Democrats block effort to impeach DHS Secretary Mayorkas with Republican support

House Democrats, with the help of a small group of Republicans, on Monday successfully blocked an effort led by Rep. Marjorie Taylor Greene, R-Ga., to impeach Homeland Security Sec. Alejandro Mayorkas in a straight up or down vote.

The final vote tally was 209-201, with eight Republicans joining all Democrats in support of the latter party's motion to stop that floor vote, and instead refer the impeachment resolution introduced by Greene to the House Homeland Security Committee. Twenty-four members — 12 Democrats and 12 Republicans — did not vote on the measure.

The eight Republicans who joined Democrats included Reps. Ken Buck, R-Colo., Darrell Issa, R-Calif., Tom McClintock, R-Calif., Patrick McHenry, R-N.C., John Duarte, R-Calif., Virginia Foxx, R-N.C., Cliff Bentz, R-Ore., and Mike Turner, R-Ohio.

Greene introduced the resolution to impeach Mayorkas on Thursday, which would have forced a vote on impeachment without a hearing or a committee markup. If voted on and passed, it would have sent his impeachment straight to the Senate for trial.

The Department of Homeland Security responded to the vote with a statement accusing Congress of "wasting time," and calling on it to "do its job by funding the government, reforming our broken immigration system, reauthorizing vital tools for DHS, and passing the Administration’s supplemental request to properly resource the Department’s critical work to stop fentanyl and further secure our borders."

"Secretary Mayorkas continues to be laser-focused on the safety and security of our nation. This baseless attack is completely without merit and a harmful distraction from our critical national security priorities," the statement read.

Mayorkas has faced increased calls for his impeachment over the past year concerning his handling of the border crisis. At the same time, Republican lawmakers have repeatedly raised concerns about the risk to national security and public safety posed by the numbers of illegal immigrants evading overwhelmed Border Patrol agents amid the crisis.

Under Mayorkas, migrant encounters at the southern border hit an all-time record in September with a massive 260,000 encounters as border officials continue struggling to cope with the large influx, sources told Fox News Digital.

Last month, Mayorkas confirmed that over 600,000 illegal immigrants evaded law enforcement at the southern border during fiscal year 2023.

House punts on Mayorkas impeachment

A small number of House Republicans sided with Democrats in moving to punt an effort to impeach Homeland Security Secretary Alejandro Mayorkas.

Rep. Marjorie Taylor Greene (R-Ga.) filed the motion last week, leapfrogging Republican leadership to force the vote. It threw newly elected Speaker Mike Johnson into a messy debate that fires up a disgruntled party base but doesn’t unite his razor-thin majority.

A total of eight Republicans voted with Democrats on Monday night to send Greene’s resolution to committee, effectively pigeonholing it for now.

While Johnson has said he supports what would be a historically rare impeachment for a Cabinet official, he’s also having to contend with a coalition of frontliners, old-school conservatives and governing-minded pragmatists who aren’t yet sold that Mayorkas has actually committed an impeachable offense.

GOP Reps. Cliff Bentz (Ore.), Ken Buck (Colo.), John Duarte (Calif.), Virginia Foxx (N.C.), Darrell Issa (Calif.), Tom McClintock (Calif.), Patrick McHenry (N.C.) and Mike Turner (Ohio) voted with Democrats to refer to the resolution to committee.

The fight also comes five days before a potential government shutdown, sparking private grumbling that Greene’s resolution is badly timed. She had filed it late last week, forcing it to come to a vote for consideration within two legislative days.

Greene hinted over the weekend that she thought leadership was working to kill her resolution either by tabling it or trying to refer it to a committee. Ahead of Monday’s vote, she warned that “a vote with the Democrats is a vote AGAINST impeachment.”

She added after her resolution was sent to committee Monday night that she could force the impeachment vote again, predicting the eight Republicans who voted with Democrats will come under pressure from voters to flip their position.

"I can assure you that Republican voters will be extremely angry," Greene said.

Mayorkas was once viewed as the conference’s top impeachment target. But that effort has been pushed out of the spotlight — and from most GOP lawmakers’ attention spans — by a sweeping investigation into President Joe Biden, not to mention a weeks-long speaker fight that ground the House to a halt.

The Homeland Security Committee is also months into its own border investigation, releasing “phase four” of its findings on Monday. Committee Chair Mark Green (R-Tenn.) has said he intends to complete his five-step investigation before making a decision on whether to make an impeachment referral to the Judiciary Committee. Green voted against sending the resolution to committee Monday night.

Democrats, and even some Republicans, have criticized the impeachment effort, arguing that the disagreements with Mayorkas amount to policy differences not high crimes or misdemeanors.

“Every day, the men and women of the Department of Homeland Security work tirelessly to keep America safe. They need Congress to stop wasting time and do its job by funding the government, reforming our broken immigration system, reauthorizing vital tools for DHS, and passing the Administration’s supplemental request to properly resource the Department’s critical work to stop fentanyl and further secure our borders," a department spokesperson said Monday.

But unlike when Republicans easily referred to a resolution to impeach President Joe Biden to committee earlier this year, impeaching Mayorkas sparks division within the conference. Some of the Republicans who voted against sending the resolution to committee haven't come out in support of impeaching Mayorkas, meaning there's likely a larger pool of opposition within the GOP conference.

But Rep. Tony Gonzales (R-Texas), from a border district, confirmed to POLITICO that he has been trying to build support for impeaching Mayorkas among moderate and swing-district Republicans.

“I am tired of Americans and migrants dying in my district," he said.

