Trump White House call record omissions raise eyebrows

As a congressional watchdog calls for a new probe into allegations that former President Donald Trump regularly destroyed presidential records, the Jan. 6 committee has simultaneously discovered on Thursday that a series of critical gaps exist in White House call logs secured from the National Archives. 

First reported by The New York Times, the gaps in the official White House telephone logs from Jan. 6, 2021, are not a complete surprise—Trump was well known to use his private cell phone or his staff’s cell phones when conducting affairs or speaking to aides, legislators, and others.

The Jan. 6 committee has not yet suggested that the omissions in the call logs are the result of any tampering on behalf of the former president. A committee spokesman did not immediately return a request for comment to confirm whether the logs it has received are all of the logs requested are just a portion of those records. 

White House call logs itemize who has telephoned the White House or who called out and will also include, generally, the date, time, and length of a call.

The Jan. 6 committee has received a plethora of documents and testimony already confirming that Trump spoke to several key officials throughout Jan. 6, including one call made to then-Vice President Mike Pence and legislators like Sen. Mike Lee of Utah. 

The call to Lee was meant for Sen. Tommy Tuberville of Alabama. Lee passed his mobile phone to Tuberville and the Alabama lawmaker spoke to Trump for just under 10 minutes. Their discussion unfolded as the president’s supporters were storming the Capitol. 

That entire exchange, however, did not occur on an official White House telephone, making the committee’s findings on Thursday all the more concerning. 

CNN reported that sources who have reviewed a presidential diary from Jan. 6—also obtained by the Archives and shared with the committee—noted that it has “scant information and no record of phone calls for several hours” after Trump returned to the Oval Office up until he recorded a national address in the Rose Garden. 

In addition to calls to Pence and Senator Lee, Trump also had a tense phone call with House GOP Leader Kevin McCarthy on Jan. 6.

During Trump’s second impeachment, McCarthy told a fellow Republican lawmaker that when he finally reached Trump by phone during the assault, Trump was insistent that “antifa” had breached the complex.

McCarthy told Trump it was his supporters and Trump hung up in a huff.

Since then, McCarthy has aligned himself completely with the former president, refusing to cooperate with a voluntary request from Jan. 6 investigators issued weeks ago. The probe is now weighing whether to officially subpoena the House leader.

Doing so would be a historic move and an outcome the California Republican has arguably long courted. McCarthy was opposed to the formation of a Jan. 6 commission from the outset unless it promised to review other, unrelated external security threats posed to lawmakers and focused on intelligence failures of the U.S. Capitol Police.

He later refused to negotiate with Speaker of the House Nancy Pelosi over the committee’s membership. After his proposal to seat two staunch Trump allies on the committee, including Rep. Jim Jordan of Ohio—who was, even then, considered to be a potential material witness to the overall probe—McCarthy took his ball and went home.

With negotiations killed, the House went forward and the committee was formed. The House Republican has since regularly opposed the committee’s work and has taken up keen alliances with the uber-conservative, pro-Trump, anti-Jan. 6 investigation House Freedom Caucus.  

Though the gaps in the White House call logs obtained so far may correlate to Trump’s prolific use of unofficial cell phones, sources who reviewed the logs did say Thursday that at least one entry positively confirms Trump attempted to call Pence on the morning of Jan. 6 before the siege.

The official record does not reportedly show Pence answering, and the source said, according to CNN, that there is also no record showing Pence returned Trump’s call. 

Interestingly, Keith Kellogg, Pence’s national security adviser at the time, informed the committee during recent closed-door testimony that Pence and Trump spoke on the phone on Jan. 6 and further, that the president’s daughter and adviser, Ivanka Trump, witnessed the call. 

This was the call in which Trump pressured Pence to stop or delay the certification. If the White House call records obtained Thursday show that a call was made to Pence but Pence did not pick up, then Kellogg’s testimony would seem to suggest that the pressure call to the vice president happened on another phone, and not an official White House telephone. 

Like the select committee, the Archives did not immediately return request for comment Thursday about whether all of the White House call logs have been remitted to the panel in full or if others are still on the way. 

The Jan. 6 committee has issued sweeping orders to telecommunications companies, including Verizon and T-Mobile, for the phone records of other Trump White House officials, family members, and orbiters. More than 100 people have been part of those requests; the companies have largely cooperated thus far, according to court records. 

Select committee chairman Bennie Thompson has aired his concerns about Trump’s prolific unofficial cell phone use in the past. 

Norm Eisen, a legal analyst for CNN, said Thursday that the gap of records in the White House call logs and related diaries “raises a set of very serious concerns, including questions of whether there was an intentional effort to circumvent the usual system and, if so, who directed it and for what purpose.” 

A social media field guide to lawmakers who pushed Trump’s lies before, on, and after Jan. 6

Earlier this year, Rep. Zoe Lofgren, a California Democrat and member of the Jan. 6 committee, compiled and released a report. Its contents feature the comprehensive statements of sitting U.S. lawmakers who nearly a year ago posted messages on social media endorsing former President Donald Trump’s lies about the 2020 election.

They are lawmakers who, as seen in this badland of their own admissions, sometimes reveled in Trump’s lies as rioters—many armed with makeshift weapons—scrambled up the marble facade of the Capitol. They are lawmakers who objected to the certification of votes after people were maimed and killed. They are lawmakers who, until today, have chosen to overwhelmingly stand behind these statements while continuing to prop up moldering delusions about a victory never won. 

As the anniversary of the insurrection looms, plans are underway for public hearings hosted by the Jan. 6 committee. Solemn events commemorating the sacrifices made by those who defended the Capitol will be held. The former president, who incited the insurrection and found himself impeached by Congress for that conduct, has plans to hold something he believes resembles a press conference. If the hundreds of rallies he led and thousands of statements he made over four years of his presidency are any indicator, his event at Mar-a-Lago on Jan. 6 will be nothing more than a dusting off of sad old songs.

