race that McCloskey described as "a battle for the soul of the Republican Party." After losing to Pombo, who had spent most of his tenure in Washington attempting to undo the Endangered Species Act, he threw his support behind Democrat Jerry McNerney, the eventual winner.

"It was foolish to run against him (Pombo), but we didn't have anybody else to do it, and I could not stand what a------ they'd become," the frank-talking former Marine colonel said of the modern GOP in a 2008 interview with The Associated Press.

McCloskey cited disillusionment from influence peddling and ethics scandals under the George W. Bush administration as reasons why he switched parties in 2007 at the age of 79. "A pox on them and their values," he wrote in an open letter explaining the switch to his supporters.

"McCloskey was a rarity in American politics — his actions were guided by his sense of justice, not by political ideology," Joe Cotchett, his law partner since 2004, said in a statement. "He hated inequity and did not hesitate to take on members of his own political party."

Born in Loma Linda, California, on Sept. 29, 1927, as Paul Norton McCloskey Jr., he graduated from South Pasadena High School, where the second baseman made the school's baseball hall of fame, although he self-deprecatingly called himself "perhaps the worst player on the baseball team."

McCloskey joined the Marine Corps as an officer and led a rifle platoon during some of the most intense fighting of the Korean War. He was awarded the Navy Cross for extraordinary heroism, the nation’s second-highest honor, a Silver Star for bravery in combat and two Purple Hearts.

He earned a law degree from Stanford University and founded an environmental law firm in Palo Alto before making the move to public office. In 1967, he defeated fellow Republican Shirley Temple Black and Democrat Roy Archibald in a special election for the San Mateo County congressional seat.

The left-leaning McCloskey had a thundering presence in Washington, attempting to get onto the floor of the 1972 Republican National Convention during his bid to unseat then-President Nixon on an anti-Vietnam War platform. He ultimately was blocked by a rule written by his friend and law school debate partner, John Ehrlichman, that said a candidate could not get to the floor with fewer than 25 delegates. McCloskey had one.

Still, McCloskey loved to say he finished second.

He would later visit Ehrlichman in prison, where Nixon's former counsel served 1.5 years for conspiracy, perjury and obstruction of justice in the Watergate break-in that led to the president's resignation.

While in office, McCloskey also was known for befriending Palestinian leader Yasser Arafat and criticized Israeli influence on American politics. The congressman was the first to demand Nixon's impeachment, and the first to demand a repeal of the Gulf of Tonkin resolution that allowed the Vietnam War.

But his enduring legacy is the Endangered Species Act, which protects species designated as endangered or threatened and conserves the ecosystems on which they depend. McCloskey co-wrote the legislation in 1973, after a campaign by young people empowered by Earth Day activities successfully unseated seven of 12 Congress members known as "The Dirty Dozen" for their anti-environment votes.

"On that day, the world changed," McCloskey recalled in 2008. "Suddenly, everybody was an environmentalist. My Republican colleagues started asking me for copies of old speeches I had given on water and air quality."

"A powerful champion of endangered species, Pete, ironically, became one," said Denis Hayes, co-organizer of the Earth Day, about the rarity of a "green, anti-war Republican."

After 15 years in the House, he lost his run for a Senate seat to Republican Pete Wilson, who went on to be California's governor. He moved back to rural Yolo County, relishing the life of a farmer and part-time attorney.

"You know, if people call you 'congressman' all the time, you'll end up thinking you're smarter than you are," he said.

McCloskey, however, couldn't stay quiet forever.

In 2006, after his unsuccessful race against Pombo, he helped form the Revolt of the Elders Coalition, a group of retired Republican congressmen who pushed to get soldiers more money for college, undo measures that made it tougher to investigate ethics violations and rallied against those who had received funding from disgraced lobbyist Jack Abramoff, including Pombo.

"If you can do something at age 80 that positively affects our country, you should be proud of it. Otherwise there's no redeeming value in getting older," he said.

McCloskey is survived by his wife, Helen — his longtime press secretary whom he married in 1978 — and four children by his first wife: Nancy, Peter, John and Kathleen.

Former FBI informant accused of lying about Bidens’ business dealings to be transferred to California

An ex-FBI informant accused of lying about President Joe Biden and his son Hunter Biden's alleged business dealings with a Ukrainian energy company will be transferred to California, where he is expected to face a judge.  