Joe Biden wants to complete his goals on civil rights, taxes, and social services if he’s reelected

WASHINGTON (AP) — President Joe Biden has a simple reelection pitch to voters — let him "finish the job."

So what does that mean? What's left for him to get done?

Unlike Donald Trump, the front-runner for the 2024 Republican presidential nomination who has been releasing videos and statements detailing his agenda, Biden hasn't formally released his plans as part of his campaign.

But his ambitions are no secret, and his goals for child care, community college and prescription drugs have been laid out in detail during the Democrat's first term. He also has unfulfilled promises on civil rights, such as protecting access to the ballot box, preventing police misconduct and restoring the nationwide right to abortion. Banning firearms known as assault rifles remains a priority as well.

The result is a second-term agenda that could look a lot like Biden's first-term agenda, with some of the same political challenges. Almost none of this can get done without cooperation from Congress, and many of these goals already have been blocked or pared down because of opposition on Capitol Hill.

Biden has achieved bipartisan victories on infrastructure projects and public funding for the domestic computer chip industry. But Democrats would need to win wide majorities in both the House and the Senate to clear a path for the rest of his plans.

"We're going to finish as much of the job as we can in the next year," said Bruce Reed, Biden's deputy chief of staff. "And finish the rest after that."

Biden's campaign expressed confidence that the president's agenda would stack up well against Republicans in next year's election. Kevin Munoz, a spokesman, described the election as "a choice between fighting for the middle class or shilling for rich special interests" and he said "it's a contrast we are more than happy to make."

One other difference between Biden and Trump doesn't fit neatly into policy white papers, but it's core to their political foundation. Biden has made defending American democracy a cornerstone of his administration, while Trump tried to overturn his election loss in 2020.

The result of the 2024 campaign could reshape not only government policy but the future of the country's bedrock institutions.

TAXES

Biden's plans are expensive and he doesn't want to increase the deficit, so that means he's looking to raise taxes on the wealthy.

He already has succeeded in implementing a 15% minimum tax on companies with annual income exceeding $1 billion.

Biden has proposed raising the top tax rate to 39.6%, the corporate tax rate to 28% and the stock buyback tax to 4%.

He wants a minimum tax of 25% on the wealthiest Americans, a levy that would be applied not only to income but unrealized capital gains. The idea, which Biden called the "billionaire minimum income tax," could prove difficult to put in place, not to mention extremely hard to push through Congress, given Republican opposition to higher taxes.

SOCIAL SERVICES AND HEALTH CARE

Biden's original signature plan was known as Build Back Better, a cornucopia of proposals that would have dramatically changed the role of the federal government in Americans' lives.

It was pared down because of resistance from Sen. Joe Manchin, a West Virginia Democrat who is a key vote in the narrowly divided Senate and announced this past week that he will not seek reelection. The result was the Inflation Reduction Act, which included financial incentives for clean energy and limits on prescription drug costs, but not many other programs.

Biden will want to bring back the ideas that were left on the cutting room floor. That includes making two years of community college tuition free, offering universal preschool and limiting the cost of child care to 7% of income for most families.

He also wants to resuscitate the expanded child tax credit. The American Rescue Plan, the pandemic-era relief legislation, boosted the credit to $3,000 for children over six and $3,600 for children younger than age 6. The expansion lapsed after a year, returning the credit to $2,000 per child, when his original package stalled.

More work is left on prescription drugs. The monthly cost of insulin was capped at $35 for Medicare recipients. Biden wants the same limit for all patients.

GUN VIOLENCE

The White House recently announced a new office dedicated to preventing gun violence. Biden also signed legislation that's intended to help officials keep guns out of the hands of domestic abusers and other dangerous people.

But Biden's biggest goal, a ban on so-called assault weapons, remains out of reach because of Republican opposition. Such a ban was in place from 1994 to 2004, but it wasn't extended after it expired. Although the proposal hasn't been spelled out in detail, it would likely affect popular high-powered weapons such as the AR-15, which can shoot dozens of bullets at a fast pace.

Another item on the wish list is universal background checks, which increase scrutiny of sales conducted through gun shows or other unlicensed avenues.

CIVIL RIGHTS

Biden took office at a time of national upheaval over the role of racism in policing and the future of democracy. George Floyd, a Black man in Minneapolis, was murdered by a white police officer, and Trump tried to overturn Biden's election victory, leading to the riot on Jan. 6, 2021, at the U.S. Capitol.

Biden promised to address both of these issues through landmark legislation, but he came up short of his goals.

On policing, bipartisan negotiations on Capitol Hill failed to reach a deal, particularly when it came to making it easier to sue over allegations of misconduct. So Biden instead crafted an executive order with input from activists and police. The final version changes rules for federal law enforcement, but it does little to alter how local departments do their jobs.

He similarly issued an executive order on voting rights that aims to expand registration efforts. But Democratic legislation intended to solidify access to the ballot box failed to advance when some members of the party refused to sidestep Senate filibuster rules to pass it.

Biden's presidency was upended by the Supreme Court's decision to overturn Roe v. Wade, which guaranteed nationwide access to abortion. It's proved to be a potential campaign issue for Democrats, but they have had less success in Congress. Biden said that if his party picks up more seats, he will push for legislation codifying the right to abortion.

IMMIGRATION

On Biden's first day in office, he sent Congress his proposal for overhauling the country's immigration system. The idea went nowhere.

But the president would want to take another swing at the issue in a second term. It will prove an especially urgent topic as migrants continue crossing the U.S.-Mexico border and the country looks for the next generation of workers to achieve its economic goals.

