Tuberville blasts Biden’s Space Command decision: ‘This is absolutely not over’ 

Sen. Tommy Tuberville (R-Ala.) blasted President Biden’s decision Monday to keep the headquarters of the Space Command in Colorado, overturning former President Trump's decision to move it to Alabama.

“As soon as Joe Biden took office, he paused movement on that decision and inserted politics into what had been a fair and objective competition—not because the facts had changed, but because the political party of the sitting President had changed,” Tuberville said in his statement.

Tuberville is locked in a standoff with the Pentagon over its abortion policy, placing a hold on hundreds of Biden's military nominations in protest.

Some officials have said Alabama's restrictive abortions laws played into the Space Command HQ decision, though the White House said it was motivated entirely by concerns that a major move would undermine military readiness.

Tuberville wrote that it was “shameful” the Biden administration waited until Congress was in recess to make this decision, noting it came after the House and Senate passed versions of next year’s defense budget. The two chambers still need to hammer out a final version of the defense budget.

And he claimed that Colorado Springs did not even crack the top three sites for the headquarters in a review by the Air Force, trailing locations in Alabama, Nebraska and Texas.

“This decision to bypass the three most qualified sites looks like blatant patronage politics, and it sets a dangerous precedent that military bases are now to be used as rewards for political supporters rather than for our security,” he wrote.

Trump's initial decision to move the HQ to Alabama also prompted claims of political motivations from Democrats. Alabama overwhelmingly voted for Trump in the 2020 election and has two GOP senators, while Colorado voted for Biden and has two Democratic senators.

Tuberville on Monday said the fight to bring the headquarters to Alabama was “not over,” adding he hopes House Armed Services Committee Chairman Mike Rogers (R-Ala.) will continue an investigation into the matter.

“This is absolutely not over. I will continue to fight this as long as it takes to bring Space Command where it would be best served—Huntsville, Alabama,” he said.

Rogers said in a statement that he will continue the committee's investigation into the relocation of the headquarters, also saying the “fight is far from over.”

“The Biden administration’s shameful delay to finalize the permanent basing decision for U.S. Space Command warranted the opening of a Congressional investigation," Rogers said.

"I will continue this investigation to see if they intentionally misled the Armed Services Committee on their deliberate taxpayer-funded manipulation of the selection process. I will continue to hold the Biden administration accountable for their egregious political meddling in our national security."

Other Alabama Republicans, including Sen. Katie Britt and Gov. Kay Ivey, also took aim at Biden’s decision Monday.

“President Biden has irresponsibly decided to yank a military decision out of the Air Force’s hands in the name of partisan politics,” Britt said in a statement. “Huntsville finished first in both the Air Force’s Evaluation Phase and Selection Phase, leaving no doubt that the Air Force’s decision to choose Redstone as the preferred basing location was correct purely on the merits."

“The White House choosing to not locate Space Command Headquarters in Alabama – the rightful selection – is very simply the wrong decision for national security,” Ivey posted on X, the platform formerly known as Twitter. “The fact that a CNN reporter is who first delivered the news to Alabama should say all.”

Biden campaign co-chair: Code of conduct for presidential family members ‘may be worth looking at’

Sen. Chris Coons (D-Del.), a co-chairman of President Biden’s reelection campaign, on Sunday suggested it may be worth looking at a code of conduct for family members of presidents.

NBC "Meet the Press" host Chuck Todd asked Coons if Congress should try to address creating a code of conduct for presidential family members, including sons and daughters of sitting presidents.

“That may be worth looking at, because frankly, as you referenced, Jared Kushner wasn't just a private citizen,” Coons said, referring to former President Trump’s son-in-law.

Todd responded, “So if you're outraged about Hunter Biden, you should be outraged about Jared Kushner.”

“You can’t pick and choose,” Coons said.

Coons also mentioned that the Senate has been working on trying to get the Supreme Court to adopt a code of ethics, similar to how members of Congress have to disclose their assets and stock holdings.

Coons comments some as Biden’s son, Hunter Biden, has been in the spotlight over his legal issues. The younger Biden appeared in a Delaware court last week, where his plea deal on federal tax and gun charges was put on hold by a judge who questioned the scope of the agreement. 

Hunter Biden has faced other legal issues over a daughter he has in Arkansas. The young girl’s mother filed a paternity suit against him in May 2019, and he appeared in court this May. In June, he reached a settlement in his child support case after being ordered to sit for a deposition under oath to answer questions about his finances.

The president made his first public remarks about his 4-year-old grandchild Friday, after silence from the White House over the young girl.

Trump: McConnell freeze-up ‘a sad thing to see’

Former President Trump said it was “a sad thing to see” Senate Minority Leader Mitch McConnell (R-Ky.) freeze at the podium during a press conference and called for new leadership atop the Senate GOP.