Alexander Smirnov, 43, has been ordered transferred to California where he will appear in court at 9 a.m. Monday local time. He was released by a Nevada judge earlier this week.

A California judge ordered him arrested again on Thursday after federal prosecutors argued Smirnov, who holds dual U.S.-Israeli citizenship, was a flight risk. 

On Wednesday, federal prosecutors said Smirnov peddled lies "that could impact U.S. elections" while asking a judge to keep him locked up ahead of trial on charges alleging he lied to the FBI about a phony multimillion-dollar bribery scheme involving the Bidens and the Ukrainian energy company Burisma.

Prosecutors say Smirnov falsely told his handler that Burisma executives paid Biden and his son, Hunter Biden, $5 million each around 2015. The claim became central to the Republican impeachment inquiry in Congress.

However, federal prosecutors said Smirnov had only routine business dealings with the company starting in 2017 and made the bribery allegations after he "expressed bias" against then-presidential candidate Biden. Special Counsel David Weiss said Smirnov's untruths were made in an effort to impact the 2024 presidential election.

He is charged with making a false statement and creating a false and fictitious record. The charges were filed in Los Angeles

Smirnov was arrested Thursday at the law offices of his attorneys in downtown Las Vegas. Fox News Digital has reached out to Smirnov's lawyers.

Hunter Biden’s Hollywood lawyer ‘sugar bro’ allegedly violated professional conduct rules: Bar complaint

Hollywood attorney and Hunter Biden confidant Patrick Kevin Morris may have violated California’s bar rules with his lavish spending on the president’s son, says a complaint by America First Legal. 

The AFL, a conservative legal group founded by former Trump White House senior adviser Stephen Miller, filed the complaint Tuesday with the State Bar of California alleging Morris violated California’s rule that prohibits a lawyer from funding the lifestyle of a client or potential client.

The complaint came ahead of Morris' closed-door testimony to the House Oversight Committee Thursday.

Morris reportedly spent $4.9 million financially supporting the president’s son. Included in the sum was a $2 million loan for Hunter to pay off his back taxes, and $875,000 was a purchase Hunter Biden’s art. 

A Los Angeles Times story characterized Morris’s relationship with Hunter Biden as, "foremost as his lawyer, but also his friend, confidant and bankroller." And, when Hunter Biden made a surprise visit to Capitol Hill, last week, he was flanked by Morris and his attorney Abbe Lowell.

"However, if Mr. Morris has provided personal funds to an individual who has now been confirmed to be a client – or who would reasonably believe himself to be Mr. Morris’s client – Mr. Morris would have violated both the text of the Rules of Professional Conduct and the well-established norms of the legal profession," the America First Legal complaint says. 

Morris was reportedly scheduled to do a transcribed interview with the House Oversight and Accountability Committee and the House Judiciary Committee this week, as part of the formal impeachment inquiry into President Joe Biden for potential actions or benefitting from alleged influence peddling by family members, including his son.

Specifically, State Bar of California Rule 1.8.5(a), states that "[a] lawyer shall not directly or indirectly pay or agree to pay, guarantee, or represent that the lawyer or lawyer’s law firm will pay the personal or business expenses of a prospective or existing client."

"If Hunter Biden or a similarly situated person would reasonably anticipate that Mr. Morris was obligated to provide legal services, the alleged funding of the lifestyle of a client or potential client justifies the immediate opening of a misconduct investigation under Rule 1.8.5," the complaint says. 

On Capitol Hill, and on other occasions, Lowell has been the lawyer who spoke as Hunter Biden’s representative. However, the same Times story said, "Morris strode shoulder to shoulder with the president’s son as they made a surprise appearance at a congressional contempt hearing on Capitol Hill. On Thursday, he is expected to be seated behind him in a downtown Los Angeles courtroom as Hunter Biden is scheduled to be arraigned Thursday on criminal tax charges, much as he did in a Delaware courtroom."

Morris did not respond Wednesday to Fox News Digital for this story after phone calls were made to his firm, PKM Law.

The State Bar of California would not confirm or deny if an investigation was underway. 

"By law, disciplinary investigations are confidential, unless confidentiality is waived pursuant to the provisions of Business and Professions Code section 6086.1(b) or (c)," a state bar spokesman said in an email to Fox News Digital. 