To see everything, click this link. These statements do not deserve to be relegated to the shadowy corners of our nation’s collective memory. To forget them, to ignore them, is to treat democracy like it is guaranteed. If nothing else, Jan. 6 served as a reminder that it is not. 

Rep. Mo Brooks, a Republican from Alabama, posted messages on social media repeatedly before the insurrection casting doubt on the validity of mail-in ballots and suggesting, baselessly, that a “criminal element” was at hand courtesy of Democrats. He also shared disinformation from Breitbart. 

This December, ‘Stop the Steal’ movement founder Ali Alexander told investigators on the Jan. 6 committee that he exchanged a text message with Brooks in the run-up to the attack. Brooks initially denied communicating with Alexander. This week Brooks admitted to the text and as noted by the Alabama Political Reporter, he played it down. It was “so innocuous and forgettable that Congressman Brooks did not recall it,” a spokesperson for Brooks told APR. 

The text from Alexander to Brooks:

“Congressman, this is Ali Alexander. I am the founder of Stop the Steal, the protests happening in all 50 states,” Alexander wrote in the text, shared by Brooks. “We met years ago back in 2010, during the tea party when you were first elected. I texted the wrong number. I had intended to invite you to our giant Saturday prayer rally in DC, this past weekend. Also Gen. (Michael) Flynn should be giving you a ring. We stand ready to help. Jan 6th is a big moment in our republic.”

Alexander also said he spoke to Arizona Republican Paul Gosar. Gosar, was censured by the House in November for sharing a video depicting the murder of Rep. Alexandria Ocasio-Cortez and attacking President Joe Biden. Alexander also claimed to have spoken to Rep. Andy Biggs, another Arizona Republican. Gosar, Brooks, and Biggs are members of the ultraconservative House Freedom Caucus. Lofgren’s social media report also archives multiple public remarks from Gosar and Biggs. 

Brooks on Nov 5: 

But in a bigger sense, part of the problem is the uncertainty interjected into the election process by this early mailing of ballots en masse… The only weakness in the Alabama system is that you don’t really know if a person is an American citizen who can lawfully vote, and that’s because the Democrats out of Washington, D.C. have made it extraordinarily difficult for election officials to determine if a person is a United States citizen when they register to vote… Well of course Democrats want that kind of process because it has more vulnerabilities to election fraud. And the Democrats are renown for engaging in election fraud, voter fraud, election theft, however you want to categorize it… You don’t see the Democrats doing anything at all that minimizes the risk of election fraud, of non-citizens voting. Everything that the Democrats seemingly push for, creates another weakness that the criminal element that wants to steal elections can exploit… I have concerns about all of them… I’ll tell you right now, I don’t have confidence, if Joe Biden is reportedly elected President of the United States, I do not have confidence that the person who would be sworn in, was sworn in because that person in fact got the lawful votes needed to win the electoral college… based on all of the things I know about election theft and voter fraud from the past, coupled with how much easier it is to steal an election or engage in voter fraud with this system that the Democrats have been so successful in implementing around the country that has weakened my and a lot of other[s’] faith in the system.”

Ten days after President Joe Biden was declared winner of the 2020 election, Brooks pushed discredited theories of “uncounted ballots” in Georgia. Georgia was a key target of the Trump administration’s election subversion strategy, according to records and witness testimony obtained by the Jan. 6 Committee.

Jeffrey Clark, a former Department of Justice attorney, focused on Georgia as a part of his alleged attempt to oust former Attorney General Jeffrey Rosen at Trump’s behest and install himself. Rosen ultimately refused to go along with a pressure campaign.

Brooks continued well into December, addressing Trump on Twitter and making claims of “illegal alien block votes” influencing the election.

Before a segment where Brooks said the 2020 election was plagued by the “worst election theft in the history of the United States,” the host of Fox & Friends First opened the show saying Brooks had “earned him[self] a big thank you from President Trump.”

Joined by two dozen fellow Republicans, Brooks called on Attorney General William Barr to investigate in Georgia. He also objected to counts in Pennsylvania, Nevada, Wisconsin, Texas, Arizona, Michigan, and elsewhere. He railed against Mitch McConnell when the former Senate majority leader warned Republicans not to object on Jan. 6.

Roughly two weeks before the Capitol attack, Brooks called on Americans to fight, saying: “The Socialist Democrats have successfully stolen votes from the American people in2020 and we need to fight and take it back.”

At 1 PM, rioters began to breach the Capitol.  At 1:16 PM Brooks says the “battle is joined” as he, Gosar, and Sen. Ted Cruz of Texas objected to the electoral votes from Arizona

Brooks sent out seven tweets while the riot was unfolding just outside the chambers. He called Rep. Lauren Boebert of Colorado “passionate” and praised other lawmakers joining the objection. Then as he recorded Gosar’s objection, he acknowledges the breach saying doors are locked and noting that House Speaker Nancy Pelosi has left.

For weeks after the attack, Brooks was on the defensive, attacking the media for reporting his own words and actions back to him.

Reps. Jerry Carl and Barry Moore, also of Alabama, were equally vocal from November through Jan. 6.

Found on pg. 161 of Lofgren’s social media report.

Moore, in a Breitbart interview on Jan. 5, laid the rhetoric on thick, saying: “We've got to fight for election integrity for the future of this country… A lot of people don't think we can win this fight but we have to fight."

Twitter suspended Moore’s personal Twitter account after the riot exploded and after he spread conspiracy about “racial justice” and antifa activists inciting the insurgence.

Rep. Andy Biggs, never a shrinking violet, pushed the election fraud agenda hard. He tweeted and then deleted a post from Charlie Kirk inviting people to protest in Arizona on Nov. 6 and to “hold the line.” He retweeted Donald Trump Jr.’s call for his father to “go to total war” on Nov. 5. He retweeted Dan Bongino’s plea on Nov. 7 for the “biggest political rally in modern American history” and then deleted that retweet nine weeks later on Jan. 9. On Nov. 7 he wrote an opinion column for TownHall.com titled “The Only Way Forward is to Fight”—the link to which is now unavailable on Biggs’ Facebook page. Biggs did not immediately return request for comment on Dec. 22.