Biden wants to allow people who are in the United States illegally to apply for legal status and eventually citizenship. He also wants a smoother and expanded visa process, particularly for foreign graduates of American universities. These steps would be paired with additional resources for border enforcement.

UKRAINE AND ISRAEL

Biden is facing two wars on two continents, and the fallout from each conflict will shape a second term even if the fighting ends before that.

The Russian invasion of Ukraine has been going on for almost two years, and Israel and Hamas began their latest clash about a month ago. Biden wants to send military support to Ukraine and Israel, something that he describes as "vital" to U.S. national security interests.

"History has taught us when terrorists don't pay a price for their terror, when dictators don't pay a price for their aggression, they cause more chaos and death and more destruction," he said in a recent Oval Office address.

His plans will require challenging congressional negotiations. Some Republicans are resisting more assistance for Ukraine after Congress has already approved $113 billion in security, economic and humanitarian resistance.

Both conflicts will likely require years of U.S. involvement. For example, Biden is looking for a new opportunity to push for a two-state solution in the Middle East, creating an independent Palestinian country alongside Israel.

CLIMATE

Fighting global warming is one of the areas where Biden has had the most success. The Inflation Reduction Act includes nearly $375 billion for climate change, much of it going toward financial incentives for electric cars, clean energy and other initiatives. Biden is also pushing stricter regulations on vehicles and power plants.

But the U.S. is not yet on track to meet Biden's ambitious target for reducing greenhouse gas emissions, according to independent analysts. And there's a lot of work ahead to ensure new programs reach their potential.

One hurdle is red tape for energy projects. The White House argues that it's too hard to build infrastructure such as transmission lines, but legislation to address the issue would likely require compromises with Republicans, who see an opportunity to grease the skids for additional fossil fuel development.

Campaign Action

House GOP subpoenas former White House counsel in Biden classified documents probe

House Oversight Chair James Comer is issuing more subpoenas, this time related to his investigation into President Biden’s handling of classified documents.

Comer (R-Ky.) subpoenaed former White House counsel Dana Remus on Monday, as well as a request for transcribed interviews with four White House employees. In a letter to an attorney for Remus, Comer and Judiciary Committee Chair Jim Jordan (R-Ohio) link Biden’s handling of classified documents to the larger GOP Biden impeachment investigation, which centers around his family’s business deals.

Republicans are months into that probe. And while they have uncovered examples of Hunter Biden trying to use his last name to further his business deals — and poked holes in some of Biden and the White House’s previous statements — they’ve struggled to find a smoking gun that would link Joe Biden’s official decisions to his family’s business deals.

Attorney General Merrick Garland tapped Robert Hur to serve as special counsel for an investigation into Biden’s handling of classified documents, which were first found at the Penn Biden Center.

The White House said last month that Biden had taken part in an interview as part of the investigation.

Comer, Jordan subpoena former White House counsel for testimony related to Biden’s classified docs

FIRST ON FOX: House Oversight Committee Chairman James Comer and House Judiciary Committee Chairman Jim Jordan subpoenaed former White House Counsel Dana Remus to appear for a deposition and requested transcribed interviews from several other officials with knowledge of President Biden’s alleged improper retention of classified records, Fox News Digital has learned.

Comer and Jordan subpoenaed Remus Monday. 

Comer first requested she appear for a transcribed interview before the House Oversight Committee in May. That request came after the panel obtained information that they said "contradicts important details from the White House’s and President Biden’s personal attorney’s statements about the discovery of documents at the Penn Biden Center, including the location and security of the classified documents."

COMER DEMANDS ANSWERS ON WHETHER BIDEN CLASSIFIED RECORDS MENTION COUNTRIES RELATED TO FAMILY BUSINESS DEALS

Comer has described Remus as a "central figure in the early stages of coordinating the packing and moving of boxes that were later found to contain classified materials." Comer, in May. Said Remus could be a witness "with potentially unique knowledge" about the matter.

Comer and Jordan also requested an interview with Annie Tomasini, a senior Biden aide and director of Oval Office Operations who took "inventory" of Biden's documents at the Penn Biden Center over a year before they were said to be found. Tomasini is a close friend of the Biden family, and Hunter Biden.

They also requested an interview with Anthony Bernal, a senior advisor in First Lady Jill Biden’s office and Ashley Williams, a special assistant to the president and deputy director of Oval Office Operations; and Katharine 

House Republicans identified Remus, Bernal, Williams, Tomasini and an unknown staffer, in addition to Kathy Chung, a top aide to Defense Secretary Lloyd Austin, as individuals who made multiple visits to the Penn Biden Center and were involved with the retrieval of boxes of documents and materials ahead of early November 2022, which was when Biden's personal attorneys "unexpectedly discovered Obama-Biden documents" in a locked closet at the Biden think tank.

BIDEN INTERVIEWED BY SPECIAL COUNSEL ABOUT CLASSIFIED DOCUMENTS

Biden attorneys claim that classified documents were first discovered at the Penn Biden Center on Nov. 2, 2022, but Comer has pointed to contact between Remus and Cheung dating back to May 2022.

Comer has questioned Remus’ timing of first contacting Chung, flagging that the first contact on May 24, 2022, was "notably" the same day the Justice Department had dated a subpoena return date for former President Donald Trump to turn over any classified records being held at Mar-a-Lago.

Remus left the Biden administration last year and joined Covington & Burling LLP as a partner.