Hunter Biden’s attorney claims indictments would not have been brought if he was not related to the president

Hunter Biden's attorney said Thursday that his client would not be facing charges out of Delaware and California if he was not President Biden's son, saying the charges would not be brought if his last name was "anything other than Biden."

Earlier Thursday, Hunter Biden was indicted in California on nine tax charges over $1.4 million in taxes he owed between 2016 and 2019. Special Counsel David Weiss has been using a federal grand jury in Los Angeles to gather evidence of possible criminal tax charges against Hunter Biden.

The charging documents filed in California accuse Hunter Biden of spending money on personal expenses including drugs, luxury hotels and exotic cars. "[I]n short, everything but his taxes," prosecutors wrote.

If convicted, Hunter Biden could face up to 17 years in prison.

HUNTER BIDEN FACES NEW INDICTMENT IN CALIFORNIA

This comes after Hunter Biden pleaded not guilty in October to federal gun charges in the U.S. District Court for the District of Delaware in connection with Weiss' years-long investigation.

"Based on the facts and the law, if Hunter’s last name was anything other than Biden, the charges in Delaware, and now California, would not have been brought," defense attorney Abbe Lowell said in a statement. "First, U.S. Attorney Weiss bowed to Republican pressure to file unprecedented and unconstitutional gun charges to renege on a non-prosecution resolution. Now, after five years of investigating with no new evidence -- and two years after Hunter paid his taxes in full -- the U.S. Attorney has piled on nine new charges when he had agreed just months ago to resolve this matter with a pair of misdemeanors."

"I wrote U.S. Attorney Weiss days ago seeking a customary meeting to discuss this investigation," he continued. "The response was media leaks today that these charges were being filed. All these issues will now be addressed in various courts, the first to occur this Monday when the prosecutors knew our motions to dismiss their first set of questionable charges would be filed."

Lowell said all of Hunter Biden’s back taxes were paid in full more than two years ago and that he has since been up-to-date with his filings and taxes. Lowell also said his client was suffering from a serious drug addiction during the period of unpaid taxes.

Additionally, Lowell pointed out that millions of Americans fail to file or pay their taxes on time each year and that it is uncommon for someone to be charged for not filing or paying their taxes on time. Lowell said it is especially rare for a person who paid the taxes, interest and penalty afterward to be charged.

Thursday's indictment comes ahead of an expected vote from House Republican leaders next week to formally initiate an impeachment inquiry into President Biden over possible ties to his son's overseas business dealings. The White House has maintained that President Biden had no knowledge of his son's business dealings.

House Republicans have also said they would move to hold Hunter Biden in contempt of Congress if he does not appear for a closed-door deposition on Dec. 13. But Hunter Biden has said he would only testify before the House if it is in public because information from closed-door testimonies is selectively leaked and used to "manipulate, even history, the facts and misinform the American public."

Hunter Biden faces new indictment in California

President Biden's son Hunter Biden will be indicted in California, Fox News has learned. 

While the exact nature of the charges remain unclear, the indictment in the Central District of California was expected later Thursday. 

Special Counsel David Weiss has been using a federal grand jury in Los Angeles to gather evidence of possible criminal tax charges against Hunter Biden. 

Hunter Biden pleaded not guilty in October to federal gun charges in U.S. District Court for the District of Delaware after being charged out of Weiss' years-long investigation.

Earlier this week, House Oversight Committee Chairman James Comer, R-Ky., released subpoenaed bank records showing an entity owned by Hunter Biden had made "direct monthly payments to Joe Biden." 

The White House has repeatedly said that President Biden did nothing wrong and had no knowledge of his son's business dealings. 

House Republicans, meanwhile, have warned the younger Biden they would move to hold him in contempt of Congress if he didn't appear for a closed-door deposition on Dec. 13. 

Hunter Biden has insisted he would only testify to the House if it's in public because information from closed-door testimonies is selectively leaked and used to "manipulate, even history, the facts and misinform the American public."

WH officials confirm date, location for Biden’s US meeting with Chinese President Xi

White House officials have confirmed that President Biden will be meeting with Chinese President Xi Jinping this month in an effort to ease tensions between the two countries.

Biden and Xi are scheduled to meet in San Francisco's Bay Area on Nov. 15, according to White House press secretary Karine Jean-Pierre.