A little over a month after Biden was declared the winner, Biggs used his social media platform to amplify voter fraud allegations. Two days before a ‘Stop the Steal’ rally in Washington erupted in violence, Biggs tweeted:

The radical left and their allies in the mainstream media attempted to overthrow America’s duly elected president, @realDonaldTrump. Americans do not trust them, nor will we take orders from them when they command us to stop trying to ensure the integrity of our elections.

Biggs also tweeted “Never surrender!” on Jan. 4 and in the same breath linked to a tweet from Dan Bongino reading: “CONCEDE NOTHING!” During the breach, Biggs posted clips of his remarks from the floor objecting to the count. On Jan. 8, he railed against anti-Trump Democrats and defended the former president, saying that an “impeachment plot” was brewing. By Jan. 11 after his political rival Joan Greene said on Facebook that he, Rep. Mo Brooks, and Paul Gosar plotted the insurrection, he threatened a defamation suit.

On Jan. 20, Biggs’ own brothers gave an interview laying blame on the lawmaker for the Capitol attack. Ali Alexander had a higher opinion of Biggs. He called him his “hero.”

Rep. Paul Gosar’s social media feeds were littered with conspiracy theories about the 2020 election. He was seen posing for photos with members of hate groups like the Proud Boys over six months before the Capitol assault, but his affinity for the group reportedly stretches back years.

In November, Gosar joined rallies at state capitols. He championed “conquering the Hill” at a rally in December in Arizona.

On Nov. 6, Gosar asked to be first in line for scrutiny and later praised Ali Alexander. Alexander has since deleted the message retweeted by Gosar where Ali said: “Ali Alexander addresses nation ahead of nationwide State Capitol rallies happening NOON tomorrow.”

Gosar attended various rallies demanding an audit and spent weeks promoting Trump’s claims to victory. Dozens of pages from Lofgren’s social media report are devoted just to Gosar’s missives alone. He lauded “teamwork” with Trump’s personal lawyer Rudy Giuliani and on Dec. 6 dug himself deeper, demanding audits in Arizona. On Dec. 7 he wrote a letter to the state of Arizona, questioning if the U.S. was witnessing an “open coup” and tagged Trump and Giuliani, saying he was responsible for the first ‘Stop the Steal’ rally in the state. He called news of an audit “28 bitch slaps” for Arizona Gov. Doug Doucey as he demanded Doucey’s recall.

He was outraged at Doucey for refusing to “talk to Trump” on Dec. 9.

After the insurrection, on Jan. 11, Gosar deleted a Dec. 19 tweet where he bragged about making a ‘Stop the Steal’ stage his own. Before the insurrection, on Dec. 21 and Dec. 22, he bragged about meeting with Trump in the Oval Office.

The next day on Dec. 24, he announced a press conference with ‘Stop the Steal’ leaders. On Jan. 11 he deleted that tweet. Eight days before the Capitol breach, Gosar amplifies Rep. Marjorie Taylor Greene:

Four days before the attack, Gosar asked for “patriots” to “HOLD THE LINE.”

Just before the riots erupted, Gosar tweets: “Don’t make me come over there” as he demands Biden’s concession and tags Alexander Ali.

As the riots were underway, there were two sides to Gosar: one on Twitter and the other on Parler, where he posted a photo of rioters scaling the Capitol and said, “Americans are upset.”

Another Arizona Republican, Rep. Debbie Lesko, tweeted an interview where she would not say how she would vote on certification, even as the riot was underway. She later said she predicted “there would be a problem” but she did not foresee something happening at “the magnitude” it did on Jan. 6. She ended up voting against certification.

GOP Leader Kevin McCarthy, a Republican from California, spent weeks posting messages on Twitter attacking Pelosi and suggesting that Democrats were engaged in voter fraud.

Before the attack, he asked people not to be quiet:

He was largely quiet on Twitter on the day of the attack, tweeting archived footage from election objections filed by Democrats in 2005 at around noon. He posted another message after 10 PM on Jan. 6: His own speech from the floor condemning the violence of the day. 

Other lawmakers, like Rep. Lauren Boebert, promised to fight early on and invoked the ubiquitous “hold the line” rhetoric:

Boebert’s rants continued unabated for weeks and weeks after the election. The Lofgren social media report provides pages upon pages of Boebert’s tweets alone.

In a video posted to Facebook 48 hours later, Boebert said she met with Trump in the Oval. In the clip she said: “I want President Trump to fight until this election is actually over… I had the privilege of spending time with President Trump in the Oval Office a few days ago, and I encouraged him to use all of the legal means he had to make sure this was a fair election… I can assure you he’s definitely in this fight until the end… This election is not over.”

On Dec. 19, Boebert for the first time asks followers to mark their calendars for Jan. 6. She announced her intent to object to certification on Christmas eve.

A day after that, Boebert says the people are needed to put pressure on state legislatures to rescind certification and calls for pressure on senators and congressman to object on Jan. 6:

The attack was now days away. Boebert lashed out at Democrats and urged against playing by the rules:

Boebert was excited by the impending certification ceremony, saying the first six days of 2021 would be decisive. On Jan. 2 she would express gratitude to senators for announcing their plans to object.

As Trump began his speech and the attack was less than an hour from unfolding, Boebert made urgent calls on Twitter and said she would “fight with everything” she had.

Two days after the insurrection, Boebert changed her profile picture to a portrait of Trump and posted a video on Twitter defending her vote to object. For a week after the attack, she appeared on social media chastising Democrats, accusing them of violence and playing coy around questions about her tweet saying Pelosi had been removed from the chamber on Jan. 6. Boebert condemned the violence after the attack but continued to amplify Trump’s election fraud conspiracy.