“We have to have that,” Trump said when asked whether he wants to see new leadership after McConnell’s freeze-up last week. Trump offered the comments in an interview on Breitbart News that aired Sunday.

Trump said it was “sad” to see McConnell freeze up, while continuing to criticize the way McConnell had led the Senate GOP.

“Well, I thought it was sad. At the same time. I think it's a shame that he went so far out to give Green New Deal money to Biden and the Democrats,” he said, adding, “But that was too bad. That was actually a sad thing to see. He had a bad fall, I guess and probably after effect of that, but it was also sad that he gave trillions and trillions and trillions of dollars to the Democrats to waste on the green New Deal.”

Trump added later about McConnell: “At the same time, I hope he's well.”

Trump and McConnell have repeatedly battled since the GOP leader staunchly criticized Trump for his actions on Jan. 6, 2021. McConnell did not vote guilty in Trump's impeachment trial but ripped him in a dramatic speech on the Senate floor at the trial's conclusion.

McConnell has also signaled his displeasure with Trump's influence in GOP primaries, which a number of Republicans argue was a factor in helping Democrats keep the majority in that chamber.

Trump's criticisms repeated his past attacks on McConnell and two pieces of legislation backed by President Biden. One is a bipartisan transportation bill that McConnell supported, but the chief climate provisions passed by the Biden administration were in the Inflation Reduction Act, which McConnell opposed and did not receive GOP support.

During a press conference last week, McConnell stopped talking mid-sentence and froze, prompting his colleagues to inquire about his well-being and pause the news conference momentarily, before McConnell returned and insisted he was “fine.”

McConnell, at 81 years old, has been Senate GOP leader for 16 years and in January became the longest-serving Senate leader in history, surpassing a record set by former Sen. Mike Mansfield (D-Mont.).

In his comments about the freeze-up, Trump did not comment on McConnell’s age — which has been raised often in conjunction with the incident — and attributed McConnell’s episode to the fall he had earlier this year, when McConnell suffered a concussion. Recent reporting has also indicated McConnell suffered additional undisclosed falls.

McConnell’s health puts focus on shadow race to replace him 

Senate Republican Leader Mitch McConnell’s (R-Ky.) health scare has Republican senators wondering whether the 81-year-old lawmaker will stay in the top job beyond the 2024 election and who might eventually replace him.  

McConnell plans to serve out his current term as leader and has given every indication that he intends to return as Senate GOP leader in the 119th Congress, which starts in January of 2025 — hopefully from his point of view with Republicans in control of the Senate majority.  

Yet Republican senators privately acknowledge that McConnell appears to be frailer since falling and suffering a concussion on March 9, which resulted in him being hospitalized for several days. The accident required rehabilitation at an inpatient facility and kept him away from the Capitol for more than a month.  

McConnell’s health came back into the spotlight Wednesday when he froze midsentence while delivering his opening remarks at the weekly Republican leadership press conference and had to step away from the podium and return to his office for a few minutes to recover.  

He later insisted that he was “fine” and declined to comment specifically about any health problems he may have, leaving GOP colleagues to speculate about how much longer he will serve as leader and who has the inside track to replace him. 

“I think the leadership race is well underway and this accelerates that,” said a Republican senator who requested anonymity to discuss the fallout from McConnell’s health episode before television cameras Wednesday.  

The lawmaker noted that Senate Republican Whip John Thune (R-S.D.) ran the Senate floor this month during the debate and votes on the annual defense authorization bill, with his staff working in close coordination with floor staff to get agreements on amendments and resolve objections.  

“Thune is running the floor, he’s running the [National Defense Authorization Act] negotiations,” the lawmaker said. 

Thune helped get 80 amendments adopted to the defense bill — through the manager's package, roll call votes and voice votes — helping GOP colleagues ring up accomplishments.

The senator said the shadow race to one day replace McConnell has boiled down to Thune, Sen. John Cornyn (Texas), who previously served as Senate GOP whip, and Senate Republican Conference Chairman John Barrasso (Wyo.).  

“Cornyn has been very solicitous” about raising money for Republican senators who are up for reelection next year, showcasing his fundraising ability, which has been one of McConnell’s greatest strengths as leader, the senator said.  

Cornyn’s joint fundraising committee, the Cornyn Victory Committee, has raised $4.12 million for Senate GOP incumbents, future Senate GOP nominees and the National Republican Senatorial Committee (NRSC) through the first six months of this year.  

Cornyn raised a total of $20 million for Senate Republican candidates in the 2022 election cycle, more than any other Republican senator with the exception of McConnell and then-NRSC Chairman Rick Scott (R-Fla.).  

“We hope to exceed that,” Cornyn said of what he plans to do for the 2024 election compared to the $20 million he raised for candidates in the 2022 election cycle. 