"Facts continue to emerge showing that the White House’s narrative of President Biden’s mishandling of classified documents doesn’t add up," Comer, R-Ky., said. "It is imperative to learn whether President Biden retained sensitive documents related to any countries involving his family’s foreign business dealings that brought in millions for the Biden family."

"The Oversight Committee looks forward to hearing directly from Dana Remus and other central figures to further our investigation into President Biden’s mishandling of classified documents and determine whether our national security has been compromised," Comer continued. 

And Jordan, R-Ohio said the subpoenas and interview requests is part of the House's effort to hold the Justice Department and the president accountable.

"President Biden’s mishandling of classified documents, including the apparently unauthorized possession of classified material at a Washington, D.C. private office and in the garage of his Delaware residence, raise serious concerns about his mishandling of sensitive intelligence information and his Department of Justice’s double standard of justice," Jordan said. "Today’s subpoena and transcribed interview requests represent another step in holding President Biden and the DOJ accountable." 

Comer, Jordan and House Ways & Means Committee Chairman Jason Smith, R-Mo., are leading the House impeachment inquiry against President Biden. 

"This is just the latest example of President Biden's willingness to skirt the law in order to hide the truth," Smith told Fox News Digital. "If the President himself was illegally holding classified material for some purpose, the American people deserve to know what that purpose is--and whether it constitutes an abuse of office." 

Smith added that the Biden administration "hasn't hesitated to scrutinize political opponents' use of classified materials, and he should be held to the same standard."

Meanwhile, the subpoenas also come after Comer, last month, demanded answers from Special Counsel Robert Hur, who is investigating Biden’s alleged improper retention of classified records, on whether the sensitive, classified documents Biden retained were related to specific countries— countries that were involved in his family’s lucrative foreign business deals.

Comer is investigating the Biden family’s foreign business dealings as part of the House impeachment inquiry, as well as Biden’s alleged mishandling of classified documents.

Comer also requested from Hur a list of the countries named in any documents with classification markings recovered from Penn Biden Center, Biden’s residence, including the garage, in Wilmington, Delaware, or elsewhere; and a list of all individuals named in those documents with classification markings; and all documents found with classified markings.

Biden sat down for an interview with Hur last month.

"As we have said from the beginning, the president and the White House are cooperating with this investigation, and as it has been appropriate, we have provided relevant updates publicly, being as transparent as we can, consistent with protecting and preserving the integrity of the investigation," White House spokesperson for investigations Ian Sams said after the president's interview with the special counsel. 

Hur’s investigation comes after a batch of records from President Biden's time as vice president, including a "small number of documents with classified markings," were discovered at the Penn Biden Center by the president's personal attorneys on Nov. 2, 2022. 

Additional classified records were discovered at President Biden’s Wilmington home in January. After that discovery, Attorney General Merrick Garland appointed Hur as special counsel to investigate the matter.

Leading Off

Primary Calendar: Daily Kos Elections is pleased to unveil our 2024 primary calendar, where you'll find a complete list of major-party filing deadlines, primaries, and runoffs for all 50 states. We also include the dates of each presidential primary, which often take place months before the state's downballot nomination contests. Sometimes, though, the two coincide, which frequently leads to higher-than-normal primary turnout.

One of the things we pay careful attention to at Daily Kos Elections is each state's candidate filing deadline, since it represents the point at which prospective candidates need to decide whether or not they'll actually run for office. The first deadline of the cycle was on Friday in Alabama, where a brand-new congressional map will be used for the first time.

That gives us the opportunity to run down the state of play for the state's key races, something we'll do as each state's filing deadline passes. And several are coming up soon: Arkansas is next on Nov. 14, while Illinois, California, Texas, North Carolina, and Ohio all have deadlines next month.

Filing season doesn't end, though, until July 19 in Louisiana, which traditionally brings up the rear. (Louisiana holds an all-party primary on Nov. 5, which is the date of the general election, rather than separate partisan primaries.) Some precise dates are not yet set such as the filing deadline for Georgia, which likely will be sometime in early March, so we'll update our calendar as soon as they are.

We also include important notes about those deadlines. Nebraska, for example, has a unique law that requires any incumbents, regardless of whether they are seeking reelection or another office, to file by Feb. 15; the deadline for everyone else is March 1. We also list states where party conventions are important for determining ballot access, winnowing the field, or officially picking nominees.

Finally, we provide details about which states require primary runoffs, including what percentage of the vote is needed in each state to trigger a second round of voting. For instance, in Georgia, a runoff is needed if no candidate takes a majority of the vote, while in North Carolina, runoffs are only conducted if no one takes more than 30%—and then only if the runner-up requests one.

The 2024 downballot primary season officially kicks off on March 5 (Super Tuesday), with Alabama, Arkansas, California, North Carolina, and Texas leading the way. Some primary dates could change, though. For instance, while Massachusetts is currently set for Sept. 17―the very last partisan primary in the nation―the state House passed a bill Wednesday to move it to Sept. 3.

The state Senate and Gov. Maura Healey still need to assent, but there's good reason to think they will. As the Boston Globe notes, the legislature has routinely bumped up the date over the last decade since late primaries interfere with federal laws that require mail ballots to be sent to overseas voters 45 days before a general election. (Legislation setting a permanent earlier date has yet to pass.) We'll update our calendar when Massachusetts finalizes its plans, and we'll do the same for any other adjustments to the calendar elsewhere.

Senate

NJ-Sen: The New Jersey Globe's David Wildstein writes that First Lady Tammy Murphy will announce in the coming week that she'll seek the Senate seat held by her fellow Democrat, indicted incumbent Bob Menendez. Murphy would join Rep. Andy Kim in the June 4 primary; Menendez, who is set to go on trial the month before, hasn't announced his plans yet, though Wildstein writes that "few expect" him to run again.