Other vocal Trump allies like Rep. Matt Gaetz—currently under investigation by the Justice Department—spent weeks before the election crying fraud without proof and on Nov. 5, Gaetz suggested the Justice Department could step in and evaluate votes in Pennsylvania. Similar pleas would be made by Gaetz for DOJ involvement for weeks after the election. Attorney General William Barr last December found no proof of election fraud. 

The DOJ isn’t as powerless as it currently looks. They should be in court NOW to put the legally non-compliant ongoing Philadelphia count into FEDERAL RECEIVERSHIP!

He also posted and deleted tweets about alleged voter fraud in Pennsylvania and on Nov. 9 tweeted an article where Georgia Gov. Brian Kemp said only legal votes would be cast. “Great hearing from you,” Gaetz wrote.

He said on Nov. 12 that he spoke to Trump about election fraud and that Trump was “ready for battle." He appeared on Steve Bannon’s show War Room a week after that. Bannon, investigators say, may have been integral to coordinating the attack, He was indicted on contempt of Congress charges this winter and awaits a summer trial. On Nov. 30, Gaetz appeared on Fox News, calling for people to “stand and fight”

On Dec. 21, just after 6 p.m. Gaetz called for a defense of the election.

A day later he retweeted a post from Mark Meadows, Trump’s chief of staff, which said several members of Congress had met with Trump.

On Jan. 4, Gaetz urged people to “fight like hell” for America “with all that we have.”

Tens of thousands might be marching in the streets on Jan. 6, Gaetz said 24 hours before the siege. He also cast doubt on whether Pelosi would permit debate. She made no indication she would not.

“One question remaining is whether or not Nancy Pelosi will even allow the two hours of constitutionally-authorized debate on these questions. But when you’ve got tens of thousands of people potentially marching in the streets in Washington, D.C., tomorrow, I think it would be a very bad look for the People’s House not to entertain debate if we have a constitutionally acceptable objection signed by a House Member and a Senator,” Gaetz said.

On the day of the attack, Gaetz tweeted lightly. Around noon, he suggested criticism of elections made them better. He tweeted again at 10 PM, sharing an article suggesting facial recognition was used to pick up extremists in the crowd. The Washington Times removed the article he posted below after the facial recognition company said the claims were false.

In the weeks that followed and as a second impeachment brewed for Trump, Gaetz defended Trump unceasingly and said “the left” was engaged in rhetorical warfare. Gaetz bristled at the suggestion that Jan. 6 was an insurrection and when an independent government watchdog announced it was investigating improper attempts to overturn the election 20 days after the attack, Gaetz expressed outrage:

Representatives like Bill Posey chalked up Jan. 6 to a disturbance by a small number of individuals. Rep. Greg Steube falsely stated that violence at the Capitol was started by “antifa” and “BLM” activists.

Republican Rep. Marjorie Taylor Greene got an early start, appearing in a video on Oct. 27 endorsing political violence. 

“The only way you get your freedoms back is … with the price of blood,” she said.

Hurling insults at “weak-kneed” and “spineless” Republicans who wouldn’t join the chorus of election fraud claims, Greene caped for Trump incessantly. She called for people to attend a ‘Stop the Steal’ rally in Georgia on Nov. 7 and later deleted that tweet only to replace it with more posts of her appearance at that rally. On Nov. 10 she called for the Georgia governor to step in.

She called for “fighters” who wouldn’t give up before the “war is over” in November. She offered gun giveaways, urged noncompliance with mask mandates, and kept on tweeting at Georgia officials about bogus fraud claims. On Dec. 14, she vowed to ‘Stop the Steal’ on Jan. 6.

Greene also retweeted the following message from Kylie Kremer, a chief organizer for Women for America First. Kremer is reportedly now cooperating with the Jan. 6 committee after receiving a subpoena this fall. Kremer wrote: “The calvary is coming, Mr. President! JANUARY 6th | Washington, DC”

And in a video shared from her Twitter page the next day, Rep. Greene said: “Just finished with our meetings here at the White House this afternoon. We had a great planning session for our January 6th objection. We aren’t going to let this election be stolen by Joe Biden and the Democrats. President Trump won by a landslide… Stay tuned.” 

Greene also said online that she spoke to Trump by phone on Dec. 22. She said they spoke again on Jan. 2.

She also used Jan. 6 as a chance to fundraise, saying she would need a massive grassroots army behind her to “stop the steal.”

Like Boebert, Greene too called it a “1776 moment” in an interview with Newsmax on Jan. 5. She said in a post later that same day that she held planning meetings with Republicans to discuss their objections.

During the riot, Greene called for people to "be smart.” She spent the morning tweeting out claims of election fraud in Georgia and called on Pence to “be bold and courageous.” Just after 9 PM on Jan. 6 she tweeted the later-debunked story about facial recognition picking up on antifa extremists. “We’ve seen what they’ve done all year long,” she said.

In the aftermath, Greene condemned the violence on Jan. 6 but was aggressively promoting Trump’s claims nonetheless. She appeared on the House floor six days after the assault sporting a mask with the phrase molon labe. As pointed out by Rep. Lofgren’s report: “Molon Labe is a classical Greek phrase meaning “come and take [them],” attributed to King Leonidas of Sparta as a defiant response to the demand that his soldiers lay down their weapons. Gun-rights advocates have adopted the phrase as a challenge to perceived attempts by the government to confiscate arms.”

The lawmakers highlighted in this lengthy guide are far from the only individuals who posted messages promoting Trump’s claims of election fraud. But the lawmakers mentioned up to this point consumed some 880 pages of the nearly 2,000-page social media report. Rep. Billy Long, a Missouri Republican, alone, consumed dozens of pages showing how regularly he promoted disinformation and then later, insisted there was no insurrection. Dozens of pages also feature Rep. Elise Stefanik of New York. Stefanik later assumed a House leadership role when Leader McCarthy ousted Rep. Liz Cheney. Cheney was booted from the role when she refused to go along with her party’s overarching insistence that Trump won the election. 