“Historically, I used to just raise money for the senatorial committee and let them spend it the way they saw fit, but I found that colleagues appreciate the [direct] help,” he said. “It saves them their wear and tear and a little time so they can hopefully maximize their fundraising elsewhere.” 

McConnell continues to be a major force in fundraising and any successor would have big shoes to fill in that area. 

Two outside groups aligned with McConnell, the Senate Leadership Fund and One Nation, raised a combined $38 million during the first six months of 2023, setting a record for the first half of a nonelection year. 

Republican senators say they view Thune, who is 62, and Cornyn, 71, as the front-runners to become the next Senate GOP leader.  

“I think those will be the two that run for leader when that happens,” said a second Republican senator who requested anonymity to discuss the brewing succession battle.

The senator said “Cornyn’s been raising money for people for years” and has built a solid record as a major GOP fundraiser while pointing out it’s Thune’s “job” as whip to be managing the daily developments on the Senate floor.  

“I’m glad that he stepped up” during the floor consideration of the defense bill, the senator said, which came close to derailing because of an ongoing dispute over the Pentagon’s policy of paying for servicemembers to travel to obtain abortions.  

The senator said neither Thune nor Cornyn have said anything about running for McConnell’s job. But their ambitions to move up to the top job are an open secret.  

“The leadership is interesting times,” the senator remarked, noting that Thune and Cornyn “can’t discuss” their plans because it would be “rude” while McConnell is in the job.

Senators say Barrasso, 71, can’t be ruled out of the mix because he plays an important role as GOP conference chairman in pushing messaging strategy and could run as a more conservative alternative to Thune and Cornyn in a three-way race.

Barrasso, for example, voted against this year’s debt limit deal between Speaker Kevin McCarthy (R-Calif.) and President Biden, which other members of the Senate GOP leadership supported. 

Former NRSC Chairman Rick Scott (R-Fla.), who is up for reelection next year, hasn’t ruled out another run for Senate Republican leader.  

He challenged McConnell in November in what became an intense and sometimes acrimonious debate over the future of the GOP conference before losing by a vote of 36-10. 

A Senate Republican aide said Cornyn has had to be more aggressive in angling for a future opening for Senate leader because he does not currently hold a position in the elected leadership. He had to step down as whip because of term limits in January of 2019.

“Thune and Cornyn are the two names that have been in the mix the most because they have both been whip, and everybody knows that Cornyn wants the [leader’s] job more than anything,” the aide said.  

Cornyn has held regular lunches and coffees with fellow Republican senators to help maintain his relationships with colleagues.  

He has kept ties with the conservative wing of the GOP conference by regularly attending Monday evening meetings of the Senate Republican Steering Committee. 

Thune and Cornyn have both publicly expressed interest in becoming leader in the future but have also made clear that the job is McConnell’s for as long as he wants it.  

Thune earlier this year waved off a question about running for Senate Republican leader as putting “the cart before the horse.”  

He stepped in to handle some of McConnell’s responsibilities, such as leading the weekly leadership press conference, while McConnell underwent rehabilitation after his fall.

Likewise, Cornyn this week insisted to reporters that he isn’t actively running to become the next leader. 

“There’s no vacancies,” he said. “And those [leadership] elections won’t be until November 2024. So I guess the short answer is there’s nothing to prepare for.”  

Barrasso has only said he would like to continue serving the Senate GOP conference in whatever way is most helpful to his colleagues.  

The Wyoming doctor was in the spotlight himself Wednesday because he came to McConnell’s aid after he froze in the middle of delivering his opening remarks at the press conference.  

Barrasso acknowledged to reporters immediately afterward that he was “concerned” about McConnell’s health since his accident in March but hastened to emphasize “he’s made a remarkable recovery” and is “doing a great job leading our conference.” 

Some Republican senators downplayed the incident, which McConnell’s office attributed to the leader feeling “lightheaded,” as a blip that doesn’t affect his ability to lead the conference.  

“Naturally, anytime it happens I think you’re concerned, but in terms of his capabilities and ability to lead, no, I’m not worried about his ability to lead,” said Sen. Mike Rounds (R-S.D.).  

A third Republican senator who requested anonymity, however, said that some GOP senators feel they aren’t getting the full story about McConnell’s health, which is in turn fueling speculation about how much longer he will remain leader. 

“No one says what’s wrong with him,” the senator said. “I think there ought to be more transparency here.”

Lawmakers set to face ticking clock on health care priorities

The House and Senate left Washington for the month of August with a lengthy, time-sensitive to-do list waiting when they return, including multiple key health care priorities. 

There will only be three weeks before the end of the fiscal year to get everything done, and just 11 legislative days when both chambers will be in session at the same time. 

Congress faces a Sept. 30 deadline to reauthorize a sweeping pandemic preparedness bill, fund community health centers and renew opioid addiction services.