Wildstein also reports that longtime South Jersey powerbroker George Norcross will likely support Murphy. Norcross' brother, Rep. Donald Norcross, didn't rule out running himself in late September, but we can probably cross his name off the potential candidate list now.

OH-Sen: The liberal firm Data for Progress tests Democratic Sen. Sherrod Brown against four Republican foes:

  • 46-46 vs. Secretary of State Frank LaRose
  • 47-46 vs. state Sen. Matt Dolan
  • 47-44 vs. businessman Bernie Moreno
  • 48-43 vs. Some Dude Joel Mutchler

WI-Sen: NRSC chair Steve Daines told Punchbowl News that rich guy Eric Hovde is his top choice to oppose Democratic incumbent Tammy Baldwin. No major candidates have launched bids here yet, and that may not change for a while: Unnamed sources predicted that Hovde would launch sometime next year.

House

AL-01: Due to the creation of Alabama's new 2nd Congressional District (see just below), two Republican incumbents will face off for the right to represent the neighboring 1st District, Reps. Barry Moore and Jerry Carl. The revised 1st, which stretches from the Gulf Coast in the west to Dothan in the east, is a deep red, heavily white district, so whoever survives the GOP primary will be assured of another term in the House. The loser will go home.

The two incumbents, who are both white, are both intensely conservative, though Moore may be even more extreme. While both men voted against certifying Joe Biden's victory over Donald Trump in 2020, Moore went even further in inflaming Trump supporters following the Jan. 6 attacks. [I]t was a Black police officer who shot the white female veteran," he tweeted of rioter Ashli Babbit, who was shot attempting to breach a hallway adjacent to the House chamber.

Moore, a member of the House Freedom Caucus, could also earn the backing of the deep-pocketed Club for Growth, which aided him in his initial bid for the prior version of the 2nd District in 2020 while also seeking to thwart Carl that same year. But Carl, who was elected to the old 1st District, does have one notable advantage: He represents 59% of the population of the redrawn 1st versus 41% for Moore, according to calculations by Daily Kos Elections.

Alabama’s primary is March 5, though an April 2 runoff is required should no candidate win a majority of the vote. However, since Carl and Moore were the only two to file, their race will be settled in the first round.

AL-02: Alabama is poised to send two Black Democrats to Congress for the first time ever, thanks to a brand new court-ordered 2nd District that's designed to bring the state into compliance with the Voting Rights Act. The new open seat has inspired a large field of hopefuls to join the race, including 13 Democrats and eight Republicans, according to AL.com's Mike Cason.

One major name, however, had a last-minute change of heart. State Sen. Kirk Hatcher, who had announced a bid late last month, said on Friday that he would not file for the race after all. His decision means that the Democratic primary will feature no prominent candidates from the city of Montgomery, which anchors one end of the redrawn district. (The new-look 2nd runs east-west across the state to include most of the rural Black Belt, reaching down to take in Mobile along the Gulf Coast in Alabama's southwestern corner.)

That still leaves five Democratic lawmakers seeking the seat, including one who entered just before the filing deadline, state House Minority Leader Anthony Daniels. Like several other contenders, Daniels represents a district a ways away from the one he's now hoping to represent: His Huntsville-based seat is nearly 200 miles from Montgomery. Daniels, however, grew up in Bullock County, one of the Black Belt counties now in the 2nd, which he has said gives him an understanding of rural communities that other candidates lack.

State Rep. Juandalynn Givan, meanwhile, represents Birmingham, which forms the heart of the state's other Black-majority district, the 7th. (There, veteran Democratic Rep. Terri Sewell faces minimal opposition in her bid for reelection; see more below.) Givan says that she, too, has ties to the district, though she seemed less concerned about the issue. "I feel I'm just as qualified to run for this seat as anybody else," Cason reports she said at her campaign kickoff, "whether I live here in Montgomery, or whether I live across the street, or up the street, or back the street, or anywhere else."

Another Birmingham-area legislator, state Sen. Merika Coleman, pointed to her itinerant upbringing as a child of a military veteran. Coleman said that although she was not "indigenous" to her district in the legislature, "most people would never know that because I have fought the good fight" for her constituents, according to AL.com's Roy Johnson.

The other two lawmakers in the mix do actually serve parts of the 2nd District. State Rep. Jeremy Gray, best known for spearheading the repeal of Alabama's ban on yoga in public schools, represents a seat at the far eastern end of the state, though his hometown of Opelika is just outside the 2nd. Finally, state Rep. Napoleon Bracy hails from Prichard, a city just outside of Mobile. That makes him the only elected official from the region in the primary.

But he's not the only notable Mobile-area Democrat in the race: Shomari Figures, who recently stepped down from a position with the Justice Department, joined the contest the day before the filing deadline. Figures is the son of state Sen. Vivian Figures, a prominent Mobile politician who has been in public office for three decades and had considered a bid herself.

The 2nd was created specifically to give African American voters the opportunity to elect their preferred candidate—almost certainly a Black Democrat, like all of the contenders mentioned above. To that end, the district is now home to a 51% Black majority and would have voted for Joe Biden by a 56-43 margin, according to Dave's Redistricting App. Given Alabama's history of racially polarized voting, that will make the Democratic nominee the heavy favorite in next year's general election.