Neophyte lawmakers like Rep. Madison Cawthorn also eagerly promoted the ‘Stop the Steal’ agenda.

Other more tenured lawmakers, like Rep. Jim Jordan of Ohio—who received a notice from the Jan. 6 Committee on Dec. 22 asking for his voluntary compliance with the probe—appeared to make promotion of election fraud lies a cornerstone of their job. During the riots he tweeted his objections routinely.

Then there are legislators like Rep. Scott Perry of Pennsylvania, who also received a request from the committee to remit documents and sit for deposition. He refused. Many questions remain. So many lawmakers, like Rep. Pete Sessions, appeared to openly support Trump’s subversion efforts. Sessions tweeted a photo of himself with supporters of the ‘Stop the Steal’ movement on Jan. 2, for instance.

In this sweeping assessment of social media activity, there are many commonalities. Perhaps the most common was a desire by so many Republicans in the House for a thorough review of issues they deemed of national importance. Their nearly wholesale refusal of the Jan. 6 probe, however, has spoken volumes in the year since the Capitol attack.

Former prosecutors say this 10-minute video provides ample evidence for Trump’s impeachment

Online news outlet Just Security, which focuses on 'rigorous analysis of law, rights, and U.S. national security policy,' has created an intense 10-minute compilation splicing together video clips from events leading up to the Capitol insurrection alongside Donald Trump's speech to the mob before they marched to and into the Capitol.

Using videos that were created and uploaded by users of the gutter of right-wing social media dumpster Parler (before the FBI lights came on and users started to scramble), the events of Jan. 6 are becoming clearer. The original video was collected by ProPublica and made available to the public, and Just Security was able to create more context for Donald Trump's speech, using the crowd responses. Set chronologically, the video is a damning piece of evidence that could and should be used in the impeachment trial of the twice-impeached former president. It shows the crowd reacting in real-time to Donald Trump's calls to "fight" for him at the Capitol, as well as whipping the crowd into a white-hot frenzy toward his own vice president. 

Just Security reporters Ryan Goodman and Justin Hendrix interviewed numerous “former senior Justice Department officials and former federal prosecutors” to get their takes on the video compilation and the result is a roadmap into the possible second impeachment of Donald Trump.

The video begins with footage of Donald Trump speaking to the Jan. 6 Stop the Steal crowd, highlighting his claims that “We will never give up. We will never concede. You don’t concede when there is theft involved,” and “We want to be so nice. We want to be so respectful of everybody, including bad people.”

Video of the crowd obtained from Parler shows people yelling and cheering, and responding to Trump’s call to action by yelling things like “Storm the Capitol,” “Invade the Capitol building,” and “Take the Capitol.” Calling the “left” of the United States, “ruthless,” Trump continuously called on then-Vice President Mike Pence to “do what’s right for the Constitution and the country.” 

Trump hits the war and fighting metaphor again, saying that “Now it is up to Congress to confront this egregious assault on our democracy,” and how the Stop The Steal folks will now march down to the Capitol building and make themselves a herd heard.  The video then pivots to the march down to the Capitol building, showing charlatan luminaries like InfoWars’ Alex Jones telling the crowd to go to the “other side of the Capitol building,” where he claims Trump will be.

Later, the video shows a crowd at the door of the Capitol building chanting “We want Pence,” over and over again. It’s not a bunch of people calling for Mike Pence to speak—that’s something that’s never happened in America, frankly. A man inside of the Capitol building is videotaped talking into a landline phone in the building, asking for Speaker Pelosi and Mike Pence, saying “We are coming for you, bitch!”

Other video taped next to scaffolding erected at the Capitol building shows a guy speaking into a megaphone, saying he hopes Mike Pence goes to the “gallows,” and that he would like to see him in front of a “firing squad.” I wonder why Mike Pence didn’t come out to nod paternalistically at the MAGA supporters, like he has for the past four years?

Video inside of the Capitol building hallways shows big bearded faketriots screaming at D.C. and Capitol police, telling them that “You’re outnumbered. There’s a million of us out there, and we are listening to Donald Trump—your boss.”

The chant of “Fight for Trump” continues.

At 4:17 PM that day, after hours of inaction, Trump released his weak sauce Twitter video, once again calling the election “fraudulent,” but telling his supporters to go home. This is followed by video of Mr. QAnon Narcissistic Mascot Jacob Chansley saying that Trump told them to go home and that the rioters had “won the day,” because it had sent the message they would remove officials from office “one way or another” if they didn’t overturn the results of the election—or whatever demands they come up with, I guess?

Finally, they cut in MAGA acolytes like Texas realtor Jenna Ryan, who chartered a private jet to go and storm the Capitol building. After first telling people she hadn’t gone in the building, only to have her own footage and a lot of other footage show that she was lying, the video has a local news interview with her saying that she thought she was following Trump’s instructions. She was, but that’s still a crime.

Former Assistant United States Attorney for the Southern District of New York Elie Honig tells Just Security that “The House impeachment managers should consider rolling this tape as their final exhibit at the trial. It shows, clearly and viscerally, how President Trump’s words in fact incited the insurrectionist mob — particularly when taken in combination with Trump’s own tweet, after the riot, praising the mob as ‘great patriots’ who should ‘remember this day forever.’”

Former U.S. Attorney for the Western District of Pennsylvania and former Deputy Assistant Attorney General Harry Litman disagrees with Honig on strategy, but not on how damning this all is: 

From a legal standpoint, a prosecutor in a case charging Trump with seditious conspiracy would play this tape in an opening, and then say, “Ladies and Gentlemen of the Jury, the evidence will show that the insurrectionists came to Washington that day because they believed the President had called them there to do their patriotic duty; once there, the President worked them into a demented rage, telling them they had to fight like hell, and that he would be there with them at the Capitol. They went with blood in their eyes screaming ‘Fight for Trump!,’ threatening the lives of Nancy Pelosi and Mike Pence, and proceeded to storm and lay waste to the Capitol, the sanctum of our democracy, all while President Trump viewed the bedlam with delight from his safe perch back at the White House. They were criminals and deserved to be punished; but any fair-minded person will see from this evidence and more that we will bring forward that it was the President who lit the match and threw it on the fire because he wanted – and at a minimum reasonably foresaw – that they would become an out-of-control mob.”