But the largest looming deadline is the appropriations bills to fund the Food and Drug Administration (FDA) and the Department of Health and Human Services (HHS), which are tied up in the House amid disagreements over abortion policies and spending levels. 

GOP leaders scuttled a vote planned for Friday on legislation funding the FDA and the Department of Agriculture after moderate Republicans objected to a provision that would reverse the FDA’s decision to allow the abortion pill mifepristone drug to be dispensed through the mail and in retail pharmacies. 

House Freedom Caucus members have also been demanding even deeper spending cuts than agreed to in the bipartistan debt ceiling deal. 

The Labor-HHS bill advanced through a House Appropriations subcommittee earlier this month, but hadn't even made it to the full committee before recess. The Republican-led House bill would slash or eliminate funding from a range of programs that deal with everything from family planning to teen pregnancy and even HIV.

Both FDA and HHS funding bills face a major fight in the Democratic-controlled Senate, where the Appropriations Committee has already passed its own version by near unanimous margins, owing to an agreement by Democratic and Republican leaders not to insert “poison pill” amendments. 

House Democratic Whip Katherine Clark (Mass.) argued in a floor speech that lawmakers should stay in Washington to strip out the “toxic, divisive, bigoted riders” in the bills, and ripped Republicans for delaying votes until September.

Pandemic preparedness

The House and Senate are taking different tracks in the reauthorization of the pandemic preparedness bill, complicating its path forward. 

The Senate advanced a bipartisan version of the Pandemic All-Hazards Preparedness Act out of committee, but the House is divided. House Energy and Commerce Committee Republicans advanced a bill on party lines after Democrats introduced their own version.

The primary disagreement is over drug shortages. Democrats are clamoring to give FDA more oversight authority to address the shortages, but Republicans are insisting on keeping the issues separate. 

The Senate version contains some provisions addressing drug shortages, but only one involves beefing up FDA authority. 

Congress is under pressure to stem drug shortages amid reports of doctors rationing cancer drugs and other medicine. Republicans on the Energy and Commerce Committee have said they are committed to dealing with the problems, but that it shouldn't be part of the preparedness bill. 

Energy and Commerce Committee GOP leaders released a discussion draft Friday of drug shortage legislation focusing on the economic reasons for shortages, including giving some generic drug manufacturers the ability to raise the cost of their drugs if hospitals keep prices "artificially low" to the point where there's no economic incentive to produce or sell them. 

Health centers

Legislation to reauthorize funding for community health centers also faces partisan challenges. But in this case, the House cleared its bill on a bipartisan basis, while the Senate is still working through disagreements, highlighting the work to be done.

Sen. Bernie Sanders (I-Vt.), chairman of the Senate Health, Education, Labor and Pensions (HELP) Committee, originally wanted tens of billions of dollars more for the centers. He was asking for $130 billion to fund the centers over the next five years as well as $60 billion to help grow the health care workforce.

But Sanders ended up canceling a planned markup during the last week of July. Raising some eyebrows, Sanders said he is working with Sen. Roger Marshall (R-Kan.) to craft a bipartisan bill that will be "ready by the first week of September." 

Separately, Sanders and Senate Finance Committee Chairman Ron Wyden (D-Ore.) issued a joint statement pledging to partner and work toward legislation in the fall aimed at addressing primary care and other health care workforce shortages.

Opioids

At issue are several provisions of sweeping legislation signed into law in 2018 called the Support Act, which aimed to tackle the country's drug overdose epidemic. 

The House Energy and Commerce Committee advanced a bipartisan reauthorization and expansion bill, but advocates are concerned the Senate is behind. 

HELP Committee ranking member Bill Cassidy (R-La.) introduced his own version of the bill July 20, but hearings won't be scheduled until September. Cassidy has warned that the committee is wasting time on partisan bills instead of easy bipartisan wins, such as the Support Act. 

Insulin/PBM reform

Senate Majority Leader Chuck Schumer (D-N.Y.) has said for months that he wants to move legislation that would cap the cost of insulin at $35 per month for people with private insurance. 

There's hope to combine it with legislation reforming the pharmacy benefit manager (PBM) industry into a package that could get bipartisan support. 

But there's no looming deadline and no guarantee it will get taken up in September.  

Sen. Jeanne Shaheen (D-N.H.), who is a co-sponsor of one of the insulin bills with Sen. Susan Collins (R-Maine), said she still has Schumer's support heading into the fall but has not heard anything about timing.

Multiple committees have advanced PBM reform bills in both the House and Senate, so they will all need to be combined into one floor-friendly package.

GOP leaders strike out on getting Tuberville to bend

Senate GOP leaders didn't want it to get to this point.