"President Biden will meet with President Xi Jinping of the People’s Republic of China (PRC) on November 15," the press secretary announced Friday. "The Leaders will discuss issues in the U.S.-PRC bilateral relationship, the continued importance of maintaining open lines of communication, and a range of regional and global issues."

Anti-Trump Dem claimed Maryland home as primary residence despite running for Senate in California

California Democrat Rep. Adam Schiff allegedly claimed a primary residence in Maryland for years despite his goal to represent Golden State residents in the Senate.

All while owning a 3,420-square-foot home in Maryland, Schiff has reportedly taken a homeowner’s tax exemption on a smaller 650-square-foot condo he owns and designates as his primary residence in Burbank, California.

By claiming his California home as his primary residence, Schiff was able to receive a $7,000 reduction in his property assessment – an estimated $70 in annual savings from property taxes, according to a CNN report. In California, each county collects a general property tax equal to 1% of the assessed value. Schiff, who announced his Senate ambition in January, did not take a similar exemption on his Maryland home.

Tax records reviewed by the outlet revealed Schiff paid his property taxes in California with a personal check featuring his Maryland address in 2017. The outlet's review of past records and comments from the lawmaker, as well as photos shared to social media in recent history, also indicated Schiff has made his Maryland home his full-time residence.

Deed records also revealed Schiff designated his Maryland home his primary residence in 2003, the year he bought the home. Additionally, Schiff reportedly refinanced his mortgage and indicated that his Maryland home was his primary residence in 2009, 2010, 2011 and 2012.

Los Angeles County deed records for Schiff's California condo, which was purchased in 2009 for a little under $300,000, were notarized in Maryland, the outlet highlighted.

One page of the deed reportedly replaced "California" and "Los Angeles" with "Maryland" and "Montgomery County." The records also listed Schiff’s Maryland home as the return address.

A spokesperson for Schiff’s campaign told Fox News Digital the congressman's primary residence is in California and that he and his family made the "difficult decision" to move to the D.C. area so he could spend more time with his children while serving in Congress.

"Adam’s primary residence is Burbank, California, and will remain so when he wins the Senate seat," said Marisol Samayoa, a Schiff campaign spokesperson. 

"As Adam has discussed openly many times over the years, including in his recent New York Times best-selling book, he and Eve made the difficult decision to move their family to the D.C. area to spend more time with his children while doing his job — voting and representing the people of California's 30th Congressional District.

"Members of Congress have to decide how best to balance work and family, and the Schiffs did exactly that. Adam’s constituents appreciate how devoted he is to both the responsibilities of his job and his family."

The Schiff for Senate campaign also told Fox News Digital Schiff claimed both homes as primary residences due to "loan purposes."

"Adam’s California and Maryland addresses have been listed as primary residences for loan purposes because they are both occupied throughout the year and to distinguish them from a vacation property," his campaign said.

A 2010 to 2014 biography featured on Schiff's campaign website at the time made no mention of the Maryland home and indicated Schiff and his family were "settled" in Burbank. In 2020, however, Schiff refinanced his mortgage and indicated that the Maryland residence was his second home.

A family photo shared on Schiff's website in 2021, as highlighted in the report, matched the exterior of Schiff's Potomac home in Maryland. Additionally, several social media posts by Schiff in recent years suggested he still lives at his Maryland home.

In a June 2022 photo shared by Schiff on social media, the congressman posed with an "I Voted" sticker in front of his Maryland home on the day of the Democratic primary in the Los Angeles mayor’s race.

Under California law, to qualify for a homeowner’s exemption, the "dwelling must be the person’s true, fixed and permanent home and principal establishment to which he/she, whenever absent, intends to return." Certain factors used to determine if someone lives in the state include "in-state presence, vehicle registration, voter registration, bank accounts, and state income tax filings."

Several lawmakers have faced scrutiny in recent years for living in certain states and representing others at the federal level, including former Pennsylvania Senate candidate Dr. Mehmet Oz, a Republican.

The residency revelations surrounding Schiff, who served as the lead House impeachment manager for former President Donald Trump's first trial in the Senate, come as he prepares to take on stiff competition in the California Senate race. Democratic representatives Katie Porter and Barbara Lee of California also announced this year they would make a run for the seat.