In lieu of real evidence of fraud, the Trump administration and its surrogates—and those wanting to make some last-minute money off the MAGA crowds—promoted the idea that the entire election of Joe Biden over Donald Trump was rigged. In every form of media, at every opportunity, they told millions of Americans that not only were their suspicions of problematic votes cast, but that in fact, a coordinated effort to overthrow the “landslide” victory of Donald Trump was underway.

You can argue that the people who believe the things that Donald Trump says are being conned. They are. You can say they truly believed that their attempt to force Congress to throw out millions of American votes was just and constitutional. You can say all of those things because Donald Trump, the president of the United States, told them exactly that. Other elected officials, including senators, told them it was true. 

The fact of the matter is that Trump’s guilt is very easily verified. He purposely misled his supporters and then attempted to have them illegally overthrow our government. The only defense the MAGA insurrectionists being arrested right now have amounts to an insanity plea. They believed the government was out to get them and they needed to violently defend themselves because they believed they were about to be hurt by magic. It’s not a worthwhile defense in most of their cases, and hopefully, they can watch from a jail cell’s closed-captioned television set as their fearful leader and liar is convicted of crimes against our Constitution and the Executive office of our country.

Your blow-by-blow recap of the mute-button presidential debate, with a little help from Twitter

No matter what happens, this is Donald Trump’s last presidential debate. That’s the straw American voters grasped at Thursday night ahead of the final showdown between the impeached and infected Trump and former Vice President Joe Biden. This debate—the second of what was supposed to be three—was broadcast live from Belmont University in Nashville, moderated by NBC News’ Kristen Welker, and followed the same format as the first debate on Sept. 29, which absolutely everyone absolutely hated. As the nonpartisan Commission on Presidential Debates announced in September:

The debate will be divided into six segments of approximately 15 minutes each on major topics to be selected by the moderator and announced at least one week before the debate.

The moderator will open each segment with a question, after which each candidate will have two minutes to respond. Candidates will then have an opportunity to respond to each other. The moderator will use the balance of the time in the segment for a deeper discussion of the topic.

Of course, that was before Trump reminded the nation why he absolutely has to go. The first debate was, as CNN’s Dana Bash said just moments after it ended, “a shitshow.” (Jake Tapper called it a “hot mess inside of a dumpster fire” moments later.) It was undeniable. Trump’s inability to let Biden or moderator Chris Wallace get a word in forced the CPD to declare that “additional structure” was needed for the debates to follow. On Oct. 19, the CPD revealed that “structure” looked like a mute button. Unfortunately for all of us, muting was only permitted during the initial two minutes granted to each candidate at the top of the six segments. Trump’s been whining about it ever since, perhaps because interrupting Biden at every turn was the Trump campaign’s only game plan. After all, the superspreader-in-chief faces scrutiny from a nation that watched him fail to keep his campaign promises on a massive scale, an electorate who’s seen him fumble just about every chance he had to move our nation forward, and, of course, a country left to fend for itself in the face of a deadly pandemic.

As always, I watched every single second of this debate so you didn’t have to. Let’s go.

Welker announced six topics on Oct. 16. The Today Show weekend anchor and White House correspondent offered these points of focus: fighting COVID-19, American families, race in America, climate change, national security, and leadership. Most of these subjects were tackled in some form in the first debate and subsequent dueling town halls, but “American families” and “leadership” are pretty vague, so this should be interesting, assuming the candidates don’t pull a Pence and just answer completely different questions than those asked. We all know that Trump is lagging in the polls and that his campaign is broke, but more importantly, we know he’d rather talk about anything but COVID-19, and would love to focus on debunked Hunter Biden nonsense, insist that helping our nation’s poorest will destroy the suburbs, and yell about either Leslie Stahl or Hillary’s emails. Trump, through spokeswoman Alyssa Farah, announced his intentions on the morning of the debate; it’s clear he started the day determined to showcase the obsession that got him impeached.

THE CORONAVIRUS

Trump was asked how he’d navigate the next stage of the global pandemic. Trump kicked off by listing the number of people who didn’t die.

He then flaunted manipulated statistics and lies about surging states and boasts of his own recovery from the virus. He then claimed that other heads of states called him to congratulate him on his performance. He finished by promising a vaccine was coming within weeks and echoing his new refrain about “rounding the curve.” So, he didn’t answer the question.

Trump smirked as Biden somberly stated, “220,000 Americans dead.” He then noted Trump’s refusal to take any responsibility for those deaths and declared that he didn't deserve to be president.

He shot holes in Trump’s comparison of the U.S. to Europe, warned of at least 200,000 more deaths, entreated people to wear masks, and insisted that Trump has no plan before launching into his own: rapid testing, mask encouragement, and figuring out how to craft plans and direct resources to schools and businesses so that they can re-open safely and successfully. Trump, remarkably, kept quiet the entire time.

Welker wanted to know more about the promise of a vaccine “within weeks.”

Trump then named names of companies that were on their way. Welker pointed out that his own administration says that it will take months, and asked him if he was being realistic. Trump insisted his timeline was “more accurate,” and implied his own experts didn’t know about his plan to use the military to distribute “a hundred million” vials of a vaccine.

Biden was asked how he’d help Americans have confidence in a vaccine once approved, citing that 40% of Americans said they have no plans to take one. The former vice president noted the need to be transparent about the approval process. He warned of a “dark winter,” and reminded the audience that Trump said that the pandemic would be over by Easter 2019.