They tried and tried to get Sen. Tommy Tuberville (R-Ala.) to lift the holds he's placed on hundreds of military promotions — which have opened Republicans up to attacks from the Biden administration. 

But their efforts have failed, and they are now in a situation where the earliest a resolution might be found is September — when lawmakers will also be busy trying to avoid a government shutdown at the end of the month. 

“It’s hung around for a while. I support his goals,” said Sen. John Thune (S.D.), the No. 2 Senate Republican. “The challenge obviously is the mechanism he used to get to the result has created some challenges. We want to figure out a way to resolve it and address that.” 

“There are conversations now going on, which is good — between him and the military and others. We’ll have some time in August to work on a path forward, and hopefully we’ll find it,” he said. 

Senate Minority Leader Mitch McConnell (R-Ky.) has been among those trying to find a resolution, Thune said. Tuberville said he and McConnell discussed the holds Wednesday, hours after the GOP leader froze and felt lightheaded in front of reporters. 

“At this point, everybody’s engaged trying to figure out how to solve this,” Thune added.

Tuberville began his holds in early March to protest a new Defense Department policy to reimburse service members who must travel to seek an abortion for those travel expenses.

Six months later, the list of holds has grown to 300. Senate Republicans were hoping to find a solution before leaving Washington for five weeks — five additional weeks during which those military officers will remain in limbo, fueling Democratic attacks and frustrating the Pentagon.

One Senate Republican said finding an offramp agreeable to both Tuberville and those opposed to the holds has become a “recurring discussion” in the Senate GOP conference, and that McConnell has been personally involved in that quest.

“There’s not a lunch that goes by that we don’t talk about it,” the senator said, but added there’s “no chance of a resolution” any time soon. 

Aside from the potential political and national security implications of the holds, McConnell is worried about the institutional implications. 

The longtime GOP leader recently told reporters at a press conference that he is concerned this could lead to a renewed Democratic effort to change the chamber’s rules. 

Despite disagreeing with Tuberville’s tactic, however, he says he recognizes it is the prerogative of any single senator to place a hold on a nominee. 

Senators on both sides of the aisle for months have been musing publicly and privately about what it would take to get the Alabama Republican to set his hold aside, but have come up empty at every turn. 

Initially, there had been hope that a vote on an amendment to the National Defense Authorization Act (NDAA) that would reverse the abortion travel policy could do the trick, and Sen. Joni Ernst (R-Iowa) led the effort.

But more recently, Tuberville has maintained that not only does any vote have to be standalone, but that the Pentagon would have to reverse its policy before any vote could be taken. 

Trying to bridge that gap for lawmakers has become a herculean challenge no one has been able to complete.

Tuberville didn’t comment on efforts by Senate GOP leaders to seek a remedy, but he criticized the Biden administration and Senate Majority Leader Chuck Schumer (D-N.Y.) for their lack of outreach in trying to strike a deal. He also hasn’t had any further conversations with Defense Secretary Lloyd Austin since their July 17 call and said that the initial series of calls didn’t yield anything productive.

“There’s no conversation from the other side. It’s ‘our way or the highway.’ … How does that help?” Tuberville said. “They’re not worried about it, I guess. … I hate it, for the promotions and all that.” 

He added that he has yet to talk to Schumer, who has refused to use up floor time moving the nominees through regular order because he believes it is the Senate GOP’s job to figure a way out of the maze of military holds. 

“This is the responsibility of the Republican Senate caucus. … It’s up to them. I think in August, pressure will mount on Tuberville, and I think the Republicans are feeling that heat,” Schumer said late Thursday. “He’s boxing himself into a corner.”

But Democrats are trying to increase that pressure, with President Biden on Thursday night laying into the Alabama Republican and arguing his holds are harming military readiness and creating instability within the ranks of the armed forces. 

“This partisan freeze is already harming military readiness, security and leadership, and troop morale,” Biden said in remarks at the Truman Civil Rights Symposium in Washington. “Freezing pay, freezing people in place. Military families who have already sacrificed so much, unsure of where and when they change stations, unable to get housing or start their kids in the new school.”

Senate Democrats also took to the floor before and after the NDAA vote Thursday to criticize their GOP colleague. Since the hold was put into place, Democratic senators have made 12 attempts to move the military promotions in bloc via unanimous request. 

Perhaps adding to the difficulty, Tuberville has received a boost in support from voters at home and from conservative corners of the Senate GOP conference who believe he is making the right call, albeit a difficult one. 

They also argue that if Senate Democrats truly want to move on some of the nominations, they can start to do so via regular order — a move Democrats have avoided in order to not set precedent. 

“Democrats think they have a winning political thing on this. I don’t think they do, and I think Sen. Tuberville morally is in the right position with regard to the issue of abortion,” Sen. Mike Rounds (R-S.D.) said. “The [Defense] Department has just as much of a responsibility to find a path forward as any single member does, and I’m not seeing the Department try to work in any fashion other than to simply put pressure on Sen. Tuberville.” 