But that hasn't stopped a number of Republicans from hoping they can pull off an unlikely upset. The GOP field includes two politicians, state Sen. Greg Albritton and former state Sen. Dick Brewbaker, both of whom are white. Another late entrant was former NFL defensive end Wallace Gilberry, who was a star for the University of Alabama's Crimson Tide before playing professionally for nine seasons; Gilberry is Black.

AL-07: State Senate Minority Leader Bobby Singleton has opted against a primary challenge to Democratic Rep. Terri Sewell in the 7th District, despite saying in September that he was "looking forward" to just such a campaign, according to AL.com's Roy Johnson. When he announced he was considering a bid, Singleton told the Alabama Daily News, "I want the big fish." But when the filing deadline came and went, Singleton's name was nowhere to be found on the menu. Sewell should have no problem winning another term in the majority-Black 7th, which would have voted for Joe Biden 64-35, per Dave's Redistricting App.

CO-04: State Rep. Richard Holtorf declared Thursday that he was entering the June GOP primary to succeed retiring Rep. Ken Buck in this reliably red eastern Colorado constituency. Holtorf formed an exploratory committee back in September before the incumbent announced that he wouldn't run again, but the state representative isn't done trashing his would-be opponent. "Ken Buck let us down when he failed to push for the Trump agenda," declared Holtorf.

Holtorf, who cosponsored a resolution last year calling for a "full forensic audit of the 2020 and 2021 elections in Colorado," has also made it clear exactly what he thinks of Buck's anger with Republicans who refuse to accept Joe Biden's win. He previously took Buck to task for condemning a letter from local Republicans accusing the federal government of violating the rights of Jan. 6 defendants, as well as Buck's opposition to his party's fervor to impeach Biden. "Why is he on CNN and MSNBC?" Holtorf asked in September, "I don't think the message he is explaining represents the sentiment of the district."

Holtorf, by contrast, made national news in 2021 when he called a Latino colleague "Buckwheat," claiming later that he didn't know of the racist origins of the word. Holtorf again attracted unwanted attention again the next year when he accidentally dropped his gun in the state capitol while rushing to a vote, an episode that one observer called "reckless and scary."

FL-20: The House Ethics Committee announced Thursday that it was investigating Democratic Rep. Sheila Cherfilus-McCormick, though it did not include any details about what it was looking into. A spokesman for Cherfilus-McCormick, who represents a safely blue seat in South Florida, only said the congresswoman was "committed to compliance and will work to see that the matter is resolved."

OH-02: Republican Rep. Brad Wenstrup's Thursday evening retirement announcement unexpectedly set off an open-seat race for Ohio's 2nd District, a longtime conservative bastion in the eastern Cincinnati suburbs. Donald Trump took this constituency 72-27, so whoever wins a plurality in the March 19 GOP primary should have no trouble holding it. But because the filing deadline is Dec. 20, Wenstrup's potential successors have only a few weeks to make up their minds.

Wenstrup himself got to Congress after pulling off a major primary upset against the infamous Rep. Jean Schmidt in 2012, when he made his second bid for office. Wenstrup, who worked as an orthopedic surgeon, was awarded a Bronze Star by the Army for his service as a combat surgeon in Iraq in 2005 and 2006. He also had a small, albeit apolitical, fanbase back in southern Ohio: When Cincinnati Enquirer reporter John Kiesewetter asked which local physicians fit the nickname "Dr. McDreamy" from "Grey's Anatomy," some readers submitted Wenstrup's name.

Wenstrup entered the officially nonpartisan 2009 contest for mayor of Cincinnati but lost to Democratic incumbent Mark Malloy, albeit by a respectable 54-46 margin. Though he said he didn't have any plans to enter another race, he would later tell the Enquirer his feelings changed after a religious retreat in early 2011. "One of the themes of the retreat was, 'What are you going to do with the rest of your life?'" he'd recount the next year. "I felt Congress was the place to be. It was the place where I could make a difference, and I wanted to go for it."

The incumbent he decided to challenge in the 2012 primary, though, seemed secure despite a rough tenure in office. Schmidt had struggled to win her initial 2005 special election against Democrat Paul Hackett months, even though George W. Bush had decisively carried the 2nd District—a poor performance she followed up with weak victories in both the 2006 and 2008 general elections. However, the woman nicknamed "Mean Jean" by her many enemies finally had an easy time during the 2010 red wave, suggesting that she had at last turned a corner.

The ultraconservative Schmidt, though, managed to alienate her base when she gave President Barack Obama a kiss on the cheek at the president's State of the Union address in 2012, a gesture that played badly in the tea party era. The House Ethics Committee had also determined that Schmidt had improperly taken $500,000 in legal services from a Turkish group.

On top of that, redistricting left Schmidt with a seat that was about a quarter new to her. A new super PAC called the Campaign for Primary Accountability, which had the stated goal of denying renomination to incumbents from both parties, got involved with a $50,000 radio and phone campaign attacking the congresswoman.

But it was still a major surprise when Wenstrup, who didn't air a single TV ad, racked up a 49-43 win that March—a result that made Schmidt the first member of Congress to lose reelection that cycle. "Jean has always had some tough races, but she's always sort of hung on and won, so I guess I expected that again," fellow Ohio Rep. Jim Jordan told Roll Call after the votes were tallied. "It just wasn't on my radar screen."

Observers realized in retrospect that it hadn't been on Schmidt's radar screen either. The congresswoman had gone on the air only in the final days of the race and even spent the morning of the primary in D.C. rather than campaigning at home. "She just didn't work it or take this seriously," one national GOP source told Politico hours after the dust had settled. (Schmidt eventually resurrected her career by winning a state House seat in 2020.) Wenstrup, unlike the congresswoman he'd just beaten, had no trouble in the general election, and he never struggled to hold the 2nd.