Trump touted his “China Ban” that wasn’t a ban and brought up Biden’s critiques of it as being xenophobic, before veering into H1N1.

Biden didn’t bother replying to the H1N1 nonsense, then reiterated that Trump is xenophobic and noted that Trump didn’t send scientists to China and praised Xi Jinping.

Trump replied by spending a long time talking about Biden living in his basement, made a hint about Biden making his money in a questionable way before hinting that Biden made his money in shady ways.

Welker deftly slipped in a quick fact-check, noting that young people can get COVID-19 and pass it to others. She began to ask Biden a question about pandemic strategy before Biden became the first to challenge the moderator. He asked to respond to Trump’s statement that people are “learning to live with it,” by stating that we’re learning to die with it. He then repeated that Trump refuses to take responsibility for any of it.

Trump then did his signature “excuse me” without waiting to be excused and offered his first Trumpian quote of the night.

He then blamed China for containing it within its borders but not from spreading across the planet. Biden repeated the “whole range of things,” all wrong, that Trump said to Americans. Trump again brought up Biden’s “xenophobic” critique, and Biden basically gave it a half-hearted rebuttal.

Welker asked Biden about the economic and social impact of a shutdown. Biden vowed to “shut down the virus, not the country.” He noted that Trump’s ineptitude was the reason people were suffering, not the shutdowns. He then insisted that Trump should have been working with Pelosi to get relief to people. Trump mocked Biden for talking about shutdowns too much and rattled off attacks at states with Democratic governors.

He also declared that Barron, his son with his third wife, recovered from COVID-19 quickly, painting it as a miracle.

Biden again repeated that cities and states needed resources to reopen safely, bringing up school ventilation systems as an example. Trump bashed New York as a ghost town where nobody wants to live and repeated several talking points this writer recognized as almost verbatim from his 60 Minutes interview that he leaked today.

Biden continued to talk basic strategy and pointing out Trump’s aversion to it.

Trump brought up and bashed as many Democratic governors in swing states as he could—Michigan and Pennsylvania—and Biden brought up Wall Street. Trump attempted to paint Biden as owned by Wall Street while simultaneously claiming he controlled Wall Street. Biden slipped in that his average contribution was $43 before Welker declared the topic completed.

ELECTION SECURITY

Biden was up first and asked about new reports that multiple nations are interfering in our election. Biden brought up that Trump has done nothing to stop Vladimir Putin of Russia, and brought up the way that Trump attorney Rudy Giuliani has been duped by Russia. He then vowed to lay down the law on American adversaries.

Instead of letting Welker ask a question, Trump lived up to his vow to answer the questions that he want, and used his time to first insist he’s hard on Russia before diving into his big goal of painting the Biden family as a corrupt crime family with emails and millions of dollars, all procured from Russia and China. After referencing an unnamed person who had a press conference where unspecified accusations were made, demanded that Biden answer his accusation.

Biden denied everything before launching into Trump’s refusal to release his tax returns, noting that he’s released all of his. Trump insisted that his accountants told him that he “prepays” all of his taxes, and that’s why he doesn’t pay any taxes. Welker asked him when he’d release his returns, and Trump played the victim, claiming that he “gets treated worse than the tea party,” and is only being audited because he ran for president.

He then shifted into a nonsensical mafia narrative where Biden is known as “The Big Man” and gets 10% of all his sons’ schemes.

Biden repeated his demand that Trump release his returns, and Trump repeated his accusations of corruption, painting himself as a victim due to being impeached and hinted at some dirt on Biden’s brother and Iraq.

Welker jumped in before Biden could reply, and asked Biden if there was any truth to the allegations. Biden said there was not, and pointed out that the only bad deeds going on was Trump trying to get dirt that didn’t exist. Trump rattled off some numbers, Biden reiterated that no wrongdoing was found.

Welker asked about the Chinese banking recently uncovered by The New York Times and Trump told a story about how there’s nothing wrong at all with anything he did. Trumpian “excuse me” steamrollers went right over Welker before she insisted on moving on, asking Biden what he’d do to China if elected.

Biden vowed to make China play by the rules and use proper policy to punish them if they do not, instead of Trump’s stupid tariffs. He brought up North Korea, and when Welker went to ask about it to Trump, he rolled over Welker again to hint at Biden crime family nonsense, and Welker actually stopped him to ask about his own policies with China. Trump insisted that his tariffs and sanctions were effective, netted billions of dollars and helped farmers. When Biden pointed out that taxpayers bailed out farmers, Trump claimed China is the taxpayer.

When Welker finally asked Trump about his relationship with North Korea, Trump claimed Barack Obama told him war was imminent, but he became buddies with Kim Jong Un and that’s why there’s no war. Biden explained North Korean policy under Obama and why it was good policy. Trump insisted that Jong Un just didn’t like Obama. Biden pointed out that was because Obama wanted to denuclearize the Korean Peninsula. Trump said Obama left him “a mess” before Welker moved onto health care.

HEALTH CARE

Welker asked Trump about his administration’s current effort to overturn the Affordable Care Act in the Supreme Court, and what happens if they win? Trump railed about how terrible Obamacare is and how overturning the individual mandate made it something totally different but it’s still terrible and needs to be replaced by his nonexistent plan which totally always was going to cover preexisting conditions, totally always was going to cover them. He then said Biden would create socialized medicine. Biden was asked the same question. Pointing out that it put him at odds with most of the Democratic primary candidates, Biden vowed to create Obamacare with a public option, which would reduce prescription prices, let people keep their private insurance, and protect preexisting conditions. He clarified that it’s not the next step to fully socialized medicine as Trump always claims, pointed out that providing health care for all will help businesses. Trump, who was obviously communicating with someone in the audience, then leaned into “47 years in government” taunting of Biden, and insisted that his running mate Kamala Harris is “more liberal than Bernie Sanders” before bringing up fracking. He then thanked Welker for her “handling” of things before telling her to ask a question she did not let him finish.