“They’re not trying to find a path forward. They think this is one of those items where if they keep putting pressure on him, he’ll cave, and I don’t think he will,” Rounds continued. “On the issue, he’s correct.”

The Memo: McConnell and Feinstein’s stumbles raise awkward questions on age

Two high-profile incidents in quick succession involving Senate GOP Leader Mitch McConnell (Ky.) and Sen. Dianne Feinstein (D-Calif.) have put the issue of aging politicians front and center.

But the questions raised around mental capacity and fitness for office have no easy answers.

Proposals that might begin to address the issue, such as term limits or cognitive tests beyond a certain age, confront an instant Catch-22. In order to be enacted, they need the support of politicians who might be negatively impacted by them. 

Meanwhile, the people around those politicians have generally no incentive to nudge them to change their minds.

“I think some of what drives these people to stay on forever is a personal power thing that they can’t let go of," progressive strategist Jonathan Tasini said. “The second thing that drives this, though, is the staff. I think what really gets ignored is how the staff cover for people who clearly can’t function, because they themselves don’t want to lose their power.”

This week’s incidents involved two of five current senators who are 80 or older.

First, McConnell appeared to freeze up, for unexplained reasons, while delivering remarks to reporters Wednesday.

The following day, Feinstein seemed confused during a committee roll-call vote. Feinstein started giving general remarks, when all that was required was that she cast her vote. “Just say ‘Aye,’” her colleague, Sen. Patty Murray (D-Wash.), could be heard telling Feinstein.

Feinstein, 90, is the oldest sitting senator. McConnell is 81.

There are specific concerns about both senators, separate and apart from the broader issue of elected officials seeking to remain in office in their ninth decade.

McConnell suffered a concussion earlier this year in a fall at a Washington hotel — an incident in which he also suffered a broken rib. The accident kept McConnell away from the Senate of almost six weeks while he recuperated.

In the wake of Wednesday’s incident, it has also been reported by multiple outlets that McConnell suffered two other falls this year — one in Helsinki, and one at Washington’s Ronald Reagan National Airport.

Medical professionals have speculated as to whether what happened Wednesday may have been a seizure or mini-stroke.

The majority leader himself has professed to be “fine.” His staff have said of the incident that he felt “lightheaded.”

The Feinstein incident was, in some ways, more worrisome, given that concerns have been raised about her cognitive abilities for some time.

In late 2020, she asked the same question twice in succession, apparently unaware she was repeating herself, in a hearing with then-Twitter CEO Jack Dorsey.

Last year, the San Francisco Chronicle reported that four senators, including three Democrats, had told its reporters about their worries regarding Feinstein. One congressional Democrat representing California anonymously described a meeting at which he or she had to reintroduce themselves to Feinstein repeatedly.

Feinstein, who is retiring at the next election, has defended her own capabilities. Her staff has said she was “preoccupied” during Thursday’s roll call vote. 

Other allies have suggested there is an element of sexism in the apparent desire to push Feinstein out. They note examples of past male senators, including Sens. Strom Thurmond (R-S.C.) and Robert Byrd (D-W.Va.), whose capacities were widely believed to be diminished late in life but who did not face the same public pressure to step down.

Rep. Nancy Pelosi (D-Calif.), 83, was one of Feinstein’s most vigorous defenders in that regard. Pelosi announced she was stepping down as the leader of House Democrats last year, having spent 20 years atop her conference.

But the McConnell and Feinstein episodes are also important because of the way in which they illuminate a larger picture.

President Biden is 80 and prone to slips-ups, as when he recently twice referred to the war in "Iraq” when he clearly meant “Ukraine.”

Former President Trump is 77 and, while rarely hesitant in the Biden fashion, he often launches into bizarre asides during his long campaign speeches.

It’s not as if the issue of aging politicians is off-limits. GOP presidential contender Nikki Haley has proposed mandatory cognitive tests for office-holders 75 and older.

Her proposal was seen more as a shot across the bow of Biden and Trump specifically rather than an idea that had any real chance of being enacted. Haley, 51, talks often on the campaign trail about the need for “new generational leaders.”

Talk also bubbles up intermittently about term limits for senators and House members.

Term limits face the philosophical question of whether voters should be denied the chance to reelect who they wish for as long as they wish — presidency excepted. There is also the practical difficulty that politicians are not eager to vote to, in effect, abbreviate their own careers.

“The fact is, politicians — like pretty much everyone else — are living to older ages, and some people stay physically and mentally sharp and other people deteriorate somewhat,” said Tobe Berkovitz, a Boston University professor emeritus who specialized in political communications.

“The question is, should it be up to the voters or up to the doctors to decide when someone should be out of office.”