Wenstrup attracted national attention in 2017, when he treated Rep. Steve Scalise immediately after a gunman shot the Louisianan at practice for that year's congressional baseball game. "Happened to have Brad Wenstrup on the field that day, and he was one of the first to come to my side," Scalise would say when he returned to Congress months later. "Who would've thought that God would've put Brad out there on that field with me because the tourniquet he applied―many will tell you―saved my life so that I could actually make it to the hospital in time with all the blood loss."

Wenstrup would later sign on to the lawsuit alleging "unconstitutional irregularities involved in the 2020 presidential election," though he'd ultimately vote to recognize Joe Biden's win in the hours after the Jan. 6 riot at the U.S. Capitol. The congressman expressed interest a few weeks later in running to fill the seat held by retiring Sen. Rob Portman, but he ultimately decided to seek what would be his final term in the House.

WA-06, WA-Gov: Commissioner of Public Lands Hilary Franz announced Friday that she was ending her uphill bid for governor and would instead run for the seat held by Rep. Derek Kilmer, a fellow Democrat who announced his retirement the day before. Franz served on the city council for Bainbridge Island, which is located in the 6th, from 2008 to 2011, though the Seattle Times writes that she's since registered to vote outside the district in Seattle. However, Franz's announcement says she lives in Kilmer's district in Grays Harbor County.

On the GOP side, state Sen. Drew MacEwen told the paper Friday that he was forming an exploratory committee. This seat backed Joe Biden 57-40, though Democrats will want to keep an eye out to make sure two Republicans don't advance past the August top-two primary.

Attorneys General

NC-AG: Durham County District Attorney Satana Deberry unexpectedly announced Friday she would seek the Democratic nomination for attorney general. Deberry will take on Rep. Jeff Jackson, who until now had no serious opposition in the March primary to replace their fellow Democrat, gubernatorial candidate Josh Stein. The winner will likely take on far-right Rep. Dan Bishop, who still has no major opponents in the GOP contest.

Deberry was elected in 2018 to become the top prosecutor for Durham County, which is the bluest in the state, and she won again last year. Deberry, who would be the first Black woman to hold one of the 10 statewide offices that are part of the North Carolina Council of State, has touted herself as a "progressive prosecutor."

Prosecutors and Sheriffs

Snohomish County, WA Sheriff: Susanna Johnson declared victory Thursday evening over hard-right Sheriff Adam Fortney after more ballots were tabulated from Nov. 7's officially nonpartisan race. Johnson led 51-48, a margin of almost 5,400 votes, with heraldnet.com saying there just 500 ballots left "plus any mail-in ballots still en route." Fortney had the county GOP's support, while Johnson had the support of several Democratic groups.

Fortney was elected to this post in 2019, and he spent the first months of his tenure refusing to enforce Democratic Gov. Jay Inslee's public health rules. He's also rehired deputies accused of wrongdoing, including one fired for an unjustified killing. Johnson, who would be the first woman to hold this post, told Bolts Magazine the return of these deputies inspired her to run, arguing it's led to constituents becoming "terrified of the cops."

Where Are They Now?: Former Baltimore State's Attorney Marilyn Mosby was convicted Thursday evening on two counts of perjury, and each carries a maximum sentence of five years in prison. Mosby last year took third place in her Democratic primary against the eventual winner, Ivan Bates.

Prosecutors argued that Mosby lied when she submitted paperwork to withdraw $90,000 from Baltimore's Deferred Compensation Plan during the pandemic, as she checked the box saying she'd suffered "adverse financial consequences" when her salary actually rose. Mosby's team insisted that the travel business she founded had been forced to close, but prosecutors made the case that it never had any employees, clients, or income. Mosby still awaits trial for allegedly filing false mortgage applications.

House Speaker Johnson facing first true challenge since climbing leadership ladder

House Speaker Mike Johnson, R-La., faces his first true test this week. The newly elected House speaker is offering something he’s characterized in recent weeks as a "laddered CR." Yeah, not a lot of people in Washington knew what that was either.

Johnson engineered a plan to fund the entire government on a temporary basis through Jan. 19, which is when Congress is expected to pass one batch of spending bills to avert a shutdown. The remainders would have until Feb. 2.

The "laddered" concept stems from dealing with one "rung" of bills by one date and the next "rung" of bills later on. Laddered. Get it?

WHEN IT COMES TO THE NEXT SHUTDOWN FIGHT IN CONGRESS, SILENCE IS GOLDEN

Call it what you will, but what Johnson proposed is a "CR" – short for "Continuing Resolution." An interim spending bill which simply renews all funding at current levels to avoid a government shutdown early Saturday morning.

Ironically, this is exactly the same legislative idea that got former House Speaker Kevin McCarthy, R-Calif., canned earlier this fall. So, what gives?

It’s rebranding. Companies change their names all the time. Firms wrap their products up in shinier, newer packages. It doesn’t affect the stuff inside. The term "CR" became toxified inside some quarters of the House Republican Conference. So, you have to alter the marketing. Moreover, Johnson reiterates that he is committed to advancing the 12 annual appropriations bills which fund the government one by one as Republicans promised.

Except for a couple of things. A CR is still a CR. There was never enough time from when Johnson clasped the gavel to advance all the spending bills through the House and merge them with the Senate to avoid a shutdown, so this was the only way out of this cul-de-sac for Johnson.

But moreover, Johnson is running into the same problems which dogged his predecessor. Republicans insist on passing their own partisan spending bills individually, but they can’t.