Trump then repeated his fearmongering about socialism before Biden joked that he must be confused about who he’s running against. Biden then boasted that he won the nomination because he beat all the other candidates.

THE ECONOMY

Trump, deciding he was done with health care, brought up how stocks boomed under him. Trump vaguely accused Biden of harming Social Security somewhere in time, and also said Biden is not “really” from Scranton, in addition to insisting he’s the savior of the stock market and everyone’s 401(k).

Welker then brought up the struggles Americans are facing under the COVID-19-fueled recession, and asked Trump why he’s not helped. Trump blamed Pelosi. Welker asked Biden why he’s not pushed Democrats to make a deal, and Biden pointed out that the HEROES Act has been withering on the vine for months, and could have helped cities, counties, and states—teachers, firefighters, first responders—while Senate Majority Leader Mitch McConnell refuses to take it up.

Trump insisted that the HEROES Act was horrible and benefited blue states and illegal immigrants. Biden fired back that he’s a proud Democrat but will be an American president and it shouldn’t be about the politics of each state’s leadership.

Welker then asked about the fight to raise the minimum wage, and asked if this was the right time to do so. Biden said it was, because we need to help businesses. Trump claimed it be a state choice, insisting that $15 would kill small businesses. Biden said there’s no data that supports that myth.

IMMIGRATION

Welker then asked Trump about the recent news that Homeland Security has lost track of the parents of over 500 children separated at the border. Trump then blamed the baby cages on Obama before saying that his administration was looking for these parents, and wrongly implying that the children came to the country alone. Biden was disgusted and fact-checked Trump: The children were with their parents when they got here.

Trump refused to address the actual question and repeated his blaming of Obama for baby cages, claiming that his administration put migrant children in lavish digs.

Welker asked Biden why voters should trust him to overhaul the immigration system. He vowed to create a path to citizenship, particularly for DACA recipients. Trump cited his own overhaul, saying that Biden had eight years to fix the system as vice president. Trump then celebrated his end of “catch and release” before blaming Obama for baby cages again.

RACE IN AMERICA

Welker asked Biden to speak to families of color, who have to have “The Talk” with their children to teach them about the dangers of police that they face as people of color, regardless of their economic class. Biden noted that his daughter is a social worker before stating that there is systemic racism in this country. He then ran through a bulleted list of places where people of color need investment, including education and small businesses.

After bringing up the 1994 Crime Bill and “super predators,” Trump insisted that he’s the best president for Black people since Lincoln—and implied that he might outrank Lincoln, actually.

He then claimed liberals cried in his office in gratitude for his work with prison reform and HBCUs, and giving Sen. Tim Scott, the lone Black Republican in the Senate a shoutout.

Biden then denied the “super predator” accusation and pointed out that the Obama administration pardoned (checks calculator) nearly 500 times as many people as Trump has. Trump then asked why Biden didn’t fix everything when he was vice president before saying that he only ran in 2016 because of him and Barack Obama.

Biden contrasted himself against Trump directly to the American people and explained his plan to eliminate mandatory minimum sentences. Trump immediately went back to his accusations of Biden family corruption and “the laptop” before Welker, who was done playing around, pulled it back to the topic at hand: race.

Reading several of Trump’s many racist acts to him, she asked him why people should trust him. Trump used his time to insist he’s not racist and disparage Black Lives Matter as people who wanted to kill cops.

Biden made an Abraham Lincoln joke at Trump’s expense that Trump pretended he didn’t get, all the better to launch into how not-racist he is, and how he is the best thing Black people have ever seen, and to bring up the 1994 Crime Bill again.

Biden took responsibility, among with the entire Senate, for the Crime Bill, and expressed regret, particularly for the disparity in cocaine sentences. Trump kept asking why Biden didn’t fix the criminal justice system when he was vice president. In an awkward moment, Biden blamed the Republican Congress, and Trump said he should have convinced them. With that, it was time for

CLIMATE CHANGE

Welker, after pointing out the candidates’ very different visions to combat climate change, asked Trump why his was better. Trump spent most of his two minutes talking about a trillion trees and bashing Obama, but claimed none of it matters since the U.S. can’t force Russia or China or India to do anything.

He also declared that the Paris Climate Accord was horrible.

Biden solemnly addressed the real crisis that is our destruction of this planet, laid out a detailed plan to combat climate change, and Trump decided to take aim at The Squad, who he calls “AOC Plus Three,” and accused Biden of wanting to knock down all the buildings with big windows and replace them with buildings that have tiny windows.

Biden laughed the entire time, and dismissed Trump entirely before insisting that the nation could grow and be cleaner under his plan. Trump attacked windmills and solar power with some absolute gobsmacking lies that have nothing to do with science or reality. He tried to get to fracking but Biden jumped in, insisting he’s never been against it. Trump said Biden will turn against fracking because the party said so.

The segment on the urgency of climate change has morphed into a conversation of who loves fracking more, which will be great to show children in 50 years to explain what happened.

Trump was then asked about his plans to fight environmental racism. Trump insisted that people of color are all working, and then essentially said he hadn’t heard of environmental racism before bragging about how we don’t get our oil from other countries anymore, proving he’d absolutely missed the point.

Biden, by contrast, spoke to the “fence line” communities that bear the brunt of oil pollution. Trump—not the actual moderator—then asked Biden if he’d shut down the oil industry, and Biden answered him, saying that he’d transition us out of it. Trump then said “he’s gonna shut down the oil industry” and named battleground states like Texas and Ohio, telling them to “remember that” in a desperate ploy for votes.

LAST QUESTION, LAST DEBATE

For the final question, Welker asked each candidate what they would say to people who didn’t vote for them in their inaugural address.

Trump blamed China for the pandemic again before insisting that everyone loved him before it, and bashed about what a horrible president Biden would be. Biden took his time to call himself an “American president” who represents everyone, and vowed to improve conditions for the whole country. He slipped in an entreaty for voters to remember what’s on the ballot and then, thankfully, it was over.