There is also the question of how any restriction on age or mental abilities would be codified or enforced. Sen. Bernie Sanders (I-Vt.) is 81, and even his most staunch ideological opponents don’t seriously question his mental capacity.

For the moment, it seems most likely that the issue of aging politicians will remain a conundrum without an obvious solution.

“It’s not that you reach 75 and you should be gone,” said Tasini.

Democrats balk at Alito assertion that Congress has ‘no authority’ over Supreme Court

Democratic lawmakers are criticizing Supreme Court Justice Samuel Alito’s recent interview with The Wall Street Journal (WSJ) in which he stated “no provision” in the Constitution allows Congress to regulate the Supreme Court.

“I know this is a controversial view, but I’m willing to say it,” Alito said Friday, referencing Congressional Democrats’ recent efforts to mandate stronger ethics rules. “No provision in the Constitution gives them the authority to regulate the Supreme Court — period.”

"I don’t know that any of my colleagues have spoken about it publicly ... But I think it is something we have all thought about," he told the Journal.

His remarks sparked pushback from a slew of House Democrats.

Rep. Ted Lieu (D-Calif.) argued Congress would always have regulation power over the high court.

"Dear Justice Alito: You’re on the Supreme Court in part because Congress expanded the Court to 9 Justices,” Lieu posted Friday on X, the platform formerly known as Twitter. "Congress can impeach Justices and can in many cases strip the Court of jurisdiction."

"Congress has always regulated you and will continue to do so," he added. "You are not above the law."

Rep. Alexandria Ocasio-Cortez (D-N.Y.) claimed the Supreme Court should be the "most scrutinized" because of its power.

“What a surprise, guy who is supposed to enforce checks and balances thinks checks shouldn’t apply to him," Ocasio-Cortez wrote. "Corruption and abuse of power must be stopped, no matter the source," she added. "In fact, the court should be *most* subject to scrutiny, bc it is unelected & life appointed."

“Alito’s next opinion piece in the WSJ is about to be ‘I am a little king, actually. The Constitution doesn’t explicitly say I’m not,’” she added in a separate post.

Both California Democratic Reps. Katie Porter and Adam Schiff also responded to the justice's remarks, calling his view "controversial."

“This view is more than controversial; it’s incorrect,” Porter said on X.  “This is coming from a justice who tried to hide the fact that he accepted luxury vacations on private jets. As a government official, I welcome the American people holding me accountable—why doesn’t Justice Alito?”

Schiff, referring to the ProPublica report that revealed an undisclosed Alaskan fishing trip the justice accepted in 2008 that was paid for by a conservative donor, said Alito's view shows why an "enforceable code of ethics" is needed. The investigation — paired with another that revealed Justice Clarence Thomas received financial gifts without disclosing them — ultimately led to lawmakers' push for the ethics review.

“Let’s translate these statements from Justice Alito, real quick: What we do and how we do it, who pays for our trips and our vacations, or a family member’s tuition, is none of your damn business,” Schiff posted on X. “So buzz off. They need an enforceable code of ethics. Now.” 

Sen. Sheldon Whitehouse (D-R.I.), the sponsor of a bill to reform Supreme Court ethics standards and a member of the Senate Judiciary Committee, also shared on social media that the Journal author of the interview with Alito is the lawyer for Leonard Leo, a prominent conservative legal activist who reportedly organized the fishing trip to Alaska that Alito attended alongside Paul Singer, a hedge fund manager whose plane they took.

“The lawyer who ‘wrote’ this is also the lawyer blocking our investigation into Leonard Leo’s Supreme Court freebies,” Whitehouse tweeted. “Shows how small and shallow the pool of operatives is around this captured Court — same folks keep popping up wearing new hats.”

Sen. Brian Schatz (D-Hawaii) claimed that Alito’s comments seemed “escalatory” and were meant to provoke a response.

“This seems escalatory, and nudges even reluctant court watchers and skeptics of statutory reforms towards doing something,” Schatz said. “I mean, this is a fancy way of telling everyone to pound sand because he’s untouchable.”

Other Democrats who offered their criticism of the Supreme Court justice's words include Rep. Ritchie Torres (N.Y.), Sen. Tina Smith (Minn.), Sen. Martin Heinrich (N.M.) and former Rep. Mondaire Jones (N.Y.).

Chip Roy trolls GOP colleague over Senate pages confrontation

Rep. Chip Roy (R-Texas) had a friendly ribbing for Rep. Derrick Van Orden (R-Wis.) on Friday, sharing photos of the Capitol Rotunda ceiling after Van Orden yelled at Senate pages who were resting on the rotunda floor Wednesday night.

“TGIF after a rough week, Senate Pages? I got a great photo, how about you?” Roy said on X, formerly Twitter.