Republicans had to yank a Transportation/Housing spending bill off the floor last week and did the same with a Treasury/White House spending bill on Thursday.

And for the record, the latter bill met its demise after the House rejected an amendment to reduce the pay of White House spokeswoman Karine Jean-Pierre to $1 a year. That’s right. $1.

What is this? The Price is Right?

Jean-Pierre’s annual take-home pay is $188,000. Point being, Republicans burned crucial time making amendments like those pertaining to Jean-Pierre in order for debate and a vote when they couldn’t even get the overall legislation to pass.

These appropriations bills are not exactly ready for the Showcase Showdown.

THE SPEAKER’S LOBBY: THE HITCHHIKER’S GUIDE TO A POSSIBLE GOVERNMENT SHUTDOWN

It’s far from clear whether the House can even pass Johnson’s proposal. And, because of GOP skepticism, Johnson may need to rely on Democrats to avert a government shutdown. Sound familiar?

If Republicans give Johnson a pass and approve his "laddered" CR – especially with Democratic assistance – we will have confirmed something significant about the Speaker’s debacle which consumed most of October and prompted McCarthy’s ouster: the motion to vacate the chair was never about spending bills or legislation. It was a personal vendetta against McCarthy.

But back to the task at hand: government funding expires at 11:59 p.m. ET Friday. There is not much turning radius to move a bill of any sort through the House and through the Senate. Either way, it doesn’t appear that Johnson faces some of the same opprobrium which was leveled at his predecessor, but Johnson doesn’t appear to have a Midas Touch yet, either.

Lawmakers from both sides long suggested that Johnson would enjoy a "honeymoon" after finally securing the gavel following a brutal three weeks incinerating one speaker and three speaker nominees.

"There’s a honeymoon period here. I’m not sure how long that lasts. Maybe 30 days," opined Rep. Thomas Massie, R-Ky., late last Thursday.

But minutes later, House Republican leaders pulled the Treasury/White House bill from the floor because it lacked the votes to pass.

"With what’s going on over on the floor today, I think that indicates that the honeymoon might be shorter than we thought. And every time the CR expires, the speaker’s putting his head in the lion’s mouth," said Massie.

Johnson may not be able to control the CR and he also can’t control privileged resolutions offered by Rep. Majorie Taylor Greene, R-Ga., who filed a special resolution late last week to impeach Homeland Security Secretary Alejandro Mayorkas. 

Since the resolution is "privileged," it goes to the front of the legislative line. The House will likely consider Greene’s gambit on Tuesday.

It’s possible that the GOP-led House could impeach Mayorkas with no hearings, no depositions and no markup of a resolution. This would be after Republicans brayed for months about "the regular order." Greene said it was too late for all of that.

"No more strongly worded letters. No more committee hearings. No more clips on the press. We have to do something about it," she said.

HOUSE MAY VOTE ON IMPEACHING MAYORKAS WITHOUT A MOTION TO TABLE: SOURCE

To be frank, many Republicans would rather talk about impeaching Mayorkas instead of actually impeaching Mayorkas, especially with no committee hearings or markups. 

The House just voted to table (or kill) a resolution to expel Rep. George Santos, R-N.Y., because the Ethics Committee hadn’t completed a report on his conduct. Moreover, Johnson said on Fox he was concerned about "due process," but that’s cast to the wind with Greene’s measure to impeach Mayorkas.

A senior House leadership source told Fox to expect a straight up or down vote on the Mayorkas resolution. In other words, no motion to table. Of course, Democrats could move to table, but it’s unclear if they would do that. Democrats don’t want Mayorkas impeached, but they may feel it’s a victory either way.

One of two things will happen: The House votes to impeach Mayorkas. If so, he becomes only the second cabinet officer ever impeached. The last was Secretary of War William Belknap in 1876, but Democrats know that the Senate would never hold a full trial on Mayorkas. It must start the process. But the Senate can vote to dispense with the articles.

Democrats will view impeachment as a victory because Republicans wasted their time – impeaching Mayorkas – as the government runs out of money. They’ll also point to who authored the articles of impeachment: Greene.

The other scenario is if the House fails to impeach Mayorkas. It’s far from clear that the House has the votes to do so. Democrats will then point to Republicans chattering ad nauseam about impeaching Mayorkas and then stumbling. 

All talk and no action, and some Republicans have had it.

"I’m not going to be thinking a lot about every privileged resolution that Majorie (Taylor) Greene files because we’ve got real work to do," said freshman Rep. John Duarte, R-Calif., who represents a battleground district and won by 564 votes in 2022. "I’m not interested in these peripheral impeachments."

Regardless, Democrats will point to election results last week in Kentucky, Virginia and Ohio and suggest that Republicans are again focused on the wrong things.

Not everyone in the nation knows who Mike Johnson is yet, but if the government shuts down on Saturday, you can bet everyone will learn who he is.

So, you can dress things up by applying lipstick, mascara and anything else on a CR… but it’s still a CR. That’s something Republicans abhor, but Johnson has no choice when his side still can’t even pass their own spending bills.

There is one school of thought on Capitol Hill that maybe a shutdown is inevitable. Congress narrowly averted a shutdown once McCarthy put a straight, six-week CR on the floor at the last minute, so maybe McCarthy simply delayed a shutdown. McCarthy paid the price for preventing that earlier in the fall.

Johnson won’t pay an immediate price regardless of how things go. He might not get a laddered CR, but this is the challenge Johnson faces for climbing the leadership ladder.