Van Orden found a group of Senate pages — 16- and 17-year-olds who run messages and mail for the Senate — on the floor of the Capitol Rotunda. Pages generally rest in the rotunda when the Senate works late — as it did Wednesday night on National Defense Authorization Act Amendments.

When he saw the scene, he let loose on the teenagers, reportedly calling them "jackasses" and "little s----."

“Wake the f‑‑‑ up you little s‑‑‑‑. … What the f‑‑‑ are you all doing? Get the f‑‑‑ out of here. You are defiling the space you [pieces of s‑‑‑],” Van Orden said, according to the account provided by a page.

Van Orden later said he would not apologize, and that the teens were disrespecting the Capitol and its history by lying on the floor.

The incident has brought Van Orden under fire from his Senate colleagues, who defended the pages. Senate Majority Leader Chuck Schumer (D-N.Y.) addressed the incident on the Senate floor Thursday.

“I was shocked when I heard about it, and I am further shocked at his refusal to apologize to these young people,” he said.

“I can’t speak for the House of Representatives, but I do not think that one member’s disrespect is shared by this body, by [Senate Minority Leader Mitch McConnell (R-Ky.)] and myself.”

House Speaker Kevin McCarthy (R-Calif.) told reporters Friday that he would talk to Van Orden about the incident.

These 11 senators voted against the must-pass defense spending bill

The Senate passed its version of the annual National Defense Authorization Act (NDAA) on Thursday night with widespread bipartisan support.

Just 11 senators — including six Democrats, one independent and four Republicans — voted against the must-pass defense spending bill, which next heads into the reconciliation process as the Democratic-led Senate and Republican-led House attempt to find a compromise.

The Senate version largely avoided the culture wars provisions in the House version, which passed almost entirely with GOP support, but it still authorizes a topline figure of $886 billion — a figure that was too high for some senators on both sides of the aisle. The topline figure last year was $816.7, up from $777.7 billion in fiscal 2022.

Here are the 11 senators who voted against the upper chamber’s version of the bill:

Sen. Cory Booker (D-N.J.)

Sen. Mike Braun (R-Ind.)

Braun said Wednesday that he planned introduced several amendments to the defense spending bill, which he argued was driving government glut.

“It’s the most important thing we do here in the federal government, but we don’t do any budgets over there, we don’t do any audits,” he said in a video posted to X, the platform formerly known as Twitter. “It’s all part of the problem of why we spend too much money and then borrow it from future generations.”

Sen. Mike Lee (R-Utah)

Sen. Ed Markey (D-Mass.)

Markey called the $886 billion defense spending package “ridiculous" and claimed that the “bloated budget does not advance our national security.” 

“The American people have repeatedly heard from Republicans that we need to cut government spending—for education, for health care, for food assistance—and now they are enthusiastically throwing funding to their defense contractor friends,” Markey said in a series of posts on X.

“While I am grateful that the NDAA passed tonight includes my language to compel the [Department of Defense] to take the overdose crisis among service members and their families seriously, I can’t support a package that inflates military spending at the expense of working and middle-class families,” he added.

Sen. Jeff Merkley (D-Ore.)

Merkley similarly described the defense budget approved under the Senate’s version of the NDAA as “bloated.” 

“I voted against the excessive military spending in the NDAA,” he tweeted Thursday night. “The already bloated defense budget does not need to be injected with additional billions of dollars.”

Sen. Rand Paul (R-Ky.)

Sen. Bernie Sanders (I-Vt.)

Sanders explained his opposition to this year’s NDAA on the Senate floor Wednesday, pointing to several crises that lawmakers are seemingly overlooking while approving the large defense spending bill.

“We have a planetary crisis in terms of climate change. Our health care system is broken and dysfunctional. Our educational system is teetering. Our housing stock is totally inadequate. And these are just some of the crises facing our country,” he said.

“And what is very clear, I think, to the American people and to many people here in the Senate and those in the House, we’re not addressing those crises," Sanders continued.

He argued that Congress votes to increase the military budget every year with "seemingly little regard for the strategic picture facing our country."

“It just happens,” he said. “We don’t worry about people sleeping out on the street, we don’t worry about people who don’t have any health care, we don’t worry about people who can’t afford prescription drugs.”

Sen. JD Vance (R-Ohio)

Vance said his vote against the defense spending bill was due to its commitments to provide Ukraine with “years of additional military aid.”

“I’ve worked in good faith throughout this process to secure as many wins for Ohio as possible, and I’m proud that many of those priorities have been included in the final version of the NDAA,” Vance said in a statement Friday. 

“However, I cannot in good conscience support the broader package, which commits the United States to years of additional military aid for the war in Ukraine,” he added. “It’s disappointing to me that these significant priorities that would benefit Ohioans have been bogged down with such deeply problematic foreign policy proposals.”
